Article 20.1 of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, states that the creation, modification or deletion of files of Public Administrations may be made only by means of general provision published in the Official Journal of the State or the official journal concerned.

This same requirement was already imposed in article 18 of the Organic Law 5/1992, of October 29, of Regulation of the Automated Treatment of Personal Data, which was repealed by the aforementioned Organic Law 15/1999. In accordance with the provisions of Article 18, the Order of the Ministry of Public Works of 4 October 1999 was approved in order to update the relationship of automated files of personal data of the Ministry of Public Works.

After the Order that has just been mentioned, several Orders were approved in which modifications were made to the relationship of files of the Department, among them the Order FOM/1109/2011, of April 13, for which Updated the relationship of personal files of the Port Authority of Tarragona. Through the Order that is now approved, the list of files of the Ministry of Public Works is updated again, in order to create two new files for which the Port Authority of Tarragona is responsible.

It must be said that this Order has been informed, during its processing, by the Spanish Data Protection Agency, in its virtue, I have:

First. Creating files.

In Annex I of this Order, the new creation file (called "Port Police") is related that, corresponding to the Port Authority of Tarragona, must be incorporated into the set of data files of character Staff of the Ministry of Public Works.

In the above mentioned annex, the responsible organ and service or unit to which the rights of access, rectification and cancellation can be exercised; the name of the file; the purpose of uses; the persons or collectives of which it is intended to obtain data of a personal nature or to be required to supply it; the procedure for the collection of the data; the basic structure of the file; the intended disposals of such data, where appropriate; and the security measures of the data files.

The security measures set out in the relevant paragraph are those that are applicable in accordance with the provisions of Royal Decree 1720/2007 of 21 December 2007 on the implementation of the Regulation on the development of the Organic Law 15/1999, of December 13, of protection of personal data.

Second. Deleting files.

The two files with personal data that are included in Annex II (called "Laves of the APT" and "Lost Objects") are deleted.

The destination of the information of these files will be integrated into the new creation file "Police Port", as provided for in article 20.3 of the Law 15/1999, of December 13.

Third. Modifying files.

The nine files with personal data that are included in Annex III (called "Entry and Exit Registration", "Candidates to Work in the APT", "Customers and Suppliers", "Management Board", are amended. "Presence, visitation and accreditation", "Claims and legal reports", "Exhibitions that perform the APT", "Personal" and "Videosurveillance"), establishing the modifications indicated therein, in accordance with the Article 20.3 of the Organic Law 15/1999 of 13 December.

Fourth. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
