By Order ITC/1977/2006 of 15 June, the automated files were determined with personal data of the extinct Ministry of Industry, Tourism and Commerce and of the public bodies attached or dependent of the same. Subsequently, by orders ITC/1864/2007 of 6 June 2007, ITC/3667/2007 of 30 November 2007 and ITC/550/2009 of 26 February, the creation, modification and deletion of certain files of the said Ministry or its bodies public.

On the other hand, Royal Decree 1823/2011, of December 21, restructured the ministerial departments, suppressing the Ministry of Industry, Tourism and Trade and creating the Ministry of Industry, Energy and Tourism.

Subsequently, Royal Decree 344/2012 of 10 February, developed the basic organic structure of the Ministry of Industry, Energy and Tourism by determining the management bodies up to the organic level of general sub-direction and defining the competencies of these bodies, as well as the various bodies and entities attached to or dependent on this ministry.

As a result of the structural changes noted and the time since the last update of the files containing personal data of the department, and in order to obtain the maximum clarity and, The Committee on Legal Affairs and Citizens 'Rights, the Committee on Legal Affairs and Citizens' Rights, and the Committee on Legal Affairs and Citizens ' Rights, and the Committee of the European People's Department, its autonomous agencies attached: Spanish Centre for Metrology, Institute for the Restructuring of Coal Mining and Alternative Development of the Mining Comarcas, the Institute of Tourism of Spain, and the Spanish Patent and Trademark Office, as well as the business public entities attached: Institute for the Diversification and Savings of Energy and Red.es. Therefore, this provision includes the listing of the files of the Ministry and these autonomous organizations and public entities, indicating those already existing that are maintained, with or without modifications, the newly created files and those that are deleted, giving compliance to the Article 20 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data, which states that the creation, modification or deletion of the files of the Public Administrations may be done only by means of of general provisions published in the Official Journal of the State or in the official journal concerned.

The reports of the Department of the Electronic Administration of the Department and the Agency for Data Protection have been collected during the process of processing this provision.

In its virtue, I have:

Article 1. Object.

This order aims at the creation, modification and deletion of files of personal data existing in the Ministry of Industry, Energy and Tourism, as well as in certain public bodies attached to the same.

Article 2. Scope.

This order applies to the files of personal data existing in the Ministry of Industry, Energy and Tourism, as well as in the following public bodies: Spanish Metrology Centre, Institute for Restructuring of Coal Mining and Alternative Development of the Mining Comarcas, the Spanish Tourism Institute, and the Spanish Patent and Trademark Office, Institute for Energy Diversification and Savings and Red.es.

Article 3. Existing files.

All personal data files of the Ministry of Industry, Energy and Tourism, as well as the public bodies referred to in the 2 article are detailed in Annex I, including:

(a) The personal data files existing prior to the entry into force of this order.

b) Data files of a personal nature are the responsibility of the Ministry of Industry, Energy and Tourism and its public bodies attached to the entry into force of this order and which are modified in the terms set out in Annex I.

c) Personal data files created by this order, listed below:

Article 4. Files deleted.

1. The personal data files listed in Annex II are deleted.

2. The destination to be given to the data or, where appropriate, the forecasts to be adopted for destruction, in accordance with the provisions of Article 54.3 of the Implementing Regulation of the Organic Law 15/1999 of 13 December, of Protection of the Personal Data, approved by Royal Decree 1720/2007 of 21 December, will be the one established for each of them in Annex II.

Article 5. Notification.

In compliance with Article 55 of Royal Decree 1720/2007 of 21 December, the files will be notified to the Spanish Data Protection Agency for registration in the General Data Protection Register within the deadline. 30 days since the publication of this order in the "Official State Gazette".

Single repeal provision. Regulatory repeal.

The following provisions are hereby repealed with regard to personal data files, which are the responsibility of the Ministry of Industry, Energy and Tourism and its public bodies attached to it:

a) Orders:

1. Order of 26 July 1994 on the creation and use of personal data files of the Ministry of Commerce and Tourism.

2. Order CTE/3147/2002, of November 28, regulating the files of personal data of the Department and of the Public Bodies of research dependent on it.

3. Order ECO/143/2002, of 10 January, regulating the automated files of personal data of the central organization and of certain public bodies attached to the Ministry of Economy.

4. Order ECO/1686/2003, of June 12, to create the file for automated processing of personal data "Electronic Single Document (DUE)" of the Ministry of Economy.

5. Order ITC/3358/2004, of October 8, which incorporates a personal data file for the management of the Pension Plan at the Ministry's level.

6. Order ITC/1977/2006, of 15 June, determining the automatic files with personal data of the Ministry of Industry, Tourism and Commerce and of the public bodies attached to or dependent on the same.
