The public body Ports of the State has referred to the Ministry of Development, for its approval, the proposal of " Valuation of the grounds and water sheet of the service zone of the port of Vilagarcia of Arousa and lands affected to aid to navigation ". This port has the consideration of a port of general interest and is of exclusive competence of the General Administration of the State in accordance with the provisions of Article 4 and Annex I of the Royal Decree of Law 2/2011, of 5 September, The text of the recast of the Law of Ports of the State and of the Merchant Navy, in conjunction with article 149.1.20. of the Constitution.

The determination of the value of the land and the waters of the port service area, as well as of the areas affected by the use of navigation aids, is necessary to calculate the amount of the occupation rate to be paid in the Port Authority for the occupation of the harbour public domain under authorization or concession, since, according to the provisions of article 175 of the cited Text of the Law of Ports of the State and the Navy Merchant, the tax base of the charge is the value of the public domain good occupied.

The proposal to evaluate the land and water has been formulated by the Port Authority of Vilagarcia de Arousa, including, among the necessary background and studies, an economic-financial memory.

As provided for in Article 175 of the Referred Text of the Law of State Ports and the Merchant Navy, the value of the land will be determined on the basis of market criteria. To this end, the service area shall be divided into functional areas, assigning to the land included in each of them a value by reference to other land of the municipal term or to the next municipal terms, with similar uses and conditions, in particular those qualified as logistic, commercial or industrial use, taking into consideration the appropriate use. In addition, in the case of areas intended for the handling of goods, it may also take into consideration the value of port areas which may be alternatives for the traffic of that port.

In the assessment of the land of each port area, it will also have to take into account the degree of general urbanization of the area, the characteristics of management established in the special plan of the port, its centrality in the service area, and its proximity, accessibility and connection with the different transport modes and infrastructures, in particular to the docking facilities and sheltered water areas.

As for the assessment of water, point (b) of the cited precept states that the value of the water spaces included in each of the functional areas in which the service zone of a port is divided will be determined by reference to the value of the land in the areas of the service area with similar purpose or use or, where appropriate, to the nearest land. The assessment shall take into account the conditions of shelter, depth and location of the waters, without exceeding the value of the reference grounds.

The valued land has been divided into functional areas as follows:

Ground service zone:

I. Ramal.

At the northern end of the port, between the beach of Compostela and the marina, currently dedicated to the movement of solid bulk and some general merchandise. It also includes the rail link area that reaches this O Ramal dock from the station.

II. Passengers.

Area bordering on the city's fabric that hosts activities not related properly with ships and goods. It has been divided into the following subareas, differentiated by their location, uses and conditions of use:

IIa. Northern passengers: Space north of the harbour enclosure, located between the Playa de Compostela with the one that borders on the north, the railway line that is directed towards the pier of O Ramal, and said dock.

IIb. Passengers center: Collect the area of passengers not included in the rest of areas II, of endotational equipment and area of recreation.

IIc. Passengers gardens: Includes the Garden of A Concha, Park of Miguel Hernandez and Gardens of O Centenario.

IId. Passengers south 1: Located next to the urban facade, are the administrative buildings of the headquarters of the Consello Regulator of the Denomination of Orixe Mexillon of Galicia, and of the offices of the Port Authority (former Command of the Marina); these buildings are located on the same line as the House of the Sea, which is located outside the current service area of the Port.

Ie. Passengers South 2: Included in the next strip of administrative and educational buildings in the city where, within the service area, the Auditorium is located.

IIf. Southern passengers 3: Strip further away from these buildings with respect to the city, which includes the offices of the Port Authority.

IIg. Passengers dock: Comprises the Passenger Pier, the access to the same and the sector linked to the marina that is situated in the encounter of the cantil and the access to the Pier of Passengers on the side of the darsena number 1.

III. Dig it up.

Transition zone bounded by the O Centenario Gardens to the north and the purely commercial zone to the south, which includes the ramp of its own name, services to boats and equipment.

IV. Link.

It corresponds to the old Link Pier, where several warehouses are locked, on the second line after the internal communication vial.

V. Commercial Annex.

Space attached to the Commercial Pier, limited by the water sheet but without docking in this alignment, and also by the Cavadelo, Link and Comboa areas.

VI. Commercial.

It corresponds to the hammer of this three-line dock that welcomes diversity of traffics, mainly solid bulk and general merchandise.

VII. Comboa.

Includes the spaces between the Commercial area and the Ferrazo area, mainly dedicated to frozen fishing. Both bulk and general merchandise are unloaded on the dock.

VIII. Ferrazo sur.

Surface area for the Ferrazo pier, whose main related merchandise is liquid bulk.

IX. North ferro.

Space to the north of the previous area, limited to the east by the latest Ferrazo enlargement.

X. Ferrazo enlargement.

Surface gained to the sea recently with the provision of a wide surface with three alignments devoted mainly to traffic of general merchandise containerized.

Maritime Service Zone:

A. Darsena n. º 1.

Sports Darsena bounded by the grounds of the Ramal area, the Passenger area and the extension of the outer spigon of the Passenger Pier to the north, to the existing ramp at the Ramal Pier.

B. Darsena n. º 2.

Located south of the darsena no. 1, delimit the grounds of the Passenger area, the ramp of the Cavadelo and the closure as an extension of these limits.

C. Passenger Pier.

Eighty-meter-wide area to the exterior of the Passenger Pier.

D. Darsena n. º 3.

Related to the Cavadelo area, limited by the area of Cavadelo area, the Ribera Wall, the extension of the Spigon of the Passenger Pier to the South and the Spigon between Cavadelo and the Darsena n. º 2.

E. Commercial East.

Related to the Commercial Pier, bounded by the grounds of said pier, the Wall of Ribera, the same extension of the outer spigon of the passenger dock to the south that separates it from the previous area, and the union of the end of this spigon with the North-East tip of the Commercial Pier.

F. Darsena n. º 4.

Limited by the grounds of the commercial pier, the dock of Comboa, the pier of Ferrazo, its enlargement, and the imaginary line that joins the South-East tip of the expansion of the Ferrazo pier with the north-west tip of the dock Commercial.

G. Rest artificial coat.

Inland water surface of the Port bounded by the imaginary line linking extreme points of the Ferrazo dam and the Ramal dock, excluding the above areas.

H. Rest Zone I.

Water area of the area I inland waters of the Port, excluding the above areas.

J. Zone II.

Water area of the Port's Outer Water Zone II.

Areas affected by Navigation Aids:

The isolated lands that house the maritime signals, which are the object of assessment, are delimited in the plans that are part of the Plan of Use of the Port Spaces and are assigned to the functional areas described below, with expression of their existing location and buildings:

SM1. Tip Insured.

Land located in the municipality of Carnota, which is accessed by a deviation from the C-550 highway, whose closest population is Larino. In them is a hexagonal tower of silons, aluminum dome and housing building.

SM2. Mount Louuro.

Land located in the municipality of Muros, which is accessed by a secondary road, whose closest population is Louuro. In them is a hexagonal tower of low-rise silt and a white house with little dimension.

SM3. Reembroidino.

Land located in Punta O Cabo, in the municipality of Muros, which is accessed by the C-550 highway. The closest population core is Muros. In them is a white house of two plants, in the form of U, of a stately appearance and white tower that barely rises above the height of the building.

SM4. Corrubedo.

Land located in the municipality of Ribeira, which is accessed by the C-330 highway, whose closest population is Corrubedo. In them is a circular plant turret and a small-scale building.

SM5. Save.

Land located on the island of Salvora. One track connects the lighthouse and the small dock. They include a white octagonal tower with a red band of 12 meters high and a large rectangular floor building with a single height.

SM6. Rua.

Land located on the Island of Rua (islet of about four hectares), in which is a cylindrical tower of masonry and a house of a plant.

SM7. Tip Cabal.

Land located on the island of Arousa, close to the core of the island's population, which is accessed through the bridge of the PO-307. There is a low-rise tower and a building on rocky terrain.

The valuation proposal has been elaborated and processed in accordance with the provisions of the current article 177 of the Recast Text of the Law of State Ports and the Merchant Navy, approved by Royal Legislative Decree 2/2011, of 5 September, having submitted to the process of public information and to the reports of the Ministry of Finance and Public Administrations and the Public Body Ports of the State.

In its virtue, on the proposal of the Port Authority of Vilagarcia of Arousa, and of the President of Ports of the State, with the agreement of the Secretary of State of Infrastructures, Transport and Housing, completed the formalities required by existing legislation, I have:

First. Approval of the assessment.

The "Valuation of the Land and Water Lamina of the Port of Vilagarcia of the Port of Vilagarcia of Arousa and Terrain affected to the Navigation of the Navigation" is approved. A copy of the original document duly endorsed by the Ministry of Public Works, another in the Public Body Ports of the State and a third in the Port Authority of Vilagarcia of Arousa will be deposited.
