Article 20 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data establishes that the creation, modification and deletion of the files of the Public Administrations can only be done by means of general provision published in the Official Journal of the State or the official journal concerned.

In the same sense, the Implementing Regulation of the Organic Law 15/1999 of 13 December of Protection of Personal Data, approved by Royal Decree 1720/2007 of 21 December, provides for the creation of the files of public ownership may only be carried out by means of general provision or agreement published in the "Official State Gazette" or corresponding official journal, provided for in Article 53 of that Royal Decree-1720/2007, of 21 December, which " when the provision relates to the organs of the General Administration of the State or entities or bodies linked or dependent on them, shall be in the form of a ministerial order or a resolution of the holder of the relevant entity or body. "

As the National Statistics Institute is a self-governing body under the Ministry of Economy and Competitiveness, it has to be understood that the high level of personal data files can be done by means of a resolution. of the President of the INE.

In its virtue, and in order to comply with the provisions of Article 20 of the aforementioned Organic Law 15/1999 of 13 December, as well as in Articles 52 and 54 of its Implementing Regulation, as regards the creation, modification and deletion of automated files containing personal data, and prior report of the State Advocate in the Ministry of Economy and Competitiveness, resolute:

First. Object.

The purpose of this resolution is the creation of personal data files existing at the National Statistics Institute and the modification of a file included in the Annex to the Resolution of the President of the INE date 24 September 2014, in order to indicate, in the section referred to in the basic structure, the treatment used in the organisation of the data (automated, non-automated or partially automated).

Second. Scope of application.

This resolution applies to the personal data files existing in the field of the National Statistics Institute.

Third. Creating and modifying files.

Personal data files are created and the COSPRO personal data file, which is listed in the Annex to this resolution, is modified.

Fourth. Management and organization measures.

The owners of the organs responsible for each personal data file shall take the necessary management and organisational measures to ensure the confidentiality, security and integrity of the data. as the drivers to make effective the guarantees, obligations and rights recognized in the Organic Law 15/1999, of December 13, and in its standards of development.

Single end disposition. Effectiveness.

This resolution shall have effect from the day following that of its publication in the "Official State Gazette".
