Royal Decree 809/1999 of 14 May 1999 regulating the requirements to be met by marine equipment intended to be shipped on ships pursuant to Directive 96 /98/EC, as amended by Directive 98 /85/EC, establishes common rules for the uniform application of the international standards applicable to those marine equipment, in accordance with the test standards developed by the international standards bodies and by the Organisation International Maritime (IMO).

International conventions and testing standards should be applied in their updated versions. This is why Council Directive 96 /98/EC of 20 December on marine equipment has been amended numerous times, replacing the content of Annex A in order to bring it into line with the amendments which have been produced both in the Safety of Human Life in the Sea, made in London on 1 November 1974 (SOLAS), or in other international conventions applicable to it, as in the test standards developed by the international standards bodies.

The last amendment of Directive 96 /98/EC has been carried out by the adoption of Commission Directive 2014 /93/EU of 18 July 2014 amending Council Directive 96/98 on marine equipment, replacing Annex A in order to introduce the references to the latest approved amendments, both in international conventions and in the test rules.

In order to incorporate into our legal order Directive 2014 /93/EU, of the Commission, this order is approved and it proceeds to the repeal of the norm currently in force, the Order FOM 2083/2014 of October 24, for which The technical conditions of Royal Decree 809/1999 of 14 May 1999 concerning the requirements to be met by marine equipment intended to be taken on board vessels, pursuant to Directive 96 /98/EC, as amended by the Directive, are updated. Directive 98 /85/EC.

The final provision of Royal Decree 809/1999, of 14 May, authorizes the Minister of Public Works to update the technical conditions laid down in that rule as a result of the application of the rules of law community.

In its virtue, on the proposal of the Director General of the Merchant Navy, with the agreement of the General Secretariat of Transport and the Secretary of State for Infrastructures, Transport and Housing and in agreement with the Council of Status, I have:

Single item. Approval of Annex A.

The contents of Annex "A" to Royal Decree 809/1999 of 14 May 1999 on the requirements to be met by marine equipment intended to be shipped on ships, pursuant to Directive 96 /98/EC, Amended by Directive 98 /85/EC, it is replaced by the Annex attached to this order.

Single transient arrangement. Marine equipment already manufactured.

The marine equipment designated as transferred from Annex A. 2 to column 1 of Annex A. 1, which have been manufactured before 14 August 2017, may be placed on the market and installed on board Spanish vessels until 14 August 2017. August 2015 in accordance with the approval procedures in force before that date.

Single repeal provision. Regulatory repeal.

Order FOM/2083/2014 of 24 October 2014, which updates the technical conditions of Annex A to Royal Decree 809/1999 of 14 May, on the requirements to be met by marine equipment, is hereby repealed. intended to be shipped on ships, in application of Directive 96 /98/EC, as amended by Directive 98 /85/EC.

Final disposition first. Competence title.

This order is dictated by the provisions of Article 149.1.20. of the Constitution, which attributes the State exclusive competence in the field of merchant marine.

Final disposition second. Incorporation of European Union law.

This order incorporates into Spanish law Commission Directive 2014 /93/EU of 18 July 2014 amending Council Directive 96 /98/EC on marine equipment.

Final disposition third. Entry into force.

This order will take effect on August 14, 2015.
