Law 11/2007, of June 22, of electronic access of citizens to Public Services, created the concept of "electronic headquarters" by defining it in the first section of its article 10 as " that electronic address available to citizens through telecommunications networks whose ownership, management and administration is for a public administration, an organ or an administrative entity in the exercise of its powers. " Furthermore, paragraph 2 of the same Article determines that the establishment of an electronic seat bears the responsibility of the holder in respect of the integrity, veracity and updating of the information and services to which it can be accessed. through the same.

On the other hand, Royal Decree 1671/2009 of 6 November 2009, for which the Law 11/2007, of 22 June, of electronic access of citizens to public services is partially developed, in addition to regulating this figure in its Articles 3 to 9 specifically determine in Article 3.2 that "the electronic venues will be created by Order of the corresponding Minister or Resolution of the holder of the Public Body, which must be published in the" Official Gazette of the State ", determining the minimum content of this approval rule. This brings to the citizens guarantees of full certainty and security that only partially reached the virtual offices that have so far been channeling the electronic relations with the citizens.

The creation of the electronic headquarters was agreed by the Board of Directors of the Port Authority of the Balearic Islands at the session of November 27, 2014, delegated to the President the power to dictate how many acts and resolutions are required in this respect.

In compliance with Article 4.3 of Order FOM/716/2009 of 4 March, regulating the composition and functioning of the Ministerial Committee of Electronic Administration of the Ministry of Public Works, this resolution has been informed by that committee.

In its virtue, I resolve:

Article 1. Object and scope of application.

This resolution aims at the creation of the electronic headquarters of the Port Authority of the Balearic Islands, thus complying with the provisions of Article 3 of Royal Decree 1671/2009 of 6 November 2009. partially develops Law 11/2007, of June 22, of electronic access of citizens to Public Services.

The scope of this resolution extends exclusively to the organs belonging to the Port Authority of the Balearic Islands, and to the entire departments or functional areas in which the Port Authority is structured The Balearic Islands for the provision of its services.

Article 2. Access to electronic headquarters.

The electronic headquarters of the Port Authority of the Balearic Islands will be available at https://seu.portsdebalears.gob.es.

Article 3. Bodies responsible for the electronic headquarters.

1. The ownership of the electronic headquarters will correspond to the Port Authority of the Balearic Islands, being therefore responsible for the management, contents and services made available to the citizens in the same.

2. The management and coordination of the common contents of the headquarters will be the responsibility of the Director of the Port Authority of the Balearic Islands.

3. They are designated as administrative officers for the management of the electronic headquarters and for the services made available to the citizens through it, to those responsible for the organizational units assigned to the competition. in respect of each of the services made available to the citizen and detailed in the electronic headquarters.

4. The technological and computer management of the headquarters will be entrusted to the organizational unit of Electronic Administration dependent of the Division of Information Systems of the Harbour Authority of the Balearic Islands.

Article 4. Characteristics of the site.

All performances, procedures and services that, developed in the public law regime, will require the authentication of the Administration will be carried out through the electronic headquarters of the Port Authority of the Balearic Islands. Public or users by electronic means, as well as those other than those that are decided to include them in the electronic seat for reasons of efficiency and quality.

1. The electronic headquarters of the Port Authority of the Balearic Islands are created with the following characteristics:

(a) The electronic seat shall be accessible to its instrument of creation, either directly or by link to its publication in the "Official State Gazette".

(b) The electronic seat shall be identified by an electronic seat certificate, the use of which shall be limited to the identification of the electronic seat. Such an electronic seat certificate may be the subject of consultation through it.

c) To ensure the provision of services, and in accordance with the provisions of article 8.2 of Law 11/2007, of June 22, of electronic access of citizens to Public Services, the following are established channels:

1. For electronic access, through the Internet either directly through the site or through the institutional portal www.portsdebalears.com.

2. º For face-to-face attention, the main offices of the Port Authority of the Balearic Islands in Moll Vell, 3-5, Palma de Mallorca 07012, without prejudice to access through the records regulated in Article 38 of the Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure.

3. For telephone attention, information services on telephone 971 22 81 50.

2. The information and services included in the electronic headquarters will comply with the principles of accessibility and usability established in Law 11/2007, of June 22, in the terms that are established in this matter by the regulations in force in each time.

3. The contents published in the electronic headquarters will respond to the criteria of safety and interoperability arising from Law 11/2007 and of Royal Decree 1671/2009, as well as of the Royal Decree 3/2010, of 8 January, for which the Scheme is regulated National Safety, and Royal Decree 4/2010 of 8 January, for which the National Interoperability Scheme is regulated.

Article 5. Content and services of the electronic headquarters.

1. The minimum content to be included in the electronic seat is:

(a) Updated information on the electronic headquarters, including the identification of the seat and the identification of the body responsible for its management and administration.

b) Information necessary for the proper use of the site including the map of the electronic headquarters, as well as the related to the intellectual property.

c) Electronic advice services to the user for the proper use of the electronic headquarters

d) System of verification of the certificate of the electronic headquarters, directly and free of charge.

e) Relation of electronic signature systems that are admitted or used in the electronic headquarters.

f) Access to the electronic register of the Port Authority of the Balearic Islands.

g) Access to the contractor's profile and other services provided by the Public Sector Contracts Act.

h) Data protection and privacy policy of the port authority and liaison with the headquarters of the Spanish Data Protection Agency.

i) Link to the "Official State Bulletin".

j) Accessibility information.

k) Any information or service that the Port Authority of the Balearic Islands considers to be of interest or necessity.

l) Regulatory regulations of the Electronic Headquarters.

2. The services available to the citizens to be included in the electronic headquarters are:

a) Catalog of procedures and services available at the electronic headquarters.

b) Electronic services letter of electronic headquarters.

c) Electronic means that citizens can use in exercising their right to communicate with public administration.

d) Liaison for the formulation of complaints and suggestions as provided for in Article 6.1 of this resolution.

e) Access to the case processing status through the electronic record.

f) Port authority bulletin board.

g) Official date and time, and days officially declared as non-business.

h) System for verifying electronic seal certificates.

i) Checking the authenticity and integrity of documents issued by public bodies or bodies that cover the premises that have been authenticated by secure verification code.

Article 6. Means for formulating suggestions and complaints.

1. The electronic seat shall contain a procedure for the formulation of complaints and suggestions. The formulation of the same will have the consideration of initiation of the administrative procedure

2. The means available for the formulation of suggestions and complaints regarding the content, management and services offered at the Headquarters created by this resolution shall be as follows:

a) Electronic presentation through the general mailbox of suggestions and complaints of the Port Authority of the Balearic Islands available in its electronic headquarters.

b) In-person or post-office presentation to the general register of this Port Authority, in accordance with the procedure laid down in Article 15 of Royal Decree 951/2005 of 29 July establishing the general framework for quality improvement in the General Administration of the State.

3. The user shall not be considered as a means of making suggestions and complaints to the user for the correct use of the site, without prejudice to his or her obligation, if any, to deal with the problems arising from the use of the citizens.

Article 7. Regulations and resolutions.

1. The electronic headquarters of the Port Authority of the Balearic Islands will contain the general rules regarding the electronic processing of the procedures.

2. The decisions given by the Board of Directors of the Port Authority of the Balearic Islands shall be published in the electronic seat where they relate to the matters covered by this resolution.

Article 8. Official board of the Port Authority of the Balearic Islands.

In accordance with the provisions of Article 12 of Law 11/2007 of 22 June 2007 on the electronic access of citizens to Public Services, the publication of acts and communications which, by law or regulation, be published in bulletin boards or in edicts, may be replaced or supplemented by its publication in the electronic headquarters of the Port Authority of the Balearic Islands, as expressed in each case.

Final disposition first. Commissioning of the electronic seat.

The electronic seat that is created by this resolution shall begin to operate within a maximum of one month from the date of publication of the same in the "Official State Gazette".

Final disposition second. New procedures and content modification.

By resolution of the President of the Port Authority new services, procedures and contents may be included in the electronic headquarters, in the framework of which in this respect Article 6 of Royal Decree 1671/2009 provides.

Final disposition third. Entry into force.

This resolution shall enter into force on the day following that of its publication in the "Official State Gazette".
