Article 20 of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, states that the creation, modification or deletion of the files of the Public Administrations may be made only by means of general provision published in the Official Journal of the State or corresponding official journal. Furthermore, the first provision of that rule directs the public administrations responsible for files to approve the provision of the creation of the files or to adapt the existing provision to the provisions of the law itself.

Also, Article 55 of Royal Decree 1720/2007 of 21 December, approving the Regulation of the Development of Organic Law 15/1999 of 13 December on the protection of personal data, states that the creation, modification or deletion of the files of the Public Administrations that include personal data will be notified to the Spanish Agency of Data Protection after publication of a general provision in the "Official Gazette" of the State ' or the Official Journal concerned.

Order MAM/30 4/2003, of February 11, regulated the automated files of personal data of the Ministry of the Environment, including files managed by the Tagus Hydrographic Confederation. On the other hand, the Order MAM/3783/2004, of October 26, extended the annex of the aforementioned order and incorporated, among others, the pension plan file of the Hydrographic Confederation of the Tagus.

According to the unique repeal of the Order AAA/905/2013 of 16 May, which regulates the files with personal data of the Tagus Hydrographic Confederation, Order MAM/30 4/2003, of 11 of February was repealed and this move to regulate the files of the Confederation.

The production of a new system for managing the activity of the staff of the Tagus Hydrographic Confederation working outside the facilities of the Agency and the use in the same of the technology of geolocation by GPS, for the positioning of the fleet of vehicles of the Hydrographic Confederation of the Tagus, compels the modification of the file of Human Resources in order to identify this new form of acquisition of information as well as the uses intended for the same.

It is also considered necessary to create a new data file with the name Management of Elencos, whose definition was initially included in the collection file. The separation in a file of its own will help to define its nature, not always linked with the collection, with greater precision.

In the preparation of this order, the Spanish Data Protection Agency and the Ministry of Agriculture, Ministry of Agriculture, Food and Environment have been asked to report.

In its virtue, I have:

Single item. Amendment of the Order AAA/905/2013 of 16 May, which regulates the files with personal data of the Tagus Hydrographic Confederation.

One. The HR Management file of Annex I of Order AAA/905/2013 of May 16, which regulates the files with personal data of the Tagus Hydrographic Confederation, is modified in the following terms.

Points (a) to (d1) are worded as follows:

" a) Identification and use of the file:

a.1) File Identification: HR Management.

a.2) Finality and intended uses: Management of the human resources of the entity (staff management, payroll, pension plan, social aids, control of costumes, control hours, diets and locomotion, geoppositional and location of personnel by means of GPS or similar systems, directory of users of the Agency's computer systems, identification and control of the officials of the Environmental Agents of Autonomous Bodies of the Ministry of Environment carrying out surveillance and inspection tasks.

a.3) Purpose typing: Human Resource Management; Nomina Management; Staff selection; Training; Management of the Agency's computer system users directory.

b) Data source:

b.1) Persons or collectives on which data are intended to be obtained by personal data or which are obliged to supply them: Public employees (officials and employees) who provide their services in the Confederation Garlic hydrographic, external staff and grantees.

b.2) Provenance: The interested party or its legal representative. Central Register of Personnel of the Ministry of Public Administrations. Geographical positioning data collected from geolocation systems using GPS or analog systems implanted in material means of the Agency (vehicles, telephones, tablets).

Three. A new file is created with personal data, managed by the Tagus Hydrographic Confederation, which is incorporated in Annex I of the Order AAA/905/2013, of May 16, which regulates the files with personal data of the The Tagus Hydrographic Confederation:

a.2) Purpose and intended uses: Maintenance of the user registry and identification of risks.

a.3) Purposes of Purposes: Administrative Procedure, Management of Regable Zones and Users, for the generation of Liquidations of Water Utilization Rates and Regulation Canons.

b) Data source:

b.1) Persons or collectives on which data of a personal nature is intended to be obtained or which are obliged to supply them: Citizens, users of services and goods located in the hydraulic public domain. Communities of Regants.

b.2) Source: The interested party or its legal representative, Public Administration Entities, Catastro.

c) Collection procedure: Data provided by the data subject or provided by other entities of the Public Administration, Catastro.

d) Basic file structure and the treatment system used in your organization:

d.1) Structure: Name and last name. National identity document number, Postal address, telephone, signature.

Other categories of personal data: data relating to farms and/or water uses made.

d.2) Treatment System: Mixed.

e) Communications for expected data:

e1) Recipients or categories of recipients: Judges and Courts. Article 11.2 (d) of Organic Law 15/1999.
