The administrative reorganizations operated by the Royal Decree 199/2012, of 23 January, for which the basic organic structure of the Ministry of the Presidency is developed have produced variations in the responsible bodies of various automated files of personal data corresponding to the Ministry of the Presidency, whose creation was carried out through the corresponding ministerial orders, as provided for in Article 20 of the Law 15/1999, of 13 December, for the protection of personal data.

Also, over time, the exercise of the powers of some of the organs of the Ministry of the Presidency and Agencies attached to the Department requires that several automated files of character data be created. personnel and modify existing ones.

Finally, for lack of use, for having introduced normative variations, for being excluded from the application of data protection regulations under article 2.2 of the Regulation of the Development of Organic Law 15/1999 and for other data information management and organization needs, it is necessary to delete several existing files in the department.

All these modifications, require an adaptation of the regulatory regulations of the personal data files of the Ministry of the Presidency and its Public Bodies attached, grouping together in a single norm the totality of data files, for reasons of regulatory simplification, transparency and legal certainty, thus avoiding regulatory dispersion.

In its virtue, to guarantee maximum transparency in the automated processing of personal data, thus assuring the citizenry the legitimate exercise of their rights, prior report of the Spanish Agency of Data Protection, I have:

Article 1. Object.

This order aims at the creation, modification and deletion of automated files of personal data existing in the Ministry of the Presidency and in the public bodies attached to it.

Article 2. Scope.

This order applies to the files of personal data existing in the Ministry of the Presidency and in the following public bodies: State Agency Official Gazette, Research Center

sociologicas, Centro de Estudios Políticos y Constitutional y Consejo de Administración del Patrimonio Nacional.

Article 3. Creating files.

The automated personal data files listed in Annex I are created.

Article 4. Modifying personal data files.

The automated personal files listed in Annex II are amended.

Article 5. Deleting personal data files.

The automated files of personal data Cadese, Labels, and Decorations of the Royal Order of Civil Recognition to the Victims of Terrorism (of the Ministry of the Presidency), Control of Presence, are deleted. Web Users and Database of Work and Economic Management (of the "Official State Gazette"), SICAI payments to third parties, Data Tax Agency, Teachers and students and Management of Periodic Publications (of the Center for Political Studies and Constitutional), Employee, Staff, RIRPF (of the Heritage Management Board National).

Those responsible for these files shall take the necessary measures to delete and destroy any number of copies of the file, without prejudice to the retention of the data for the resolution of the resources. which may be brought against the decisions taken.

Article 6. Relationship of files managed by the Ministry of the Presidency and its Dependent Bodies.

All files managed by the Ministry of the Presidency and its dependent agencies, including those created and modified by this Order, are those set out in Annex III.

Article 7. Responsible persons.

The persons responsible for the files shall take the necessary management and organizational measures to ensure the confidentiality, security and integrity of the data, as well as the conduct of the data. guarantees, obligations and rights recognised in the applicable rules.

Article 8. Registration of files.

In compliance with Article 55 of Royal Decree 1720/2007 of 21 December, approving the Regulation on the development of Organic Law 15/1999 of 13 December on the protection of personal data, the be notified to the Spanish Data Protection Agency for registration in the General Register of Data Protection within thirty days of the publication of this Order in the "Official State Gazette".

Single repeal provision.

The following provisions are repealed:

Order of September 30, 2000, creating automated personal data files.

Order of 23 November 2001, regulating the automated files containing personal data managed by the Ministry of the Presidency and Autonomous Bodies attached to it.

Order PRE/3651/2004 of 8 November, creating and modifying the automated files of personal data managed by the Ministry of the Presidency and the Autonomous Bodies attached to it.

Order PRE/30 77/2005 of 3 October 2005 for the creation and deletion of various automated files of personal data managed by the Ministry of the Presidency.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
