By Order PRE/1263/2009 of 21 May 2009, by which the supplementary technical instructions numbers 2 and 15 of the Explosives Regulation, approved by Royal Decree 230/1998 of 16 February, were updated, the Commission Directive 2008 /43/EC of 4 April 2008 establishing, in accordance with Council Directive 93 /15/EEC, a system for the identification and traceability of explosives for civil purposes, imposing an obligation for all the natural or legal persons in possession of a licence or authorisation for manufacture, storage, transfer or import and placing on the market of explosives, must mark the explosives and each of the smallest packaging units with a unique identification or identification code.

The single transitional provision of Order PRE/1263/2009 of 21 May 2009, in the wording of Order PRE/2035/2012 of 24 September 2009 amending that Order, provides that as from 5 April 2015, all Member States shall be required to provide the explosives placed on the market and used must incorporate the new type of marking.

The obligation to mark each of the smallest unit of explosives in some cases involves the incorporation of a large amount of data into the circulation guide for metal explosives and cardboard, regulated in Order INT/3543/2007 of 29 November 2007 amending and determining its model, content and format, and providing instructions for its preparation, with a number of annexes to be completed.

In order to ensure that the completion of the data relating to the identification number of the paragraph corresponding to the complete description of the goods in the said circulation guide is carried out considerably. More agile, by this order it is possible that these are collected and stored by telematic and/or computer media, with due guarantees of confidentiality, integrity and authentication.

This order has been submitted to the public information procedure provided for in Article 24.1.c of Law 50/1997 of 27 November of the Government, having been informed favourably by the Permanent Inter-Ministerial Commission of Weapons and Explosives.

In its virtue, I have:

Single item. Amendment of Order INT/3543/2007 of 29 November 2007 amending and determining the model, content and format of the circulation guide for metal explosives and cardboard, and instructions for making them available.

Article 3 of Order INT/3543/2007 of 29 November 2007 amending and determining the model, content and format of the circulation guide for metal explosives and cardboard, and giving instructions for their use clothing, it is worded in the following terms:

" The circulation guide for metal explosives and cardboard shall be made in accordance with the instructions set out in Annex II.

The completion of the data relating to the "N. identification" of the "Full description of the goods" section of Annex I may also be carried out by means of their collection and storage by means of telematics and/or computer, which ensure their confidentiality, integrity and authentication ".

Final disposition first. Competence title.

This order is dictated by the provisions of Article 149.1.26. of the Spanish Constitution which gives the State exclusive competence over the regime of production, trade, possession and use of weapons and explosives.

Final disposition second. Powers of development.

The Director General of the Civil Guard is hereby authorized to update the contents of the Annexes of Order INT/3543/2007 of 29 November.

Final disposition third. Entry into force.

This order will take effect the day following your publication in the "Official State Bulletin".
