Organic Law 2/2006, of 3 May, of Education, as amended by the Organic Law 8/2013 of 9 December, for the Improvement of Educational Quality (LOMCE) highlights the importance of learning throughout life in the Spanish educational system. The preamble makes explicit the need to design the education system more flexibly, so that young people who have abandoned their studies early can take them and complete them and that adults can continue their education. learning throughout life.

In Article 5, it is expressed that the basic principle of the education system is to promote lifelong learning and that, to this end, it will prepare students to learn for themselves and to provide adult people with incorporation into the different teachings, favouring the reconciliation of learning with other responsibilities and activities. This same article states that the education system should facilitate and public administrations should promote the achievement of post-compulsory or equivalent secondary education by the entire population.

Order EDU/2095/2010, of 28 July, establishing the structure of the evidence for obtaining the title of Bachiller for persons over twenty years in the field of management of the Ministry of Education, established the characteristics and structure of the tests for obtaining the title of Bachiller for over twenty years, which, by means of the Organic Law 2/2006, of 3 May, of Education, will be organized periodically by the Administrations education in the field of their competences.

However, the current design of the test has failed to achieve the goal for which it was created, demonstrating year after year through its results that a rethink of its structure is convenient. In order to improve the achievement of the objective of the tests, the content of Order EDU/2095/2010 of 28 July 2010 should be reviewed in order to facilitate the overcoming of the difficulties resulting from the result of the result being concentrated in two parts, one of all the common subjects and another of the set of the subjects of modality, as well as that the positive qualification of both is in function of the overcoming of each and every one of the subjects that configure them, without possibility of that the independent results of the subjects were valid for later years.

In the elaboration of this order, the School Board of the State has issued a report.

By virtue of the above, I have:

Single item. Amendment of Order EDU/2095/2010 of 28 July establishing the structure of the evidence for obtaining the title of Bachiller for persons over 20 years of age in the field of management of the Ministry of Education.

Order EDU/2095/2010 of 28 July 2010 establishing the structure of the evidence for obtaining the title of Bachiller for persons over twenty years of age in the field of management of the Ministry of Education Education, in the following terms:

One. Article 4 is worded as follows:

" Article 4. Structure.

1. The test for obtaining the title of Bachiller for more than 20 years shall be organised in a differentiated manner according to the various forms of the Baccalaureate, each of the subjects listed in Articles 7, 8 being carried out for each year. and 9 of Order ESD/1729/2008, of 11 June, for which the ordination is regulated and the curriculum of the baccalaureate is established.

2. In order to carry out the test, the applicants must formalize the registration in all the materials that make it up, according to the modality and in their case the route chosen, being able to request at the moment of the registration the exemption of the realization of the exercises of those matters which may have the status of previously exceeded, validated or exempted, in accordance with the rules in force.

3. For the access and development of the exercises, the necessary accessibility measures shall be observed in each case for candidates with disabilities. "

Two. Article 5 (4) is deleted.

Three. Article 6 is worded as follows:

" Article 6. Validations, equivalences and exemptions.

1. Applicants may apply for recognition by the court of the condition of convalidated material, equivalent or exempt in accordance with the following rules:

(a) Royal Decree 777/1998 of 30 April 1998 on the development of certain aspects of the order of vocational training in the field of education.

(b) Royal Decree 986/1991 of 14 June approving the timetable for the implementation of the new management of the education system.

(c) Royal Decree 242/2009 of 27 February 2009 establishing convalidations between the professional teaching of Music and Dance and compulsory secondary education and the Baccalaureate, as well as the effects on the Physical Education matter must have the status of high level athlete or high performance and professional teaching of Dance.

(d) Order EDU/2395/2009 of 9 September 2009 regulating the promotion of an incomplete course of the education system defined by the Organic Law 1/1990 of 3 October of general ordination of the education system, to another of the Organic Law 2/2006, of 3 May, of Education

e) Order EDU/2739/2009 of 1 October, determining the convalidations between the professional teaching of Music and Dance and the compulsory secondary education and the Baccalaureate, and the exemption of Education Physical, in the field of management of the Ministry of Education.

(f) Resolution of 24 September 2009, of the Secretariat of State for Education and Vocational Training, establishing the validation of the optional subjects of compulsory secondary education and secondary education, in the field of management of the Ministry of Education.

2. It is up to the courts to assess the relevant validations, equivalences and exemptions. "

Four. Article 7 is worded as follows:

" Article 7. Overcoming the test.

1. In order to obtain the title of Bachiller through this test it will be necessary to overcome all the common subjects of both courses, six modality, three of first course and three of second course, of which at least five must be of the chosen modality or route, and two optional subjects, as laid down in Article 13.4 of Order EDU/3330 /2010 of 16 December 2010 on the teaching of a baccalaureate for adults on a night-time basis, distance and virtual distance, in the field of management of the Ministry of Education, as long as it is respected the rules of precedence set out in Annex II to Order ESD/1729/2008 of 11 June.

2. The result obtained in each of the materials that make up the test will be scored from 0 to 10; the score with decimals will be rounded to the nearest integer and in the case that the decimal digit is 5, the rounding will be made to the integer higher.

3. The student who finishes the professional teaching of Music and Dance shall receive the title of Bachiller if he exceeds the exercises of all the common subjects of Baccalaureate, in accordance with the provisions of Article 19.2 of the Order ESD/1729/2008, of 11 June.

4. Similarly, students who are in possession of the qualification of vocational training technician will obtain the title of Bachiller if they exceed the common subjects of Baccalaureate, as laid down in Article 34.3 of Royal Decree 1147/2011, of 29 of July, establishing the general management of the vocational training of the educational system.

5. The subjects covered by this test shall be considered, in addition, to be exceeded for successive calls or to pursue the teaching of adult Baccalaureate in the field of management of the Ministry of Education, Culture and Sport.

6. For applicants who meet the requirements for obtaining the title of Bachiller, the average Baccalaureate note shall be calculated in accordance with the rules governing it.

7. Those who successfully pass the test in any of its modalities will receive the title of Bachiller upon request. The obtaining of the title of Bachiller shall in any event be subject to compliance with the requirements of the current regulations.

8. All persons participating in the test may obtain, upon request, a certification of the results obtained. "

Final disposition first. Application of the order.

The head of the Secretary of State for Education, Vocational Training and Universities is empowered to dictate how many instructions and resolutions require the application of the provisions of this order.

Final disposition second. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
