Law 3/2013, of 4 June, of the creation of the National Commission of the Markets and the Competition, in its transitional provision fourth, establishes that the National Commission of the Markets and the Competition will continue to exercise the functions transferred to the Ministries until such time as the ministerial departments have the necessary means to exercise them effectively.

In this same sense, the transitional provision sixth of Royal Decree 657/2013, of 30 August, for which the Organic Statute of the National Commission of the Markets is approved and the Competition has that at the order of the Minister of the Presidency, at the proposal of the ministerial department that will assume the functions and the Ministries of Economy and Competitiveness and of Finance and Public Administrations will be determined the date from which said ministerial Department begin to effectively exercise these powers.

In order to determine the date, coordination mechanisms have been established between the Ministry of Public Works and the National Commission of the Markets and Competition in order to carry out the transfer of personal and material effectively and without prejudice to the functions to be transferred that were being performed.

In addition, pursuant to the fourth provision of Law No 3/2013 of 4 June, the necessary amendments to the Royal Decree of 27 February 2015 have been adopted pursuant to Royal Decree 121/2015 of 27 February 2015. 452/2012, of 5 March, for which the basic organic structure of the Ministry of Development is developed and the Royal Decree 1887/2011 is amended, of 30 December, for which the basic organic structure of the departments is established In order to adapt it to the competences transferred to it, the ministerial budget to the new required competency distribution.

Finally, in order to ensure that the new functions entrusted to the Ministry of Public Works are properly complied with, the order determines the personnel transferred to the Ministry for the purpose of carrying out services related to the transferred functions.

In its virtue, on the joint proposal of the Minister of Development, the Minister of Economy and Competitiveness and the Minister of Finance and Public Administration, I have:

First. Effective exercise of the functions attributed to the Ministry of Development.

1. The Ministry of Public Works starts, on the day in which this order takes effect, the effective exercise of the functions that the Law 3/2013, of June 4, of the creation of the National Commission of the Markets and the Competition has attributed to it, in the conditions established in the aforementioned law, in its development regulations and in this order.

2. From this date the Ministry of Public Works is subrogated in all the rights and obligations provided for in the contracts, agreements and other agreements perfected by the National Commission of the Markets and Competition in the field of transferred competencies.

Second. Integration of staff in the Ministry of Public Works.

1. The posts and official staff from the National Commission of the Markets and the Competition that are listed in the Annex of this order are integrated into the Ministry of Public Works.

2. Effective integration occurs on the day of the entry into force of this order, developing the functions that correspond to it, going on to depend organically and functionally on the Ministry.

3. Personnel who are integrated into the Ministry of Public Works will continue in the situation of active service or where appropriate at the time of integration, retaining their status as an official, seniority and the personal level they have recognized.

4. The posts and the transferred personnel will be incorporated into the Postal Regime Subdirectorate General.

Third. Effectiveness.

This order shall have effect from the day following that of its publication in the "Official State Gazette".
