The additional provision of Law 15/2014, of 16 September, of rationalization of the Public Sector and other measures of administrative reform, creates the Register of Vehicles of the State Public Sector, with the object of grouping and unify in a single file all vehicles belonging to this sector, which will allow to rationalize its management and control.

According to the provisions of this provision, all vehicles of the General Administration of the State and of the agencies and entities that make up the public sector, defined in the Article 2 of Law 47/2003, of 26 November, General Budget, and shall be excluded vehicles of the Armed Forces and those of the State Security Forces and Corps, provided that they are vehicles assigned to the exercise of specific and specific functions of such Forces or Bodies.

The management of the registry is attributed to the autonomous agency Parque Móvil del Estado, and it is fixed a period of six months from the approval of the present order for those responsible for the management or administration of the Currently existing vehicles apply for registration in the Register.

In addition to the above vehicles, the Registry will collect the new acquisitions that are made for purchase, renting, leasing or any other similar legal business. To this end, it is established that these acquisitions must be authorized by the Directorate General of the State Mobile Park, which, for these purposes, will exercise the functions of approval of services in respect of the determination of the Models, characteristics and types of vehicles, which will contribute effectively to achieving the necessary homogeneity between the models that make up the different existing fleets.

Moreover, in Article 7 of this order the Commission for the Acquisition and Inventory of Vehicles and the Approval of Services, set up by Article 20 of Royal Decree 146/1999 of 29 January 1999, is being developed. the basic organic structure and functions, and the autonomous organism Móvil Móvil Ministerial in Mobile Park of the State is transformed, in its wording given by Royal Decree 1527/2012, of 8 November, of reform of the previous Royal Decree.

In its virtue, according to the State Council, I have:

Article 1. Object.

This order is intended to regulate the State Public Sector Vehicle Registry created by the additional provision of Law 15/2014 of 16 September 2014 on the rationalization of the Public Sector and other measures of administrative reform, in order to group and unify all vehicles belonging to that sector in a single file.

Article 2. Vehicles included.

All vehicles of the General Administration of the State and of the agencies and entities that make up the state public sector, as defined in Article 2 of Law 47/2003, of 26 November, shall be included in the Register. General Budget.

Article 3. Vehicles excluded.

Vehicles of the Armed Forces and those of the State Security Forces and Corps shall be excluded, provided that they are vehicles assigned to the exercise of their own and specific functions of those Forces or Bodies.

For these purposes, they shall be deemed not to be attached to the exercise of their own and specific functions of the Armed Forces and the State Security Forces and Corps, the following vehicles:

(a) Vehicles purchased to provide the services of representation listed in Article 5 of Royal Decree 146/1999 of 29 January 1999 and which are not provided with vehicles of the State Mobile Park.

(b) Vehicles that are purchased to serve personnel of the Armed Forces and of the State Security Forces and Corps, which provide civilian services in the General Administration of the State.

(c) Vehicles intended to provide mobility services not directly related to the specific and specific operational functions of the Armed Forces and the State Security Forces and Corps.

Article 4. Management, management and operation of the Registry.

1. The management of the Register corresponds to the autonomous body Parque Móvil del Estado.

2. The Register shall be electronic. The State Mobile Park will develop an application that will be users of the State Public Sector bodies affected by the additional provision of Law 15/2014, of September 16, of rationalization of the Public Sector and other measures for administrative reform. The application will have the following functions:

(a) It shall provide the operators of the bodies referred to in the previous paragraph with access to information relating to the Register of Vehicles.

b) Canalize all applications, communications and annotations between the State Public Sector organs, the Vehicle Registry and the Vehicle Acquisition and Inventory Commission and the Services Approval.

c) It will be deployed and will be accessible from the SARA network, which connects Spanish Public Administrations under Royal Decree 4/2010 of 8 January, which regulates the national interoperability scheme in the field of the Electronic Administration.

d) It shall be published as a service at the central electronic headquarters of the Ministry of Finance and Public Administrations.

3. The Registry shall have the appropriate organisational and technical means to ensure the interoperability and safety of the Register in accordance with the provisions of the current rules.

Article 5. Purchase of vehicles.

1. The acquisition by purchase, renting, leasing or any other similar legal business carried out by the subjects referred to in Article 2 of this order, must be authorized by the Directorate-General of the State Mobile Park. By means of this authorization, the Directorate-General shall verify that the models, characteristics and types of vehicles purchased are in conformity with the types, subtypes and, where appropriate, classes, laid down in the framework agreements or contracts. In the case of the Ministry of Finance and Public Administrations, the Ministry of Finance and Public Administrations have been involved in the process.

2. Prior authorization of the State Mobile Park will be an essential requirement for the purchase of vehicles. The acquisitions should be carried out through the General Direction of Rationalization and Centralization of the Procurement. This will require the approval of the State Mobile Park to be incorporated into the file.

3. Requests for the exception of vehicle acquisitions outside the existing centralised contracts, including rental and leasing applications, shall be submitted with the prior authorisation of the State Mobile Park to which it relates. This order, in order to be processed by the Directorate-General for Rationalization And Centralisation of Recruitment, which must, in any case, inform them favourably in order to be able to carry out such recruitment on the margins of the State centralised procurement, in accordance with the provisions of Article 5 of the Order EHA/1049/2008 of 10 April of declaration of goods and services of centralised procurement.

4. The vehicles thus acquired must be entered in the Register within 15 days of the date of acquisition, being considered as such, the date of their formal receipt.

Article 6. Casualties and modifications.

In order to keep the Register permanently up to date, the use or destination of the registration, casualties or modifications must be communicated within 15 days of the occurrence of the causative event.

Article 7. Commission of Acquisition and Inventory of Vehicles and Approval of Services.

1. The Commission of Acquisition and Inventory of Vehicles and Approval of Services of the State Mobile Park, created by Article 20 of Royal Decree 146/1999, of January 29, by which the basic organic structure and functions are modified, and transforms the autonomous organism Móvil Móvil in Mobile Park of the State, in its wording given by Royal Decree 1527/2012, of 8 November, of reform of the previous Royal Decree, will have the following functions:

(a) Attend to the Directorate-General of the body in the decision-making on the acquisition of the vehicles with which the services provided for in Article 5 of Royal Decree 146/1999 of 29 January 1999 are to be provided, that the basic organic structure and functions are modified, and the autonomous agency Móvil Móvil Ministerial in State Mobile Park is transformed.

b) Conduct the procurement programming studies of the State Mobile Park vehicles.

c) Order and verify the physical count and legal situations of the vehicles of the organism.

d) Propose to the Directorate General those vehicles of the organism that for its antiquity, state of conservation or any other circumstance must be discharged.

e) Propose how many improvement actions are deemed appropriate for the correct accounting and management of the State Mobile Park vehicles.

f) Advise the Directorate-General on the determination of the models, characteristics and types of vehicles that may correspond to the different services, as well as any other management issues, management and operation of the State Public Sector Vehicle Registry created by the additional provision of Law 15/2014 of 16 September 2014 on the rationalization of the Public Sector and other measures of administrative reform.

g) Report applications for prior authorisation to the purchase of vehicles which are formulated in accordance with the provisions of Article 5 of this order.

h) Propose how many measures and actions are deemed necessary in relation to the management, management and operation of the State Public Sector Vehicle Registry.

2. The Commission shall be chaired by the holder of the General Management Subdirectorate and shall form part of the headlines of the General Secretariat, the General Secretariat of the Economic Regime and the Subdirectorate-General for Human Resources. as a Head of Service of the General Management Subdirectorate. He will act as Secretary, with voice but no vote, a Chief of Service of the General Secretariat.

3. In the case of vacancy, absence or sickness, the chairman shall be replaced by the holder of the General Economic Regime Subdirectorate. The Vowels and the Registrar shall be replaced by those appointed by the General Directorate of the Body.

Additional disposition first. Duplicity of services.

When for reasons of security or institutional nature, any user or authority included in the scope of the motoring services provided by the State Mobile Park already has this service. have been assigned another body or institution, the State Mobile Park shall not provide or suspend the service which in another case would have been provided to it.

Additional provision second. Personal and material means.

The actions foreseen in this order will be carried out with the personal and material resources available in the agency, without increase in expenditure.

Single transient arrangement. Registration of vehicles which at the entry into force of this order integrate the fleets of the agencies or entities of the state public sector.

Those responsible for the management or administration of vehicles which are eligible for registration in accordance with the provisions of Article 2 above shall apply for registration in the Register within six months of the date of the entry into force of the entry into force of this order.

Single repeal provision. Regulatory repeal.

Any provisions of equal or lower rank shall be repealed in accordance with the provisions of this order, and in particular the fourth paragraph of the Order of the Ministry of Economic Affairs and Finance of 30 June 1999. The Director General of the State Mobile Park is empowered to issue the instructions necessary for the execution and development of the provisions of this order.

Final disposition second. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
