Article 6 of Royal Decree 2491/1996, of 5 December, which regulates the organic structure and functions of the National Institute of the Performing Arts and Music (hereinafter INAEM), attributes to its Director General the functions of management and representation of the body, the management of the staff, the implementation of the general action plans, the drawing up of the Annual Report, the contracting on behalf of the body and the granting of aid and grants.

In turn, Article 7.4 states that the General Secretariat, with the rank of Subdirectorate General, has the following powers: supervision and management of personnel and matters -the Institute's economic and administrative staff, the coordination of the Subdirectorates-General of Personnel and Economic-Administrative and all those tasks entrusted to it by the person in charge of the Directorate-General.

By Resolution of 13 November 2012, a series of powers were delegated to the head of the General Secretariat and other posts of the body in order to speed up the management and handling of the Institute.

However, after a thorough analysis of the current system of distribution of materials between the different INAEM positions, the need to redefine the delegation of certain subjects for the sake of a greater operability.

In its virtue, in accordance with the provisions of Article 13 of Law 30/1992, of November 26, of the Legal Regime of Public Administrations and of the Common Administrative Procedure and in the additional provision The 13th of the Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, prior to the favorable report of the legal services of this department, resolute:

First. Delegation of powers to the holder of the General Secretariat.

The following privileges for the General Directorate are delegated to the holder of the General Secretariat:

1. The award and conclusion of administrative and private contracts, where they are of less than EUR 18,000 (excluding VAT), with the exception of the provisions of point 2 of paragraph 4 of this Resolution.

2. The conclusion of the agreements on the transfer of the use of the spaces managed by the body under Law 8/1989, of 13 April, of Public Fees and Prices.

3. The approval and commitment of expenses of less than 18,000 euros (excluding VAT), from the budget of the agency.

4. The recognition of obligations.

5. The proposal and order of payments.

6. The management of the body of material payments by the Central Bank of the body of fixed cash advances and bookies to be justified.

7. The approval of the supporting account of the obligations satisfied by the fixed cash advance funds for the replenishment of funds from the body's paying agencies.

8. The authorisation of the extension of the extraordinary period of up to six months to justify the bookings to be justified.

9. The signature of the origin of the returns of the guarantees to the recipients who have been constituted in the tenders for the contracts.

10. The appointment necessary for the provision of teaching activities referred to in Article 304 of the Royal Legislative Decree 3/2011 of 14 November, approving the recast text of the Law on Public Sector Contracts.

11. The request for the representative of the General Intervention of the State Administration for the material verification of the investments made by INAEM.

12. The ups and downs of firms in the Banco de España.

13. The referral of the annual reports to the Court of Auditors and the General Intervention of the State Administration.

14. The authorization of commissions of services, displacements, transfers and assists, as well as the approval and liquidation of the corresponding compensation for the service in respect to the staff of the General Secretariat and the staff of the Castle-Palace of Magalia.

15. The approval of the liquidations of the indemnities for the reason of the service of the Deputy Directors General of the Agency, the staff subject to the employment relationship of special character of High Direction and the staff of the Unit of Support to the General Address.

16. The assists of the members of the State Council for the Performing Arts and Music and the Arts Councils.

17. The approval of the ticket settlements and the payment to organizers of shows in premises and facilities of the INAEM.

Second. Delegation of powers to the holder of the General Economic and Administrative Subdirectorate.

The following matters are delegated to the holder of the General Economic and Administrative Subdirectorate:

1. The management of the body of material payments by the Central Bank of the body with charge of fixed cash advances or accounts to be justified.

2. The signing of the resolutions announcing in the "Official State Gazette" the Agency's hiring by means of open or restricted procedures.

3. The authorization of commissions of services, displacements, transfers and assists, as well as the approval and liquidation of the corresponding compensation for the service in respect to the staff of the Subdirectorate General Economic-administrative.

4. The disaffection and discharge in the General Inventory of movable property of the body, obsolete or damaged by the use.

Third. Delegation of privileges to the holder of the General Staff Subdirectorate.

The following competencies are delegated to the holder of the General Staff Subdirectorate:

1. The approval of the tables of extraordinary rewards and productivity complements.

2. The call and resolution of the Social Action Plan.

3. The authorization of commissions of services, displacements, transfers and assists, as well as the approval and liquidation of the corresponding compensation for the service in relation to the staff of the General Staff Subdirectorate.

4. The management of the body of material payments by the Central Bank of the body with charge of fixed cash advances or accounts to be justified.

Fourth. Delegation of attributions in the headlines of the General Subdirectorate of Theatre and the Subdirectorate General of Music and Dance.

They are delegated to the headlines of the General Subdirectorate of Theatre and the General Subdirectorate of Music and Dance the following attributions:

1. The issuing of letters of communication of the accession or renewal of the Local Entities and letters of confirmation of the programs approved under the State Program of Circulation of the Performing Arts in spaces of Local Entities (PLATEA).

2. The celebration of the contract-shows to be signed in the framework of the State Program for the Circulation of the Performing Arts in Spaces of Local Entities (PLATEA).

3. The issue of the certificate provided for in Article 36.3 of Law 27/2014 of 27 November 2014 on Corporate Tax.

4. The acts of processing and requirements resulting from the instruction of the procedures for granting, justifying and reintegrating awards, grants and public aid.

5. The modification of the grant decisions in the legally provided cases.

6. The extension of the time limit for the submission of the justification for grants and the requirement for the submission of the justification provided for in Article 70 of Royal Decree 887/2006 of 21 July, by which the General Law Regulation is adopted of Grants.

7. The organisation to the Central Bank of the body of the material payments from cash advances and bookies to justify, referring to the units of its competence.

8. The authorization of commissions of services, displacements, transfers and assists, as well as the approval and liquidation of the corresponding compensation for the service in respect of the personnel of his unit.

9. The authorization of commissions of services, displacements, transfers and assists as well as the approval of the corresponding compensation for the service in respect to the staff of the centers of creation and artistic management attached to the Sub-direction, with the exception of staff subject to the special working relationship of High Direction.

10. The payment of the compensation for the service of the members of the commissions, juries and advisory bodies of their material scope of action.

Fifth. Delegation to the directors, managers and assimilates of the establishment and artistic management centers of INAEM.

It is delegated to the Directors, Managers and assimilated of the Centers for the creation and artistic management of INAEM:

1. The management to the corresponding Caja of its respective center or unit of material payments with charge of fixed cash advances and bookings to justify.

2. The approval of the settlements of the indemnities for the purpose of the service of the personnel of their respective center or unit.

Sixth. Fixed cash advances and bookies to be justified.

In the case of fixed-box procedures and bookings to be justified, the organs or units referred to in the first to fifth paragraphs shall authorize the expenditure and order the paying cashier to make the material payment by means of the the signature of the corresponding internal payment order.

Seventh. Supply arrangements.

1. Pursuant to Article 7.4.c) of Royal Decree 2491/1996, the holder of the General Secretariat is entrusted with the signature and dispatch of the ordinary affairs of the body in the case of vacancy, absence or sickness of the holder of the Directorate-General of the Institute.

2. The holder of the General Secretariat may be temporarily replaced in the cases of vacancy, absence or illness by the holder of the General Economic and Administrative Subdirectorate and by the holder of the General Staff Subdirectorate, in all those tasks related to, respectively, the economic management and the management of INAEM personnel, both as a result of this Resolution and other rules of the current legal system, in accordance with the provisions of the Article 17 of the LRJ-PAC.

3. In the case of vacancy, absence or sickness of the holder of the General Secretariat, the holder of the Directorate-General shall appoint an official of the General Economic and Administrative Subdirectorate for the signature of the payment order of the Institute, together with the signature of the holder of the said Subdirection.

4. The order of the Institute's boxes may also be temporarily replaced in the case of vacancy, absence or sickness by the holders of the INAEM posts to be determined in the Resolutions of this Directorate-General which regulate the payments to be justified and fixed cash advances.

5. In any event not provided for in the preceding paragraphs, the holder of the INAEM Directorate-General shall designate the relevant supply, in accordance with Article 17 of the LRJ-PAC.

Eighth. Common provisions.

1. The delegation of powers referred to in this Resolution is subject to the limitations set out in Article 13.2 of Law No 30/1992 of 26 November 1992 on the Legal Regime of Public Administrations and the Rules of Procedure Common Administrative.

2. The delegations included in this Resolution shall also include those relating to revenue management in the appropriate cases.

3. The delegations contained in this Resolution which involve acts of budgetary implementation include the delegations for the authorisation of the relevant accounting documents.

4. All the powers delegated to this Resolution may be the subject of an endorsement by the relevant delegating body in the form provided for in Article 14 of Law 30/1992 of 26 November.

5. Where acts or resolutions are issued in use of the delegation of powers set out in this Resolution, it shall be expressly stated and shall be considered as being dictated by the delegating body.

Ninth. Repeal provision.

The Resolution of the National Institute of the Performing Arts and Music of 13 November 2012, for which powers are delegated, is repealed and without effect.

10th. Entry into force.

This provision shall enter into force on the day following that of its publication in the Official Gazette of the State.
