Having regard to the text of the Act of 13 May 2015, which contains the agreements concerning salary tables and the new wording of Article 26 of the 11th State-wide collective agreement on assistance and education centres child (code 99005615011990), which was subscribed, on the one hand, by the ACADE, CEEC, CECEI, EyG and FCIC business associations, representing the companies in the sector, and the trade unions FETE-UGT, USO and FSIE, in representation of workers, and in accordance with the provisions of Article 90 (2) and (3) of the Law of the Workers ' Statute, recast text approved by Royal Legislative Decree 1/1995 of 24 March, and Royal Decree 713/2010 of 28 May on the registration and deposit of collective agreements and agreements of work,

This Employment General Address resolves:

First.

Order the registration of the said act in the corresponding Register of collective agreements and agreements working through electronic means of this Steering Center, with notification to the Commission Negotiator.

Second.

Arrange your publication in the "Official State Bulletin".

ACT OF AGREEMENTS OF THE NEGOTIATING COMMISSION OF THE XI COLLECTIVE AGREEMENT OF THE STATE-WIDE AREA OF CHILD CARE AND EDUCATION CENTERS

In Madrid, at 13:00 on Wednesday, May 13, 2015, people gathered at the headquarters of ACADE, representing employers ' and trade union organizations, are meeting at the ACADE headquarters.

The employer and union banks act with the same legitimacy as in the minutes of the establishment of the negotiating table of this convention, dated November 11, 2009, to which the full content is transmitted.

The signatory parties subscribe to the following agreements:

First.

It is agreed to amend Article 26 of the Convention, which will be worded as follows:

" Article 26. Succession of companies.

1. As regards the succession of undertakings, it will be within the meaning of Article 44 and concordant, of the recast text of the Law of the Workers ' Statute.

2. For private companies which manage public ownership centres, in the cases where the award of the concession to a new company takes place, by the end of the concession and subsequent competition, rescue of the service by the the holder or any other modification in the system of management of the service, shall be before an assumption of subrogation of all the rights and obligations of the workers with contract in force and minimum seniority of three months in the company Article 44 of the recast text of the Law of the Workers ' Statute shall be governed by Article 44.

To effect the subrogation referred to in this paragraph 2, the following procedure must be followed:

1) The incoming company must communicate, through feisty means, to the outgoing company, its status as a new contracting authority for the service.

2) The outgoing company shall notify the workers of the change of the concessionaire, with an indication of the social reason of the incoming undertaking.

3) The outgoing company will make available to the incoming and legal representation of the workers, if any, within the maximum period of 10 calendar days before the start date of the service by the new company adjudicate, the following documentation:

(a) The relationship of subrogated workers, with the indication of their personal and work data.

b) Copy of work contracts for related workers.

c) Copies of the last three salary receipts of related workers.

d) Certificate of being found to be aware of your obligations to Social Security.

e) Photocopy of the TC/2 models of the last 4 months. "

Second.

The amendment to Article 26 agreed upon in the previous paragraph will enter into force on the day of the publication of these agreements in the "Official State Gazette".

Third.

Pay maintenance is agreed for the years 2014 and 2015. The salary tables are those referred to in Annex II and Annex IIa which are attached to these minutes.

Fourth.

The workers of the Social Works Centres, themselves of a non-profit and profit-making teacher, will have a salary increase in 2014 of 0.6%, which will be applied to the remuneration concepts that establishes the Convention, paid on the payroll of December of the previous year and always on the basis of the accumulations that have been produced. Wage maintenance is agreed for 2015.

Fifth.

In relation to Annex III of the Collective Agreement corresponding to the salary of the Master in the Concerted Units of Child Education (second cycle), the negotiation of the salary tables 2014 and 2015 is postponed to a meeting back.

Sixth.

The Secretariat (UGT) is authorized to make appropriate representations to the Directorate General of Employment for the registration and publication of these agreements.

No more issues to be dealt with.
