EXPLANATORY STATEMENT

I

The Mobile World Congress is an annual conference around the world of mobile communication. The organisation falls under the "Groupe Speciale Mobile Association" (hereinafter the GSMA) which brings together almost 800 mobile operators from 219 countries, as well as more than 200 companies in the mobile world. Since 1990 the GSMA association has been organizing the "Mobile World Congress" and since 2006 it is held in Barcelona. This is an event of special relevance in the world of mobile telephony.

In 2010, GSMA established a new approach to the celebration of this event for the period 2012-2018, opening a process for the submission of applications worldwide. In this selection process, which lasted 18 months, more than 30 cities from all over the world took part and the cities of Munich, Milan, Paris and Barcelona were finalists, the latter being finally selected, so it was signed on July 14 2011 with GSMA the corresponding "Agreement". With the declaration of Barcelona as "Mobile World Capital" until 2018, Barcelona is not only the official headquarters of the aforementioned event but also the headquarters of a whole series of performances and parallel projects to promote projects and companies. of mobility throughout the year.

The "Barcelona Mobile World Capital" is undoubtedly a singular performance of relevant characteristics and implications for the telecommunications sector, with an important effect on the whole of the Spanish economy. It coincides with a moment of expansion or new technological leap for the disruption and expansion of mobile internet and the new devices and channels of access to the network that is transforming the business models on the internet to services from mobile devices and access to the network from channels in mobility. It is mobility that is enabling the expansion of new applications, the redesign of existing services and, above all, it is allowing access to the Internet for more and more people in the world.

The event offers the opportunity for Spanish companies to take advantage of this wave of innovation, opening a multitude of opportunities to share and export business initiatives that have been successful here. In addition, "Barcelona Mobile World Capital" is an event of particular relevance, not only from the point of view of the development of telecommunications and the development of technologies and the information society, but also from the point of tourist view and the image of Spain by associating, as attributes of our country, technology and modernity.

The positive impact of the "Barcelona Mobile World Capital" has been increased year-on-year. In the 2014 edition, revenues were encrypted at 397 million euros, 12,300 jobs and 30 million euros of collection. The cumulative economic impact of the "Mobile World Congress" in the city of Barcelona (in the period 2006-2014) is estimated at 2.5 billion euros and the impact on the labor market amounts to 60,000 temporary jobs. The forecasts of the economic impact for the next few years are even better, counting with the consolidated prestige of this event, reference on a world level, and the multiplication of activities related to the development of the technologies mobile led by the "Mobile World Capital Foundation".

In the last edition of the Congress held in early 2015, the Mobile World Congress brought together more than 93,000 visitors from 200 countries and over 2,000 companies that showed highly innovative products and services in 100,000 countries. square meters of exhibition space. The Government has publicly expressed its willingness to support this event, both with the demonstration of this support by the President of the Government in Parliament and with the presence of the King of Spain and various Member of the Government in Barcelona during its celebration. In addition to the high positions of the Ministry of Industry, Energy and Tourism, they have been regularly participating in the meetings of the Board and the Executive Committee.

At the moment the GSMA association has proposed not to open the selection process to new venues for the period 2019-2023 if, from Spain, the existing commitment is extended.

The City of Barcelona City Council together with the "Mobile World Capital Foundation" has announced its intention to present a proposal to renew the current commitment to continue the event in Barcelona. Barcelona during the period 2019-2023.

The renewal of the commitment to the celebration of the event for this new period is especially important. If this renewal is not signed, there is a risk of the loss of the condition of "Mobile World Capital" for Barcelona. The consequences would be very important as the "Mobile World Congress" is the main international congress held in Spain.

The need is determined by the GSMA decision calendar. The Council of that association will decide, at its next meeting on 14 July 2015, whether to approve the renewal of the Barcelona capital for the period 2019-2023 or to open the selection process to other candidates.

The approval of the renewal by the Board of GSMA requires the prior signature by all parties of the extension of the "Agreement" of 2011, in the terms negotiated by those parties and which were submitted and ratified by the Mayor of the city of Barcelona on June 2, 2015 and by the Coneller d' Empresa i Ocupació on June 9, 2015. Currently the only participating organization in the event "Barcelona Mobile World Capital" that has not subscribed to this extension of the agreement is the General Administration of the State.

In this standard, the circumstances of extraordinary and urgent need required by Article 86 of the Spanish Constitution for the approval of the decree-laws are present, due to their nature and purpose.

The adoption of the measures regulated in this royal decree is due to the need to enable the Minister of Industry, Energy and Tourism, on behalf of the General Administration of the State, to sign the extension of the aforementioned law. "Agreement" of 14 July 2011, until 1 October 2023, in order to obtain the designation of Barcelona as "Mobile World Capital" for the period 2019-2023. All this requires an immediate response, which justifies the adoption of this measure with the utmost urgency.

In its virtue, in use of the authorization contained in article 86 of the Spanish Constitution, on the proposal of the Minister of Industry, Energy and Tourism, after deliberation of the Council of Ministers at its meeting of June 26 2015,

DISPONGO:

Article 1. Ratification of agreements regarding the renewal of the designation of the city of Barcelona as "Mobile World Capital" for the period 2019-2023 and authorization for the signature of such renewal.

1. The protocol signed between the Ministry of Industry, Energy and Tourism of the Kingdom of Spain, the Generalitat de Catalunya and the Ajuntament of Barcelona, as well as the offer presented to GSMA Ltd, signed on March 26, 2015, is ratified. Ministry of Industry, Energy and Tourism of the Kingdom of Spain, Generalitat de Catalunya, Ajuntament de Barcelona, Consorci de Turisme de Barcelona, Fira Internacional de Barcelona and Fundación "Mobile World Capital Foundation" for the renovation of the designation of the city of Barcelona as "Mobile World Capital" for the period 2019-2023.

2. The Secretary of State for Telecommunications and the Information Society, representing the General Administration of the State, is hereby authorised to sign the extension of the Agreement of 14 July 2011 until 1 October 2023, in respect of the terms negotiated by the parties and ratified by the Mayor of the City of Barcelona on 2 June 2015 and by the Conseleller d' Empresa i Ocupació de la Generalitat de Catalunya on 9 June 2015.

Article 2. Guarantee of the rights of the General Administration of the State.

1. In the event that the General Administration of the State has to deal with liabilities arising from the application of Article 27 of the Agreement referred to in this rule, the signatory public administrations shall, on the part of the it is attributable to them, the responsibilities to be incurred, in accordance with the provisions of this Article and in the provisions of a regulatory nature which, in development and implementation, are issued.

2. The General Administration of the State shall take the necessary measures to guarantee its rights in respect of claims directed against it by obligations for which another Public Administration is responsible, articulating the the compensation mechanisms that are appropriate.

Single additional disposition.

In the light of the urgency of the signature of the agreement authorised in Article 1, the processing of the relevant expenditure file must be completed within one month.

Single end disposition. Entry into force.

This royal decree-law will enter into force on the day of its publication in the "Official State Gazette".
