Having regard to the text of the Minutes containing the agreement to amend the collective agreement on the retail trade in drogueries, herbalists and perfumerias (Convention code No 99100145012014), which was signed on 18 December. March 2015, on the one hand, by the business organisations National Federation of Perfumists and Drogueros of Spain (FENPYDE) and the National Federation of Associations of Herbodietetics (FENADIHER), representing companies in the sector, and, by the trade union organizations CC.OO. Services (formerly FECOHT CC.OO.) and SMC-UGT (formerly CHTJ-UGT), representing the working group concerned, and in accordance with the provisions of Article 90 (2) and (3) of the Law on the Status of Workers, recast text approved by Royal Legislative Decree 1/1995, March 24, and in Royal Decree 713/2010, of May 28, on the registration and deposit of collective agreements and agreements of work,

This Employment General Address resolves:

First.

Order the registration of the said act in the corresponding Register of collective agreements and agreements working through electronic means of this Management Center, with notification to the Commission negotiation.

Second.

Arrange your publication in the "Official State Bulletin".

In Madrid, 18 de mazo de 2015, at 12 p.m., meeting, on the one hand and the other, on the margins, as members of the Negotiating Commission of the Collective Agreement of the Retail trade in Drogueries, Herboristerias and Perfumerias, state:

1. That dated September 19, 2014, the Employment and Social Security Ministry of the Ministry of Employment decided to order the registration of the state collective bargaining agreement for drogueries, herbalistries and perfumeries.

2. º That the aforementioned Resolution and the collective agreement were published in the "Official State Gazette" dated October 2, 2014.

3. That, according to the reflections and commitments reached between the parties at the meeting of the Joint Commission in which the salary tables for 2015 of base salaries and the salary supplement for homogenization were fixed, they decided to convene the Negotiating Commission to introduce in accordance with the provisions of Article 86 (1) of the Workers ' Statute amendments to the agreed text.

4. That the negotiating table held on the date of this act has been called all the organizations legitimized in the field, regardless of whether they have signed the collective agreement or not.

In this sense, the parties that sign the present act together with the legitimization requirements required by the current labor law have agreed to modify the text of the collective agreement under the provisions of the Article 86 (1) of the Staff Regulations in the following Articles:

Article 9 shall be drawn up from the date as follows:

" Article 9. Entry into force and concurrency of conventions.

The collective agreement will enter into force on the date of its signature in all the provinces and/or Autonomous Communities that at the level of the company would be applied by applying the previous interprovincial collective agreement of retail drogueries, herbalists, orthopaedic and perfumery as well as in those territories listed in the previous Annex I where the applicable convention to date was not in force.

In the other cases of companies with provincial and/or autonomous agreements applicable to the date, agreed prior to the date of signing of this agreement, the agreement will enter into force at the end of its validity. without prejudice to the provisions of the seventh transitional provision, unless agreement is reached between the parties to anticipate the implementation of the State Convention. '

Add to the convention a 47.3 bis article of the following literal tenor:

" Article 47.3 bis. Homogenization wage supplement (CSH).

The values of the Homogeneization wage supplement of the autonomous cities, provinces and/or Autonomous Communities whose agreements have ended their initial term agreed on December 31, 2014, will be as follows:

Add a seventh transient disposition with the following literal tenor:

" Transient disposition seventh. Specific rules for the entry into force of the convention.

1. Caceres y Cuenca: Although the provincial agreements of Cáceres and Cuenca are due on December 31, 2015, their contents are known for this year and given the possibility accepted by the parties to anticipate the implementation of this state agreement. by agreement between the parties, the annexes of the framework of professional categories in the new classification of this convention and of the different salary concepts in the salary structure are included from this date.

In the same way and to facilitate conversion for those who agree in advance, the value of the homogenization wage supplement of the province of Cuenca is determined below, since in Cáceres no the credit for such a concept should be:

2. Bizkaia. In the territory of Bizkaia the current collective bargaining agreement will continue to apply in general, according to the following rules:

(a) If the clause relating to its validity in ultra-activity is completed, this is, 1 July 2016, no new general effectiveness agreement would have been formalised for the general trade agreement of Bizkaia, the present state collective agreement from that date.

The salary increase set for 2016 in Article 47 (6) shall apply from 1 July 2016.

The incorporation of the seniority amounts in accordance with the transitional provision fifth, paragraph III b.2, to the ad personam complement will occur on 1 January 2018.

The amount of the Plus transport to be incorporated according to the provisions of the transitional provision fifth paragraph III C) shall be related to the amount received in such a concept in the period 1 July 2015 to 30 June 2016.

b) If before the end of the clause relating to its validity in ultra-activity, this is, 1 July 2016, a new general effectiveness agreement would have been formalized for the trade agreement in general of Bizkaia, the present State collective agreement shall apply from 1 January 2017.

The incorporation of the seniority amounts according to the transitional provision fifth paragraph III b.2 to the ad personam complement will occur on January 1, 2018.

The amount of the Plus transport to be incorporated in accordance with the provisions of the transitional provision fifth, paragraph III (C), shall be referred to the amount perceived in such a concept in the year 2016. "

Incorporate the annexes of the adequacy of categories and salary concepts of all the pending territories of application of the state convention that are attached to these minutes.

The parties agree to ask the Employment and Social Security Directorate-General for Employment and Social Security to register, register and publish this agreement to modify the content of the accompanying collective agreement. to these minutes in the "Official State Gazette".
