I

The Organic Law 2/1986, of 13 March, of Forces and Security Corps, establishes, in its article 6, that the studies that are cured in the centers of teaching of the Security Forces and Corps, dependent on the different Public administrations may be subject to validation by the Ministry of Education and Science, today Ministry of Education, Culture and Sport, which to this end will take into account the qualifications required for access to each of them and the nature and duration of such studies.

Also, Law 26/1994, of 29 September, which regulates the situation of second activity in the National Police Corps, configures the training regime in the National Police Corps and a unitary process. progressive, integrated in the educational system, served in its fundamental part by the teaching structure of the Directorate General of the Police, with the collaboration of other institutions.

For its part, the Regulation of the selective processes and training in the National Police Corps, approved by Royal Decree 614/1995, of 21 April, complements the provisions of the aforementioned Law reiterating, in its article 3, that the training system of the National Police Corps is configured as a unitary and progressive process, integrated into the general education system, and points out that, on a proposal from the Ministry of Interior, the corresponding equivalence may be established or type approval of such studies with the levels of the general education system, according to the rules in force.

With the regulatory framework outlined and in compliance with these objectives, through the dictation of the corresponding ministerial orders, academic equivalences have been established between the different professional categories of the National Police Corps and the corresponding qualifications of the general education system, taking into account, always, the conditions required in the legislation in force to meet the requirements of the level of studies whose equivalence is granted. Once this framework has been established, the possibility of developing integrated training frameworks within the education system, especially in the university field, as developed for other bodies and security forces, is open in the future. of the State.

Thus, Order ECI/1995/2007, of June 29, declares the equivalence of the Police and Police Officer categories, of the Basic Scale of the National Police Corps, to the titles of Technical and Technical Superior, respectively, corresponding to the vocational training of the education system.

For its part, the Order of the EDU/3125/2011, of November 11, establishes the equivalence of the appointment of Inspector of the National Police Corps to the academic level of the Official University Master, title derived from the new ordination The Court of Justice of the European Court of Justice of the European Court of Justice of the European Union, of the Court of Justice of the European Union, was established by the Court of Justice of the European Court of Justice of the European Union in the ordination of official university teaching.

At present, the National Police Corps has developed a new curriculum design for access to the category of National Police Corps Sub-Inspector in collaboration with the University of Salamanca. adapted to the regulatory norms of this new ordination of official university teaching, being configured as a degree of teaching with a curriculum of 240 ECTS credits. This curriculum design has been reported favourably by the National Agency for Quality Assessment and Accreditation (ANECA).

Access to this category of Sub-Inspector is made exclusively by internal promotion from the category of Police Officer of the Basic Scale of the National Police Corps. Title of Senior Technician corresponding to the vocational training by Order ECI/1995/2007 of 29 June 2007 and therefore gives access to the studies of Grade, in accordance with Article 44.3 of the Organic Law 2/2006, of 3 May, of education, and with Article 3.1.e of Royal Decree 412/2014 of 6 June 2014 laying down the rules basic of the procedures for admission to formal university teaching.

Taking into account the above, given that the conditions laid down in the legislation in force regarding access, nature and extent of the degree studies and in application of the provisions of the legislation are fulfilled. Article 6 of the Organic Law 2/1986, of March 13, of Forces and Security Corps, this order aims to establish the equivalence of the appointment of Sub-Inspector of the National Police Corps to this academic academic level.

On the other hand, this order also addresses the amendment of Order EDU/3125/2011 of 11 November establishing the equivalence of the appointment of Inspector of the National Police Corps to the academic level of Official University Master. While the adoption of this order is recent, the experience gained in its implementation has revealed some shortcomings which prevent the achievement of the objectives proposed in its decision and which advise the introduction of certain modifications.

Specifically, first, the scope of the order is extended by extending the equivalence to the Master's degree of those Inspectors who have completed the police training from 2006 onwards, with independence of the entry procedure that they have followed (free opposition or internal promotion), since they have, in any case, been the subject of the same training and must therefore obtain the same academic recognition.

Secondly, in order to speed up the procedure and to promote the earliest resolution of the equivalences, the procedure laid down in the rule according to criteria of economy, efficiency and effectiveness is replaced. speed.

And, thirdly, the validity of the Order of 18 April 2000 establishing the equivalence of the appointment of Inspector of the National Police Corps to the degree of Licentid is extended until 30 September 2017. University. While, in accordance with paragraph (a) of the second transitional provision of Royal Decree 1393/2007 of 29 October 2007, the teaching of the former university order is definitively extinguished from 30 September 2015, the universities must ensure at least four examinations in the two academic courses following the said date of extinction. In line with this guarantee, the Order of 18 April 2000 is extended for two years.

Detected, likewise, an errata in the second section of the single additional disposition of the order, is also applicable to its correction.

This order also repeals the Ministerial Orders of 24 November 1978 and 19 November 1996 declaring the Higher Diploma of Criminology equivalent to the university diploma of Diplomacy for the purposes of participation in the selective testing for entry into the special men's and women's Corps of Penitentiary Institutions and in the testing of access to the Corps, Escalas and Categories of Security Forces and Corps, dependent on the different Public Administrations, respectively.

The aforementioned rules were dictated in a context in which there was no official university degree in the field of criminology. Since the introduction into the universities of the new degrees of degree established under the regulations concerning the new ordination of university teaching and to exist, consequently, official teachings in this field matter, they are no longer justified.

In the process of drafting this order, the Council of Universities and the Autonomous Communities have been consulted within the General Conference of University Policy.

In its virtue, at the initiative of the Minister of the Interior, on the proposal of the Minister of Education, Culture and Sport, and with the prior approval of the Minister of Finance and Public Administrations, I have:

Article 1. Object.

This order is intended to establish the equivalence of the appointment of Deputy Inspector of the National Police Corps to the official university academic level of Grade, as well as to amend the order of the EDU/3125/2011, of November 11, establishing the equivalence of training leading to the appointment of Inspector of the National Police Corps to the academic level of the Official University Master.

Article 2. Conditions for the declaration of equivalence of the appointment of Deputy Inspector of the National Police Corps.

The training leading to the appointment of Sub-Inspector of the National Police Corps is declared equivalent to the official academic level of the degree when the following subinspectors are present. requirements:

(a) To be students who have previously obtained the appointment of Police Officer of the Basic Scale of the National Police Corps by the procedure laid down in Articles 13 and following of Royal Decree 614/1995, April 21, for which the regulation of the selective processes and training in the National Police Corps is approved.

(b) Who are in possession of the title of Bachiller referred to in Organic Law 2/2006 of 3 May of Education, or equivalent qualification.

(c) The training leading to the appointment of a National Police Corps Sub-inspector has been completed in accordance with the 240 ECTS credit study plan designed for this purpose and has been appointed to the from the year 2014.

Article 3. Assessment of the training leading to the appointment of Deputy Inspector of the National Police Corps.

For the purposes of maintaining the equivalence referred to in Article 1 (1), the training leading to the appointment of Sub-Inspector of the National Police Corps shall be monitored and evaluated by the Agency. National Quality Assessment and Accreditation (ANECA).

To this effect, every six years, from the date of entry into force of this order, the aforementioned formation, taking into account the modifications that could have been introduced and the implementation of all those improvements that have arising from the quality assurance processes provided for in that training, shall be assessed by that Agency.

This periodic evaluation will be requested by the Directorate General of the Police to the Ministry of Education, Culture and Sport, which will request the corresponding report to the ANECA, which must be issued within three months and may be favourable or unfavourable. In the event that the report is unfavourable, the Ministry shall suspend the registration of equivalences provided for in the following Article until the detected deficiencies are remedied and a new favourable report of the ANECA is obtained.

Article 4. Registration in the National Register of University Graduates of the National Police Corps Subinspector appointments.

1. The equivalences corresponding to the appointments of Sub-Inspector of the National Police Corps obtained in accordance with the provisions of this order shall be entered in a special section of the National Register of University Graduates to which refers to Royal Decree 1002/2010, of 5 August, on the issue of official university degrees. For these purposes, the Directorate-General of the Police shall transmit to the Ministry of Education, Culture and Sport the relationship of National Police Subinspectors of each promotion who have obtained such an appointment in the conditions of the set out in Article 2 of this order.

2. The relationship referred to in the preceding paragraph shall contain the following particulars and documents of each Subinspector: name and surname, national identity document number, date of appointment of the Police Officer of the Basic Scale of the National Police Corps, academic title presented to access the selective process leading to the appointment of Sub-Inspector, curriculum and date of appointment as Deputy Inspector of the National Police Corps.

3. For the purposes of the documentary accreditation of the equivalence declared in this order, the Ministry of Education, Culture and Sport shall issue, at the request of each person concerned, the certificate corresponding to the equivalence of his appointment. to the official university academic level of Grade.

Single transient arrangement. Appointments of Sub-Inspector of the National Police Corps prior to 2014.

The equivalence provided for in Article 1 (1) of this order shall also apply to the appointments of the Sub-Inspectors of the National Police Corps prior to the year 2014, provided that the the conditions laid down in Article 2 (a) and (b) of this order and, in addition, the training supplements established for the purpose of completing the 240 ECTS credits of the curriculum leading to the attainment of the Appointment.

Single repeal provision. Regulatory repeal.

The orders of 19 November 1996, for which the equivalence of the Higher Diploma of Criminology to the degree of University Diplomacy is declared, are hereby repealed, to the sole effect of taking part in the tests of access to the Bodies, Escalas and Categories of the Security Forces and Corps, dependent on the various Public Administrations, for whose income the degree of University Diplomacy or equivalent is required, and of 24 November 1978, for which declares the Higher Diploma of Criminology equivalent to the degree of Diplomacy, to the only effects of take part in the selective tests for entry into the Special Men's and Women's Special Bodies of Penitentiary Institutions, without prejudice to the fact that they will continue to apply to the diplomas obtained after the teaching of the requirements laid down in those requirements, issued to students who have commenced studies prior to the date of entry into force of this order.

Final disposition first. Amendment of the EDU/3125/2011 Order of 11 November establishing the equivalence of training leading to the appointment of Inspector of the National Police Corps to the academic level of the Official University Master.

One. Article 1 is worded as follows:

"This order aims to establish the equivalence of the appointment of Inspector of the National Police Corps to the academic level of the Official University Master."

Two. Article 2 (a) and (b) shall be drawn up as follows:

"a) That they be selected by any of the procedures established in the Regulation of the selective processes and training in the National Police Corps, approved by Royal Decree 614/1995, of April 21."

b) Meeting the academic requirements necessary to access the studies of Master University established in Royal Decree 1393/2007, of 29 October, establishing the ordination of university teaching officers. "

Three. The title and the content of Article 4 are amended and read as follows:

" Article 4. Registration in the National Register of University Graduates of the equivalences of National Police Corps Inspector appointments.

1. The equivalences of the appointments of Inspector of the National Police Corps obtained in accordance with the provisions of this order shall be entered in a special section of the National Register of University Graduates to which the Royal Decree 1002/2010 of 5 August on the issue of official university degrees. For these purposes, the Directorate-General of the Police shall transmit to the Ministry of Education, Culture and Sport, the list of Inspectors of the National Police Corps of each promotion who have obtained such appointment under the conditions set out above. in Article 2 of this order.

2. The relationship referred to in the preceding paragraph shall contain the following particulars and documents of each Inspector: first and last names, national identity document number, academic title presented for access to the relevant process selective, period in which the training leading to the appointment of Inspector of the National Police Corps and date of appointment as Inspector has been completed.

3. For the purposes of the documentary accreditation of the equivalence declared in this order, the Ministry of Education, Culture and Sport shall issue at the request of each person the certification corresponding to the equivalence of his appointment to the academic level of official University Master. "

Four. Paragraph 2 of the single additional provision is worded as follows:

" Those who have obtained a declaration of equivalence to a university degree under the Order of 18 April 2000, but meet the requirements laid down in Article 2 of this order may apply for replacement of the aforementioned equivalence by that of the University Master in accordance with the provisions of this Order. "

Five. The single transitional provision is worded as follows:

" Single transient provision. Validity of the Order of 18 April 2000.

The Order of 18 April 2000 establishing the equivalence of the appointment of the Inspector of the National Police Corps to the degree of the degree of university degree will continue to apply until 30 September 2000. 2017, to whom the conditions laid down in this Order are met, do not meet the requirements of this Order in order to obtain the equivalence of the Master's degree. "

Final disposition second. Enabling for the application.

The Director-General of University Policy, in the field of his/her competencies, is hereby authorized to take the measures and to issue the necessary instructions for the application of this order.

Final disposition third. Competence title.

This rule is applicable throughout the national territory and is dictated by the provisions of Article 149.1.30. of the Spanish Constitution which confers exclusive competence on the State on the conditions of obtaining, issuing and type-approval of academic and professional qualifications.

Final disposition fourth. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
