Article 16.3 of Law 39/2007 of 19 November of the military career provides that the Council of Ministers, acting on a proposal from the Minister of Defense, will set the regulatory templates for the general, official and non-commissioned officers by bodies, scales and posts of the career military, except those for the first two jobs, the staff of which will be those resulting from the provision of places and the implementation of the The system of promotions by seniority, and which the Government will inform the General Cortes every time to approve a real template development decree.

The final provision second to Royal Decree 386/2013 of 31 May, laying down the regulatory templates for general officers, officers and non-commissioned officers of the Armed Forces for the period 2013-2017, authorizes the Minister of Defense to modify the templates of general officers of each annual period, in the sense of diminishing those of lieutenant general/admiral in increase of the general of division/vice admiral and to decrease the previewed ones for this job increasing the overall brigad/rear admiral, without any variation in the maximum number of general officers.

The general officer templates of the different corps of the Navy for the period 2013-2017, fixed by Royal Decree 386/2013, of 31 May, contemplate that during the cycle 2014/2015 a rear admiral of the Corps of Engineers and in the cycles 2015/2016 and 2016/2017, respectively, a Rear Admiral of the General Body.

The Navy's own needs advise to modify the templates in these bodies and jobs so that the amortization of a planned vacancy for the General Corps is carried out and is delayed by the Corps of Engineers, maintaining unchanged the maximum number of general officers provided for in Royal Decree 386/2013 of 31 May.

During its processing, this royal decree was informed by professional associations with representation in the Council of Personnel of the Armed Forces, pursuant to Article 40.2.b) of the Organic Law 9/2011, of July 27, of rights and duties of the members of the Armed Forces, and the professional associations registered in the Register of Professional Associations of members of the Armed Forces, in accordance with Article 40.1.c of the Cited organic law. Finally, according to the provisions of Article 49.1 (c) of the Organic Law 9/2011, of July 27, it was reported by the Armed Forces Staff Council.

In its virtue, on the proposal of the Minister of Defense, with the prior approval of the Minister of Finance and Public Administrations, according to the State Council and after deliberation by the Council of Ministers at its meeting of the March 27, 2015,

The Navy's templates listed in paragraph B of the Annex to Royal Decree 386/2013 of 31 May, laying down the regulatory templates for general officers, officers and non-commissioned officers of the Armed Forces for the period 2013-2017, are amended as follows:

One. Table 1, General Corps, for the jobs of Admiral General, Admiral, Vice Admiral and Rear Admiral, is replaced by the following:

Two. Table 4, Corps of Engineers, for the jobs of vice admiral and rear admiral, is replaced by the following:

Single end disposition. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
