By Resolution of November 19, 2013, of the Social Institute of the Navy, on the delegation of competences, the exercise of various powers in the provincial and central organs of that entity was delegated, between other, for matters of budgetary management and administrative procurement, in order to ensure agility in the implementation of management procedures and to achieve greater effectiveness in the performance of the entity.

Nevertheless, the need to adopt new measures aimed at a better use of the resources available to the Social Institute of the Navy, following the recommendations of the Commission on the Reform of the Public and the Ministry of Employment and Social Security contained in the Order of 10 February 2015, approving the annual plan of hiring of the Department, have determined the need to update the delegation of responsibilities allocated to this Directorate in the areas referred to above, in the central and peripheral areas of the entity, by amending the Resolution of 19 November 2013.

This resolution aims to centralize in the Division of Management and Budgetary Analysis and in the provincial directions of A Coruña, Barcelona, Bizkaia, Cadiz, Cartagena and Valencia the processing of certain contracts necessary for other provincial directorates, by deleting a contracting authority with delegated competence, and by reducing the scope of the delegation in the field of administrative procurement in ten out of the 25 of the Institute, which involves the removal of 11 of the 26 bodies Members of the European Parliament and the Council of the European Union, including the European Parliament, the European Parliament and the Council of the European Union, and the European Parliament, the Council and the European

Finally, the system of delegation of powers to the holder of the Subdirectorate-General of the Maritime Social Action in the field of the resolution of the resources of the Alzada is modified, incorporating new assumptions not foreseen in the the Resolution of 19 November 2013, as well as the provincial directors in the field of economic performance.

In its virtue, and in accordance with the provisions of Article 13 of Law 30/1992, of November 26, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, and in the additional provision The 13th of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, resolutely:

First. Amendment of the Resolution of 19 November 2013, of the Social Institute of the Navy, on delegation of powers.

The Resolution of 19 November 2013, of the Social Institute of the Navy, on delegation of powers, is amended as follows:

One. Six new letters are added to the second paragraph of the resolver Second, with the following wording:

" e) Resolution of applications for admission to training courses.

f) The definitive relationship of students attending courses and reservations.

g) The resolution on the reimbursement of travel, accommodation and maintenance expenses for students attending the courses.

h) The resolution of enforcement of effects for non-compliance with the student's duties.

i) The resolution of the sanctioning case for non-compliance with the rules of coexistence at the National Maritime Training Centres.

j) The qualification obtained by a student in the assessment of the professional maritime and health training course. "

Two. The resolver Quart.4, is worded as follows:

" 4. In the field of administrative procurement and budgetary management:

(a) 1. The faculty for the conclusion of works contracts, including the approval of certificates of work, public service management, supplies and services, provided that the amount of the contract is not awarded exceeds EUR 650,000, VAT or tax which is excluded, for the provincial addresses of A Coruña, Barcelona, Cadiz, Cantabria, Cartagena, Huelva, Las Palmas, Valencia, Vigo and Vilagarcia de Arousa, and are charged to decentralised or The management centre of the relevant provincial directorate has been authorised. This delegation includes the power to conclude contracts based on a framework agreement as provided for in Article 198 of the recast text of the Law on Public Sector Contracts that had previously been concluded by the Address of the Social Institute of the Navy, in accordance with the provisions of Articles 196 and 197 of the said legal text or based on any other that, in accordance with the current regulations, are applicable to the management entities and common services of social security, provided that the amount of the tender of each of them does not exceed the EUR 650,000, VAT or tax to be excluded.

The power delegated in the preceding paragraph to the provincial addresses mentioned below extends not only to the territorial scope of the provincial leadership itself but also to the territorial scope of the addresses. provincial which, for each case, are indicated and with the scope to be determined:

A Coruña: Lugo, with the exception of the powers delegated to paragraph 4.a) 3. of this resolution.

2. º The faculty to conclude works contracts, including the approval of the works, public service management, supply and service certificates, provided that the amount of the tender does not exceed the EUR 400 000, VAT or tax which is excluded, for the provincial directorates of Baleares, Bizkaia, Gijón and Tenerife, and are allocated to decentralised or authorised appropriations to the management centre of the relevant provincial directorate. This delegation includes the power to conclude contracts based on a framework agreement as provided for in Article 198 of the recast text of the Law on Public Sector Contracts that had previously been concluded by the Address of the Social Institute of the Navy, in accordance with the provisions of Articles 196 and 197 of the said legal text or based on any other that, in accordance with the current regulations, are applicable to the management entities and common services of social security, provided that the amount of the tender of each of them does not exceed the EUR 400,000, VAT or tax to be excluded.

The power delegated in the paragraph above to the provincial directorate of Bizkaia extends not only to the territorial scope of the provincial directorate itself but also to the territorial scope of the provincial directorate of Gipuzkoa, with the exception of the powers delegated to it in paragraph 4.a) 3. of this resolution.

3. º The faculty to conclude works contracts, including the approval of the works, public service management, supply and service certificates, provided that the amount of the tender is less than the limits laid down in Article 138.3 of the recast text of the Public Sector Contracts Act, EUR 50 000, in the case of works contracts, or EUR 18,000, in the case of other contracts, VAT or tax applicable Excluded for the provincial addresses of Alicante, Almería, Castellón, Ceuta, Gipuzkoa, Lugo, Málaga, Melilla, Seville and Tarragona and are charged to decentralised or authorised credit management centre of the relevant provincial directorate.

(b) The power to conclude contracts of ordinary administration, whether special administrative or private, in accordance with the provisions of Articles 19.1 (b) and 20 of the recast of the Law on Contracts of the Public Sector, with the same conditions of scope, economic limitations and exceptions provided for in the resolver Quart.4 (a).

(c) The power to approve and commit expenditure for the recognition, settlement of the obligation and proposal for payment of contracts concluded under the delegation contained in the preceding paragraphs.

d) The power to initiate the file, approve, commit the expenditure and recognize the obligation and propose the payment of the contracts that are the subject of centralization by the Directorate General of Rationalization and Centralization of the Contracting of the Ministry of Finance and Public Administrations or the Ministry of Employment and Social Security, provided that the maximum amount of expenditure resulting from them does not exceed EUR 650,000, VAT or tax that is excluded, for the provincial addresses of A Coruña, Barcelona, Cádiz, Cantabria, Huelva, Las Palmas, Valencia, Vigo and Vilagarcia de Arousa, and EUR 400 000, VAT or tax which is excluded, for the other provincial directorates, and are charged to decentralised or authorised appropriations to the management centre of the corresponding management provincial.

e) The power to initiate the file, approve, commit the expense and recognize the obligation and propose the payment of the expenses derived from the lease of real estate provided that the maximum amount of the tender of the same does not exceed EUR 400,000.

In no case shall the powers which, in respect of contracts of a patrimonial nature on immovable property, be delegated to the General Treasury of Social Security.

(f) The subscription, after favourable report of the delegated legal service in the central services of the institution and the authorization of the Division of Management and Budgetary Analysis, of conventions, protocols and agreements for the management of buildings and the sharing of shared expenses with natural or legal persons subject to private law and with public entities and bodies, within their respective provincial scope, provided that the economic obligations of they may be derived, where appropriate, not exceeding EUR 400 000, and shall be charged to the decentralised or authorised budgetary appropriations in the relevant provincial direction.

g) Likewise, the faculty is delegated to approve other expenses of the provincial management, including community, fees and taxes not derived from administrative or private contracts, and to recognize the obligation, and propose the payment of these files and those promoted by other bodies of the institution, provided that the costs incurred do not exceed EUR 400 000 and are allocated to decentralised or authorised appropriations in the corresponding direction provincial.

(h) Competition to identify the income that is paid into the revenue account which, entitled in the name of the General Treasury of Social Security, is open at the provincial level of action.

i) Proposals for payment for extra-budgetary operations to be carried out at the provincial level, with the exception of delegated powers in other bodies of the institution.

Three. A second paragraph is added to the sixth resolution, with the following wording:

" Similarly, the management, administration and recognition of the right, as well as the approval, the commitment, the recognition of the obligations and the proposal of payment of the expenses, are delegated to the provincial directors. the economic benefits and other short-term benefits of the Special Scheme for the Social Security of Workers of the Sea recognised under Community Regulations. "

Second. Entry into force and effects.

The provisions of this resolution shall enter into force on the first day of July 2015.

Third. Transitional arrangements.

The system of delegation of powers in respect of procurement arising from this resolution shall apply to the procurement files which are initiated after the entry into force of this resolution.

For these purposes, it is understood that the procurement files have been initiated if the relevant call for the contract award procedure has been published. In the case of negotiated procedures, the date of approval of the specifications shall be taken into account in determining the time of initiation.
