Order IET/556/2012, of 15 March, which delegates the competences of the Minister of Industry, Energy and Tourism, and by which the delegations of powers of other higher bodies and directors of the department are approved approves, inter alia, in its 19th paragraph, the delegations of the holder of the Secretariat of State for Telecommunications and the Information Society in the headlines of the Advisory Vocals, in the Area Coordinators, and in the holders of the Area Headquarters and the Provincial Headquarters of the Telecommunications Inspection of that Secretariat of State.

Law 9/2014, of 9 May, General of Telecommunications, has as fundamental objectives to facilitate the deployment of electronic communications networks, especially those of new generation, to recover the market unit in the telecommunications sector and reduce the administrative burdens that are supported by telecommunications operators.

Therefore, this Law introduces structural reforms in the legal system of telecommunications to facilitate the deployment of new generation networks, both fixed and those that make use of the public domain. radio and television, and the provision of services by operators, framing the different actions in the objectives of the Digital Agenda for Spain.

Likewise, and as a clear example of reducing administrative burdens, Law 9/2014 of 9 May, General Telecommunications, introduces modifications to the planning and management of radio public domain, such as the on configuring the use of radio spectrum in the Citizen Band CB-27 not as a special use, but as a common use, which implies that such use is no longer subject to the prior obtaining of an administrative authorization.

Additionally, the process of releasing the digital dividend implies that the technical actions to be carried out by the different services of the Secretariat of State of Telecommunications and the Information Society They are considerably increased. In order to be able to deal more efficiently with the administrative and technical tasks resulting from the process of releasing the digital dividend, it is necessary to give greater flexibility and effectiveness to the tasks assigned to the Secretariat of State.

the purposes of this Directive, the Commission shall, in accordance with Article 1 (1) of Directive 91 /414/EEC, provide the Commission with a view to the adoption of the Directive by the Member States of the European Union.

By virtue of that order, the order of 15 March 2012, ordered by IET/556/2012, is amended by specifying the powers conferred on it by the holder of the Secretariat of State for Telecommunications and the Information Society delegates to the Provincial Headquarters of Telecommunications Inspection. In particular, the delegation of the jurisdiction of the granting, modification and revocation of administrative authorizations for the use of the Citizen Band CB-27, authorizations which, according to Law 9/2014, of 9 May, General of Telecommunications, they have been deleted. Furthermore, the delegation of the competition for the granting and revocation of the authorisations for the placing in service of radio stations is added.

Finally, with a view to a better identification of the functions developed in the Directorate General of Telecommunications Inspection of the Directorate General of Telecommunications and Information Technologies and to achieve an improvement and effectiveness in its performance, the delegation is approved in the Head of Area of Certification and Technical Regulations of the General Subdirectorate of Inspection of the Telecommunications of the liquidations of public prices corresponding to laboratory tests or tests.

Therefore, according to the provisions of Articles 13 and 16 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure and with the provisions of the provision Further 13th of the Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, it is necessary to approve the aforementioned delegations modifying to the effect the current general order of competences of the Ministry.

First.

Amendment of the IET/556/2012 Order of 15 March, which delegates the powers of the Minister of Industry, Energy and Tourism and the delegation of powers of other senior and senior officials .

One. The 19th paragraph is worded as follows:

5. The resolutions relating to the exemption of the processing fee for authorisations for the special use of radio-electric public domain.

6. The assignment of special calling flags for temporary use in the Fan Service and Fans ' Service by Satellite, with the exception of those listed in point (c) 2. of this order. "

Two. A 19th paragraph is added with the following wording:
