Order AAA/838/2012 of 20 April on the delegation of powers of the Ministry of Agriculture, Food and the Environment, in a single instrument, for reasons of legal certainty and transparency in the administrative action, the whole system of delegation of the higher bodies and managers of the department.

Paragraph 2 of Chapter I of the aforementioned order states that, after approval by the Minister and the Secretary of State for the Environment, they are delegated to the Secretary of State for the purposes of Finance direct execution projects by the Ministry of Agriculture, Food and Environment for the conservation and enrichment of the Spanish Historical Heritage, with one per cent cultural, the faculties that correspond to the authorisation, commitment of expenditure and recognition of obligations on the issue of accounting documents, as well as those relating to them as the contracting authority and body responsible for the processing and signature of management and the powers of these acts in both cases.

However, and in relation to this last point, although the delegation of the competences for the processing and signing of management starts is foreseen, the delegation of the processing and signature of the conventions, as well as that of the powers that derive from these acts, which in practice has led to dysfunctions in the process of execution.

Therefore, the amendment of Order AAA/838/2012 of 20 April, to include in it the delegation, in the Undersecretary, of the competence for the processing and signing of agreements financed with the credits of 1%, is appropriate. cultural. All this, in order to act in accordance with the principles of legal certainty and efficiency, efficiency and administrative simplification.

Accordingly, in accordance with the provisions of Article 13 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, and in the additional provision Thirteenth of the Law 6/1997, of 14 April, of the organization and operation of the General Administration of the State, I have:

First. Amendment of Order AAA/838/2012 of 20 April on the delegation of powers of the Ministry of Agriculture, Food and the Environment.

Paragraph 2 of Chapter I "Delegation of competences in the field of public expenditure" of Order AAA/838/2012 of 20 April on the delegation of powers of the Ministry of Agriculture, Food and the Environment redacted as follows:

" 2. The Minister and the Secretary of State for the Environment, after the Minister's approval, are delegated to the Secretary of State for the appropriations to finance direct implementation projects by the Ministry of Agriculture, Food and Environment for the conservation and enrichment of the Spanish Historical Heritage, with one per cent cultural, the faculties corresponding to them in relation to the authorization, commitment of expenditure and recognition of obligations relating to the issuing of accounting documents, as well as those relating to them as the contracting authority and body responsible for the processing and signing of conventions and the management and the powers of these acts in both cases.
