Order Pre/1325/2015, Of 30 June, Which Regulates Files Of Personal Data Managed By The Ministry Of The Presidency And Its Affiliated Agencies.

Administrative reorganizations operated by Royal Decree 199/2012, 23 January, which develops the basic organizational structure of the Ministry of the Presidency have been variations in the bodies responsible for various automated file of personal character data corresponding to the Ministry of the Presidency, whose creation was performed by the corresponding ministerial orders, as established in article 20 of the organic law 15/1999 , of 13 December, of protection of personal data.

In addition, with the passage of time the exercise of the powers of certain bodies of the Ministry of the Presidency and organizations attached to the Department requires that several automated personal data files are created and existing ones are modified.

Finally, for lack of use, by introducing variations regulations, because they are excluded from the application of the rules of data protection in accordance with article 2(2) of the regulations implementing the organic law 15/1999 and for other needs of management and organization of information in the data, it is necessary to delete several files existing in the Department.

All these modifications, require an adaptation of the rules governing the files of personal data of the Ministry of the Presidency and its public bodies attached, grouping all of the data files, in a single standard for reasons of regulatory simplification, transparency and legal certainty, thereby avoiding regulatory dispersion.

By virtue, to ensure maximum transparency in the automated processing of data of a personal nature, thus ensuring citizens the legitimate rights exercise, following a report from the Spanish Agency of data protection, available: article 1. Object.

This order aims to the creation, modification and deletion of computer files of personal data in the Ministry of Presidency and public bodies attached to it.

Article 2. Scope of application.

This order is applicable to files of personal data in the Ministry of the Presidency and the following public agencies: Agency State official Gazette, Centro de Investigaciones sociológicas, Center for political studies and constitutional and Board of Directors of the national heritage.

Article 3. Creation of files.

Create computer files of personal data which are included in annex I.

Article 4. Modification of personal data files.

Amending the personal automated files which are included in annex II.

Article 5. Deletion of personal data files.

Are deleted Cadese automated personal data files, tags, and decorations of the Royal order of Civil recognition to the victims of terrorism (from the Ministry of the Presidency), Control of presence, web users and database of labour and management (of the «Official Gazette»), SICAI payments to third parties, tax agency data, teachers and students and management of recurrent publications (from the constitutional and political Studies Center) Employee, staff, RIRPF (of the Board of Directors of the national heritage).

Responsible for these files shall take appropriate measures to delete and destroy many copies of security would have on them, notwithstanding that, in his case, data for the resolution of resources that could be filed against the resolutions adopted be preserved.

Article 6. List of files managed by the Ministry of the Presidency and its dependent agencies.

All of the files managed by the Ministry of the Presidency and its agencies dependent, including the created and modified by this order, are expressed in annex III.

Article 7. Responsible persons.

The responsible persons of the files shall take measures of management and organization that are necessary to ensure the confidentiality, security and integrity of the data, as well as the leading to make effective warranties, obligations and rights under the applicable legislation.

Article 8. Registration of files.

Pursuant to article 55 of Royal Decree 1720 / 2007, of 21 December, which approves the regulations implementing the organic law 15/1999, of 13 December, of protection of personal data, the files will be notified to the Spanish Agency of data protection for the registration in the General Register of data protection within the period of thirty days from the publication of this order in the «Official Gazette of the» State'.

Sole repeal provision.

The following provisions are hereby repealed: order of 30 September 2000, by which automated personal data files are created.

Order of 23 November 2001, which regulates the automated files that contain personal data managed by the Ministry of the Presidency and autonomous bodies attached to it.

Order PRE/3651/2004, of November 8, which are created and modified the automated files of personal data managed by the Ministry of the Presidency and the autonomous bodies attached to it.

Order PRE/3077/2005, of 3 October, which are created and deleted several automated files of personal data managed by the Ministry of the Presidency.

Order PRE/1570/2006, of May 19, which creates various computer files of personal data managed by the Ministry of the Presidency.

Order PRE/2767/2009, of 6 October, which creates an automated file of personal character data and modify different files managed by the Ministry of the Presidency.

Order PRE/108/2010, of 25 January, by which they are created, modified and deleted files automated personal data, managed by the Ministry of the Presidency.

Order PRE-792-2011, on 4 April, by which creates an automated file of personal character data.

Order PRE-3561-2011, of 20 December, which will create and modify automated personal data files managed by the Ministry of the Presidency.

Order PRE/1862/2012, of 3 August, which are created, modified and files of personal data, managed by the Presidency of the Government shall be deleted.

Order PRE/1005/2013, 4 June, which creates an automated personal data file, is deleted another and different files are modified.

Sole final provision. Entry into force.

This order shall enter into force the day following its publication in the "Official Gazette".

The file and intended uses for the same purpose: manage requests for access to information of transparency that are held by the general administration of the State, since the application up to the resolution and response to the consultation.
