The Ministry of Agriculture, Food and the Environment has a series of laboratories responsible for carrying out analyses in the field of animal and molecular genetics, planned, coordinated and targeted. technically by the Directorate-General for Health of Agricultural Production, in accordance with Article 9.1.g of Royal Decree 401/2012 of 17 February 2012, for the development of the basic organic structure of the Ministry of Agriculture, Food and Environment. These include the Central Veterinary Laboratory in Algette (Madrid), and the Central Laboratory of Animal Health in Santa Fe (Granada), whose services generate an additional cost that is not attributable to the normal development of management administrative.

Well, Law 8/1989, of 13 April, of taxes and public prices, sets out in Title III, the rules on the concept, value, fixing and administration of public prices. Article 24 defines the latter as the financial benefits which are satisfied by the provision of services or the performance of activities under the law of the public when, in addition, such services or activities are provided by the sector private, be of voluntary request on the part of the administered.

The requests for analysis to perform the above activities have been increased in recent years, as well as the complexity of the analytical methods used, which makes it necessary to standardise carrying out the analytical activities and adapting their economic and administrative management to the existing rules on public expenditure and revenue.

On December 29, 2012, Order AAA/2807/2012 of 21 December 2012, which sets public prices for the performance of animal health and genetic laboratory services, was published in order to guarantee the standardisation in the performance of analytical activities as well as the adequacy of their economic and administrative management to the current standards.

After finding difficulties in implementing the Order, a thorough review of the Order has been carried out, with a number of changes being made, in the amounts of public prices, as well as the provision of a special attention to animal health analyses in the case of exports, so that, in order to facilitate its application and due to legal certainty, a new order should be issued to fix public prices in accordance with the (a) laid down in Articles 24 and 26.1 (a) of Law 8/1989 of 13 April 1989 on Public Prices and Rates and repealing Order AAA/2807/2012 of 21 December 2012.

In its virtue and in accordance with the provisions of article 26.1 of Law 8/1989, of 13 April, I hereby resolve:

First. Object.

The purpose of this order is to establish public prices for the activities referred to in the Annex. These public prices have been calculated in such a way as to cover the economic costs of the services performed.

Such amounts will be increased by the application of the legally applicable Value Added Tax rate.

The amount of the prices set out in the Annex to this order may be updated, with effect from 1 January of each year, in whole or in part.

Second. Request Model.

The application for the services to be provided may be submitted in the model to be established by the General Directorate of Health for Agricultural Production, which will be available on the Department's website.

Third. Income and Return.

1. The payment of the public prices will be made by the income of its amount in the Public Treasury by the means provided for in the General Regulation of Collection, approved by Royal Decree 939/2005, of July 29, for which the General Rules of Collection, with the request for analysis being presented together with the corresponding justification for such income.

2. In cases where the number and type of final analysis to be carried out on samples is determined by the results of the analyses being carried out, the amount of the first analysis shall be entered in the appropriate amount and, in the case of To continue with the study, new revenues will be made according to the laboratory indications.

3. If a particular benefit cannot be made, the amount corresponding to it shall be returned.

Fourth. Discounts or reductions.

1. In the case of applications for export analyses in respect of animal health, where the same person, whether natural or legal, requests for an analysis number to be carried out, the following discounts shall apply:

a) Between 1 and 10: 0%.

b) Between 11 and 25: 25%.

c) Between 26 and 50: 50%.

d) Between 51 and 100: 60%.

e) Between 101 and 500: 70%.

f) Over 500: 75%.

2. In the case of applications for analysis in the field of animal genetics, where the same person, natural or legal person, requests for the completion of the following analyses and for the quantity of samples specified, a discount of 20% shall apply. %:

a) In PCR screening analysis of genetically modified organisms: for 11 samples or their multiples.

b) Genotyping of the PRNP gene in sheep: 380 samples or their multiples.

c) Genotyped by microsatellites: 90 samples or their multiples.

d) Identity and/or lineage control using microsatellites: 90 samples or their multiples.

Fifth. Not obligated to pay.

1. Where the determinations requested relate to animals owned by any Spanish public administration, they shall not be obliged to pay the corresponding public prices.

2. They shall also not be obliged to pay the public price for the genotyping of the prnp gene set out in the 'National genetic selection programme for the resistance to transmissible spongiform encephalopathies in sheep', the applicants for where they are officially recognised Genealogical Book Management Entities in accordance with Royal Decree 2129/2008 of 26 December 2008 establishing the National Programme for the Conservation, Improvement and Promotion of Livestock breeds.

3. They shall also not be obliged to pay the public price for the genotyping of the prnp gene, the competent bodies of the autonomous communities, or cities of Ceuta and Melilla, applicants for health reasons, in cases linked to outbreaks of scrapie disease.

Sixth. Resources.

The administrative acts resulting from the management and collection of the public prices covered by this order may be challenged in the form and time limits laid down in Articles 107 et seq. of Law No 30/1992 of 26 May 1992. November, the Legal Regime of Public Administrations and the Common Administrative Procedure.

Seventh. Effects of Order AAA/2807/2012 of 21 December 2012.

Order AAA/2807/2012 of 21 December 2012 laying down public prices for the performance of animal health and genetic laboratory services is without effect.

Eighth. Effects of this order.

This order shall take effect on the day following that of its publication in the "Official State Gazette".
