Royal Decree 1049/2003 of 1 August, approving the Quality Standard for honey, sets out the requirements laid down by Council Directive 2001 /110/EC of 20 December 2001 on honey.

Directive 2014 /63/EU of the European Parliament and of the Council of 15 May 2014 amending Directive 2001 /110/EC on honey amends requirements to be incorporated into national law. In particular, it amends the labelling of honey from more than one Member State or a third country, as with the entry into force of the Treaty of Lisbon, the European Union replaced and succeeded the European Community. It also states that pollen, being a specific natural component of honey, should not be considered an ingredient of honey.

The total incorporation of Directive 2014 /63/EU into the Spanish legal order constitutes the object of this royal decree amending the quality standard for honey, approved by Royal Decree 1049/2003 of 1 August.

On the other hand, following the entry into force of Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011 on food information provided to the consumer and amending the Regulations (EC) No 1924/2006 and (EC) No 1925/2006 of the European Parliament and of the Council, and repealing Commission Directive 87 /250/EEC, Council Directive 90 /496/EEC, Commission Directive 1999 /10/EC, Directive 2000 /13/EC of the European Parliament and of the Council European Parliament and the Council, Commission Directives 2002/67/EC and 2008 /5/EC and the Regulation Commission Regulation (EC) No 608/2004, references to Royal Decree 1334/1999 of 31 July 2004, shall be construed as referring to that Regulation.

In its processing, the autonomous communities and representative entities of the affected sectors have been consulted, with the interministerial Commission for Food Management having issued a mandatory report.

In its virtue, on the proposal of the Minister of Agriculture, Food and the Environment and the Minister of Health, Social Services and Equality, in agreement with the Council of State and after deliberation of the Council of Ministers in its Meeting of the day 12 June 2015,

DISPONGO:

Single item. Amendment of Royal Decree 1049/2003 of 1 August approving the Quality Standard for honey.

The unique article of Royal Decree 1049/2003 of 1 August, approving the Quality Standard for honey, is amended as follows:

One. Paragraph 4.4 of the Quality Standard for honey is replaced by the following:

" 4.4 Without prejudice to paragraph 3.2.2 (f), which relates to filtered honey, pollen or other specific components may not be removed from honey, except where it is unavoidable in the process of removal of organic or inorganic material from outside it. "

Two. Paragraph 5.1.4 of the Quality Standard for honey is worded as follows:

" 5.1.4 The country or countries of origin in which the honey has been harvested must be mentioned on the label.

However, in the case of mixtures, if the honey is originating in more than one Member State or third country, that indication may be replaced by one of the following, as appropriate:

1. ° 'mixture of honey originating in the EU' '.

2. ° 'mixture of non-EU honeys'.

3. ° 'mixture of originating and non-originating honey in the EU'. '

Three. The following point is added to paragraph 5:

" 5.3 Since pollen is a specific natural component of honey, in the products defined in paragraph 3, it shall not be considered as an ingredient within the meaning of Article 2 (2) (f) of Regulation (EU) No 139/2014. 1169/2011 of the European Parliament and of the Council of 25 October 2011 on food information provided to the consumer and amending Regulations (EC) No 1924/2006 and (EC) No 1925/2006 of the European Parliament and of the Council, and repealing Council Directive 87 /250/EEC, Council Directive 90 /496/EEC, the Directive Commission Directive 2000 /13/EC of 1999 /10/EC of the European Parliament and of the Council, Commission Directives 2002/67/EC and 2008 /5/EC and Commission Regulation (EC) No 608/2004. '

Single additional disposition. Control of public expenditure.

The measures included in this rule may not result in an increase in appropriations or remuneration or other staff costs.

Single transient arrangement. Marketing of product stocks.

Products marketed or labelled before 24 June 2015 in accordance with Royal Decree 1049/2003 of 1 August may continue to be placed on the market until stocks are exhausted.

Final disposition first. Incorporation of European Union law.

This royal decree incorporates into Spanish law, in its entirety, Directive 2014 /63/EU of 15 May 2014 amending Council Directive 2001 /110/EC of 20 December 2001 on honey.

Final disposition second. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
