Article 15.1 of Law 55/2003 of 16 December 2003 of the Staff Regulations of the Staff Regulations of Health Services provides for the creation, modification and deletion of categories of statutory staff in the field of health the powers of each health administration, in accordance with the provisions of Chapter XIV and, where appropriate, Article 13 of that law. The former wording of Article 15 (2) provided that health services should communicate to the Ministry of Health the categories of statutory staff existing in them, as well as their modification or deletion and the creation of new categories, in order to proceed, where appropriate, to the approval of the various functional classes or categories of statutory staff, in order to ensure mobility in terms of effective equality of statutory staff in the system as a whole National of Health.

Since then, the health services, within the scope of competence granted to it by Article 15.1 of Law 55/2003, of 16 December, have deleted, created and modified categories of statutory staff according to the organisational criteria which each health service has considered appropriate, with the sole requirement of communicating it to the Ministry of Health to carry out its approval as provided for in Article 37.1 of that law. This has resulted in a diversity of professional categories that has posed a barrier to the mobility of professionals among health services.

On the other hand, article 43 of Law 16/2003, of 28 May, of cohesion and quality of the National Health System, determines that by means of royal decree, after agreement within the Interterritorial Council of the National System of Health, prior to the report of the Framework Forum for Social Dialogue, will establish the basic criteria and the conditions of the calls of professionals and the bodies responsible for their development that will ensure their mobility throughout the territory of the State, without prejudice to the powers legally conferred on the health administrations.

The Royal Decree-Law 16/2012 of 20 April, of urgent measures to guarantee the sustainability of the National Health System and improve the quality and safety of its benefits, amended Article 15.2 of Law 55/2003, 16 December, entrusting the Ministry of Health, Social Services and Equality with the approval of a homogeneous catalogue where the equivalences of the professional categories of health services were established. For these purposes, health services must communicate to the Ministry of Health, Social Services and Equality the categories of statutory staff existing in it, as well as their modification or deletion and the creation of new categories, where appropriate, to draw up this catalogue of equivalences and to be approved in accordance with the provisions of Article 37.1 of that law.

This homogeneous catalogue of professional category equivalences will allow statutory staff to access vacant places in other health services, improving the quality of care and making the guarantee of their mobility throughout the National Health System, as stated in article 43 of Law 16/2003 of 28 May.

The Ministry of Health, Social Services and Equality, in compliance with Article 15.2 of Law 55/2003, of 16 December, after its amendment by Royal Decree-Law 16/2012 of 20 April, has proceeded, after verification of the categories of statutory regime existing in the provisions in force in each health service of each autonomous community, to the identification of the current professional categories of statutory staff and, consequently, to the elaboration of the homogeneous catalogue of equivalences of the professional categories of staff statutory health services. This catalogue states the categories which are considered equivalent to each other and with respect to the so-called 'reference', in order to regulate an instrument which contributes to the guarantee of the right to mobility of statutory staff in the Set of the National Health System and the procedure for updating this catalogue, for the creation of new or modification or extinction of the currently existing professional categories.

In this sense, and in order to develop the model of nursing specialties in the National Health System, as well as to facilitate the mobility of the statutory staff who access the categories of nurses/specialists, In the field of the Human Resources Commission of the National Health System, it has been detected that those administrations responsible for the creation of categories of statutory personnel, who have not done so, will proceed to the creation of those corresponding to the nurses/specialists. It has also been informed by the Advisory Committee of the Interterritorial Council of the National Health System and by the Interterritorial Council of the National Health System.

In its virtue, on the proposal of the Minister of Health, Social Services and Equality, with the prior approval of the Minister of Finance and Public Administrations, in agreement with the Council of State and after deliberation of the Council of Ministers at their meeting on 13 March 2015,

DISPONGO:

CHAPTER I

General provisions

Article 1. Object.

This royal decree aims to guarantee the mobility, in terms of effective equality, of the statutory staff in the whole of the National Health System, through the approval of a homogeneous catalogue of equivalences of the professional categories of the statutory staff of the health services (hereinafter the catalogue), and the regulation of the procedure for updating the catalogue according to the health services of the autonomous communities creating, modifying and deleting those categories.

Article 2. Definitions.

For the purposes of this royal decree is understood by:

(a) Plaza: a basic destination for each professional category eligible for direct provision by means of convocation, within the framework of the mobility procedures provided for in Article 37 of Law 55/2003, 16 of December, the Framework Statute for statutory staff of health services.

b) Group and sub-group of professional classification: criteria for grouping and classifying the professional categories of statutory staff, in accordance with the qualifications required for access to them, as established, and with the same extension as for career civil servants, Article 76 and the third transitional provision of Law 7/2007, of 12 April, of the Basic Staff Regulations.

(c) Professional category: grouping of functions, qualifications, competences, group and functional sub-group of classification and certification, necessary and enforceable for the provision of a public service in the field of the System National Health, which conditions the incorporation and access of professionals to the health centers and institutions of this system in the group and subgroup of corresponding professional classification.

(d) Reference category: name of the category to which those regulated categories are equivalent in each health service with the same requirements for access in terms of qualifications, qualifications and other skills requirements and professional training, and which, in addition, perform the same tasks and tasks, regardless of their original denomination.

(e) Equivalent category: grouping of functions, qualifications, competences, group and functional sub-group for classification and certification, which, with a different denomination, is considered to be comparable to other or other existing ones in different health services, and that are identified, in turn, with a reference category.

Article 3. Scope of application.

This royal decree applies to the statutory staff who perform their duties in the health services centres and institutions of the different administrations with competence in health care.

CHAPTER II

Homogeneous catalogue of equivalences of the professional categories of statutory staff of health services

Article 4. Homogeneous catalog of equivalences.

The homogeneous catalogue of equivalences of the professional categories of the statutory staff of the health services, which is incorporated as an Annex, is approved.

Article 5. Structure of the homogeneous catalog of equivalences.

The homogeneous catalog of equivalences is structured into the following elements:

a) Group and professional subgroup.

b) Reference category.

c) Categories equivalent to the one that is fixed, in each case, as a reference.

Article 6. Basic conditions and criteria for the calls for the transfer competitions.

The transfer competitions called by the different health services must meet the following basic conditions and criteria:

(a) Calls which, under the provisions of Articles 37 and 38 of Law 55/2003 of 16 December 2003, promote health services, shall specify the equivalent category, which shall be the one in which they are offered places, and the reference, according to the catalogue contained in the Annex of this royal decree.

(b) In order to ensure knowledge and dissemination to all affected statutory staff who are entitled to participate in such calls, they must be placed on record in the same categories concerned, both of the reference categories themselves and of the reference categories, in which they are intended to offer places for a transfer contest.

(c) The categories appearing in the catalogue are declared equivalent in respect of the reference category to which they are equated, in order to validate those transfer contests referred to in Article 37 of Law 55/2003, of 16 December.

(d) Calls will be met with the necessary inter-regional coordination, and the principle of collaboration between all health services must be first. To this end, as stated in Article 38 of Law 55/2003, of 16 December, the Human Resources Commission of the National Health System will establish the criteria and principles that will result in order to the periodicity and coordination of Calls for places in categories affected by the catalogue.

(e) Access to the reference categories by means of participation in a transfer contest shall specify that the applicant is in the category of origin in the specific category or category in which the applicant is offered places. This will be the case in order to ensure that, under no circumstances, the access of cash to another category other than the one that comes and in which the status of statutory staff is fixed can be produced and will occur in cases where it is specified in the the Annex itself.

CHAPTER III

Updating the homogeneous catalog of equivalences

Article 7. Prior to the creation, modification, or declaration of extinction of a category.

1. Prior to the publication of the standard or of the resolution agreeing to the creation, modification, deletion or declaration of extinction of any category, the health authorities which consider it appropriate may consult, on a voluntary basis, to the Directorate-General for Vocational Management of the Ministry of Health, Social Services and Equality, on the adequacy of that decision with regard to the professional category or professional categories to which may affect.

2. The report issued by the Directorate-General for Vocational Planning will necessarily take the following aspects:

a) Justification of need.

b) Professional membership group and subgroup.

c) Titulation, access requirements and equivalence proposal with respect to the existing catalog, assessing the need for modification or update.

d) The relevance of the initiative.

3. The report of the Directorate-General for Vocational Management shall be optional and non-binding and shall be issued within one month of the date of the consultation.

Article 8. Procedure for updating the homogeneous catalog of equivalences.

1. When administrations with powers in health care, in compliance and development as provided for in Article 15.1 of Law 55/2003 of 16 December 2003, agree to the creation, modification, declaration of extinction or deletion of one or more certain professional categories of statutory staff, shall, within one month, from the publication of the standard or resolution agreeing on any of these extremes, to the referral of their text to the Directorate-General for Vocational Management of the Ministry of Health, Social Services and Equality, who will agree to the initiation of procedure for updating the homogeneous catalogue of equivalences. For these purposes, the text to be sent shall be accompanied by a reasoned proposal justifying the updating of the catalogue.

2. The procedure will require a mandatory, but not binding, report from the Human Resources Commission of the National Health System on the relevance of updating the catalogue, who, in the light of the documentation indicated in the The above paragraph shall be issued within a maximum of one month. This report shall assess the arguments contained in the reasoned proposal for updating the catalogue in relation to the new category created or amended and shall also decide on the relevance of updating the catalogue as follows: the deletion or declaration of extinction of any category which, if appropriate, is agreed.

3. Within the maximum period of three months after the start of the procedure has been agreed, and in the light of the report of the Commission on Human Resources of the National Health System, the person holding the Ministry of Health, Social Services and Equality update, where appropriate, the homogeneous catalogue of equivalences, according to the following criteria:

(a) In the case of the creation or modification of a new professional category, the required qualification for access, the group and subgroup of professional classification in which it is inserted and the rest of the requirements shall be taken into account to set the rule to create or modify.

(b) In the case of deletion or declaration of extinction of a category, the need for updating of the catalogue shall be assessed on the basis, first, of subsistence or not of a similar category in other administrations (ii) health; second, whether or not statutory staff have been established in the category concerned to maintain the right to mobility; and, in the final analysis, the rest of the circumstances which guide the need to update or not to update the catalog itself.

4. In the light of the order provided for in the preceding paragraph, it may be possible to apply administrative remedies for replacement, in accordance with Articles 116 and 117 of Law No 30/1992 of 26 November 1992 on the legal framework of the Public administrations and the Common Administrative Procedure, or litigation-administrative appeal, in accordance with Law 29/1998 of July 13, regulating the Administrative-Administrative Jurisdiction.

Article 9. Effects of the homogeneous catalog update.

1. Updating the homogeneous catalog will have the following effects:

(a) The updating of the catalogue as a result of the creation or modification of professional categories shall mean, in addition to the effects provided for in Article 6, the approval of the category concerned with that category of the reference to be considered equivalent.

b) The updating of the catalogue as a result of the deletion or declaration of extinction of professional categories will mean either the deletion of some or some equivalent professional categories or the abolition of a reference category. Such effects shall, where appropriate, be produced in accordance with the provisions of Article 8.3.b

2. In cases of deletion or declaration of extinction of categories, the integration of fixed staff of categories which are declared to be extinct in other groups of the same group and/or sub-group may be agreed by the health authorities. professional, provided that the person concerned has the necessary qualifications.

Article 10. Update of the catalogue on the occasion of the call for a mobility procedure.

Prior to a health administration calling for a voluntary mobility process with respect to a category in which no equivalence is established in the catalogue, this administration may promote its update by the procedure laid down in Article 8.

To this end, it shall forward to the Ministry of Health, Social Services and Equality the proposal for a decision to convene, as well as the rule or resolution of creation or modification of the category or categories concerned, from that point on, the remaining stages of the indicated procedure.

Additional disposition first. Application of this royal decree in the Community of Navarra.

As provided for in the additional provision of Law 55/2003 of 16 December 2003, this royal decree will be applied in the Community of Navarra in the terms laid down in Article 149.1.18. The first part of the Constitution, as well as in the Organic Law 13/1982 of 10 August, of the reintegration and improvement of the Foral Regime of Navarre.

Additional provision second. Indistinct participation of official and statutory staff in voluntary mobility procedures called by different health administrations.

In those health services in which the staff of health institutions have changed their legal status to be linked to the civil service system, the guarantee can therefore be maintained. referred to in Article 37 of Law 55/2003 of 16 December 2003. To this end, it may be provided, without distinction, that career civil servants and the fixed statutory health services can access voluntary mobility procedures established for both types of staff.

In its virtue, and for this purpose, the health administrations referred to in this provision may formalize, in this field, the collaboration agreements provided for in the additional provision of the Law. 55/2003, dated December 16.

Additional provision third. Nurse/specialist categories.

In order to guarantee the mobility of the statutory staff who access new categories of nurses/specialists and in order to comply with the provisions of this royal decree, the health administrations with In this respect, they will, to the extent of their regulatory capacity and budgetary availability, promote the creation of the categories of nurses/specialists.

First transient disposition. Communication on the categories already deleted or declared to be extinguished.

Within one month of the entry into force of this royal decree, the Autonomous Communities which have abolished or declared to extinguish any category of the equivalent in the Annex shall notify the Ministry of Health, Social Services and Equality in order to assess and resolve, in accordance with Article 8, whether or not to insert the corresponding amendment into the catalogue.

Second transient disposition. Designation of academic qualifications.

Final disposition third. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
