By Order APA/3181/2007 of 30 October 2007 laying down the regulatory bases for grants to breeders ' organizations and associations for the conservation, improvement and promotion of pure breeds of production livestock, public subsidies in this area have been regulated, with centralised management.

At the moment, it is necessary to adapt the said regulation to the new rules of the European Union in the field of aid to the agricultural sector, in particular to Regulation (EU) No 702/2014 of the Commission of 25 June 2014 on the that certain categories of aid are declared in the agricultural and forestry sectors and in rural areas compatible with the internal market pursuant to Articles 107 and 108 of the Treaty on the Functioning of the European Union.

In the elaboration of this order, the autonomous communities and the most representative entities of the affected sectors have been consulted.

In its virtue, with the prior approval of the Minister of Finance and Public Administrations, I have:

Single item. Amendment of Order APA/3181/2007 of 30 October 2007 laying down the regulatory bases for grants to breeders ' organisations and associations for the conservation, improvement and promotion of pure breeds of livestock of production.

Order APA/3181/2007 of 30 October 2007 laying down the regulatory basis for grants to breeders ' organisations and associations for the conservation, improvement and promotion of pure breeds of production livestock, as follows:

One. In Article 1, a new paragraph is added with the following content:

' This aid is in line with the provisions of Commission Regulation (EU) No 702/2014 of 25 June 2014 declaring certain categories of aid in the agricultural and forestry sectors and in rural areas compatible with the internal market pursuant to Articles 107 and 108 of the Treaty on the Functioning of the European Union, published in the Official Journal of the European Union No 193, 1 July 2014, pages 1 to 75. '

Two. Article 2 is replaced by the following:

" Article 2. Beneficiaries.

The organisations and associations of breeders of pure livestock breeds of national scope officially recognised by the Ministry of Agriculture, Food and Agriculture may benefit from the aid provided for in this provision. Environment, for the management of genealogical books or, where appropriate, second-degree entities officially recognized by the Ministry of Agriculture, Fisheries and Food, which include at least one officially recognized association by the Ministry of Agriculture, Ministry of Agriculture, Food and Environment for the management of books genealogics, which meet the following requirements:

(f) That they are not subject to a pending recovery order following a previous Commission decision that has declared unlawful and incompatible aid with the internal market. "

Three. Article 3 (5) is replaced by the following:

" 5. In any case, the eligible costs provided for in this Article shall be supported by clear, specific and up-to-date documentary evidence. "

Four. Article 8 (1) is replaced by the following:

" 1. The grants shall be compatible with any other public administration, public authorities attached or dependent on them, both national and international, and other natural or legal persons of private nature, with the exception of those referred to in the national legislation in force laying down the regulatory bases for subsidies for the promotion of indigenous Spanish breeds. Such aid shall not be cumulated with any de minimis aid corresponding to the same eligible costs if such cumulation gives rise to an aid intensity or amount exceeding that limit.

(d) Tests to determine the genetic quality or performance of livestock: the maximum percentage of the aid is 70% of the expenditure, in accordance with Article 27.1.b) of Commission Regulation (EU) No 702/2014, of 25 June 2014, and the eligible amount of cash prizes for the winners may not exceed EUR 250. '

Five. A new Article 21 is added, with the following content:

" Article 21. Conditionality.

The granting of the aid covered by this royal decree is conditional upon receipt of the acknowledgement of receipt by the European Commission, the receipt of the information referred to in Article 9.1 of the Regulation (EU) No Commission Regulation (EC) No 702/2014 of 25 June 2014. '

Six. The entries contained in the Ministry of Agriculture, Fisheries and Food in Order APA/3181/2007 of 30 October 2007 will be understood as referring to the Ministry of Agriculture, Food and the Environment.

Single transient arrangement. Application.

The provisions of this order shall apply from 31 December 2014.

Single repeal provision. Regulatory repeal.

The single transitional provision of the APA/3181/2007 Order, dated October 30, is hereby repealed.

Single end disposition. Entry into force.

This order will take effect the day following its publication in the "Official State Gazette". It shall be forfeited on the date on which Regulation (EU) No 702/2014 of the Commission of 25 June 2014 declaring certain categories of aid in the agricultural and forestry sectors and in rural areas is no longer applicable. compatible with the internal market pursuant to Articles 107 and 108 of the Treaty on the Functioning of the European Union.
