The UNED, as a public university and file holder with personal data, is included, in respect of personal files, in the scope of the Organic Law 15/1999, of December 13, Protection of Personal Data.

Article 20 of this Law 15/1999, of 13 December, of Protection of Personal Data, and the 52 of Royal Decree 1720/2007, of 21 December, for which the regulation of the development of the Organic Law is adopted 15/1999, of 13 December, on the Protection of Personal Data, provides that the creation, modification or deletion of files of public administrations may be made only by means of a general provision published in the " Bulletin Official of the State " or Official Journal concerned.

Also, Articles 53, 54 and 55 of Royal Decree 1720/2007 of 21 December 2007 set out the form and content of the provision or agreement for the creation, modification or deletion of files, as well as the way in which The General Register of Data Protection shall be notified and entered in the Register.

In concrete terms, the UNED Statute states that the adoption of technical measures to ensure the security of personal data held by them (automated processing) will be the responsibility of the UNED technology.

As soon as it precedes, and the formalities laid down in Organic Law 15/1999, of 13 December and Royal Decree 1720/2007, of 21 December, I have:

The creation of the personal data files included in Annex I to this Resolution is appropriate.

Second. Modifying files.

The modification of the personal data files included in Annex II to this Resolution is appropriate.

Third. Deleting files.

The deletion of the personal data files included in Annex III to this Resolution is appropriate.

Fourth. Security measures.

The files that are created by this Resolution are created, comply with the security measures set out in Royal Decree 1720/2007, of 21 December, for which the regulation of the development of the Organic Law is approved 15/1999, of 13 December, Protection of Personal Data.

Fifth. Access rights, rectification, cancellation and opposition.

Those affected by the above files may exercise their right of access, rectification, opposition and cancellation of data, where appropriate, to the organ that is specified in this Resolution for each file.

Sixth. Proposal for a Resolution of the Governing Council of the National University of Distance Education, dated October 14, 2014, approving the recast text of the University's personal data files. Annex IV.

Entry into effect.

This Resolution shall enter into force on the day following its publication in the Official Gazette of the State.

Resolution of the Governing Council of the National University of Distance Education, dated March 3, 2015, approving the recast text of the University's personal data files

The existence of files containing personal data and technological advances, particularly computer systems, represent possibilities of interference in the area of privacy and privacy as well as of limitation and violation of the right to have the information that is relevant to each person. Therefore, the legal system recognizes rights in this field and establishes mechanisms for its guarantee.

The Spanish Constitution, in its article 18, recognizes as a fundamental right the right to honor, personal and family intimacy and the image itself and establishes that the " Law will limit the use of computer science to guarantee the honour and the personal and family privacy of the citizens and the full exercise of their rights. " The Constitutional Court, interpreting this article, has stated in its case-law, and in particular its judgments 290/2000 and 292/2000, that it protects the fundamental right to the protection of personal data by granting it a Own substance. This right has been called by the doctrine as "right to information self-determination", or "right to the provision of personal information" and which, when referring to data processing, is included in the broader concept of "freedom of information".

Organic Law 15/1999, of 13 December, of Protection of Personal Data and Royal Decree 1720/2007, of 21 December, for which the regulation of the development of the Organic Law 15/1999, of 13 December, is approved, of Personal Data Protection, establish a set of measures to ensure and protect this fundamental right.

Article 27.6 of the Constitution recognizes university autonomy. The Organic Law 6/2001, of 21 December, of Universities (LOU), establishes in its article 2.1 that the universities are endowed with legal personality and develop their functions in a regime of autonomy and coordination between all of them. In the terms mentioned in the LOU, the autonomy of the Universities includes: " a) the elaboration of its Statutes and, in the case of the Private Universities, its own rules of organization and operation, as well as of the rules of procedure internal ".

The UNED, as a public university and file holder with personal data, is included, in respect of personal files, in the field of application of the Organic Law 15/1999, of December 13, Protection of Personal Data.

Article 20 of this Law 15/1999, of 13 December, of Protection of Personal Data, and the 52 of Royal Decree 1720/2007, of 21 December, for which the regulation of the development of the Organic Law is adopted 15/1999, of 13 December, on the Protection of Personal Data, provides that the creation, modification or deletion of files of public administrations may be made only by means of a general provision published in the " Bulletin Official of the State " or Official Journal concerned.

Also, Articles 53, 54 and 55 of Royal Decree 1720/2007 of 21 December 2007 set out the form and content of the provision or agreement for the creation, modification or deletion of files, as well as the way in which The General Register of Data Protection shall be notified and entered in the Register.

In concrete terms, the UNED Statute states that the adoption of technical measures to ensure the security of personal data held by them (automated processing) will be the responsibility of the UNED technology.
