Having regard to Royal Decree 413/2014 of 6 June 2014 regulating the production of electrical energy from renewable energy sources, cogeneration and waste, in which the fourth additional provision is regulated by the the establishment of a specific remuneration scheme for a maximum of 120 MW applicable to installations or modifications of installations of different technologies to wind, solar thermal and photovoltaics under the additional provision Fourteenth of Law 24/2013, of December 26, of the Electrical Sector.

View of Order IET/1045/2014 of 16 June 2014 approving the remuneration parameters of the standard facilities applicable to certain electrical energy production facilities from energy sources renewable, cogeneration and waste, in which the third and fourth additional provisions provide for the time limit and method of submission, the documentation to be submitted and the other requirements for applications for registration in the register of remuneration specified in Preallocation status of the facilities defined in the disposition Fourth, Royal Decree 413/2014, of 6 June.

Having regard to the content and accompanying documentation of the applications submitted in time and form, in accordance with the provisions of the additional provision of Order IET/1045/2014 of 16 June 2014, as well as, where appropriate, the subsanatory documentation submitted by the interested parties within the time limit set.

Whereas the legal deadlines granted to the stakeholders for the submission of their requests have been met.

Whereas the power quota of 120 MW set out in paragraph 1 of the fourth additional provision of Royal Decree 413/2014 of 6 June 2014 for the establishment of a specific remuneration scheme for those installations which have not been entered in the remuneration pre-allocation register or in the first section of the register of electrical energy production facilities, are in one of the following situations:

(a) That they would have submitted an application for registration in the pre-allocation register under Article 4 of Royal Decree-Law 6/2009 of 30 April 2009 laying down certain measures in respect of the the energy sector and the social bond is approved, that said application would have had entry in the administrative register of the Ministry of Industry, Energy and Tourism, and that they met the requirements of article 4.3 of the Royal Decree-Law 6/2009, of 30 of April, all before the date of entry into force of the Royal Decree-Law 1/2012, of January 27.

(b) Having a definitive entry into service for the whole of the power for which registration is sought in the register of remuneration in the pre-allocation state in the 30 days natural after the entry into force of Law 24/2013 of December 26.

Considering the prioritization of the applications set out in paragraph 6 of the fourth additional provision of Royal Decree 413/2014 of 6 June, according to the following criteria:

1. º The compliance with paragraph 1.a) of the fourth additional provision of Royal Decree 413/2014, of June 6.

2. º The compliance with paragraph 1.a), with the exception of the requirements of Article 4.3 of Royal Decree-Law 6/2009 of 30 April 2009 and the fulfilment of paragraph 1.b) of the fourth additional provision of Royal Decree 413/2014, of 6 of June.

3. º The compliance with paragraph 1.b) of the fourth additional provision of Royal Decree 413/2014, of 6 June.

Whereas as a result of the application of the criteria for prioritisation, in the event of equality of several applications which will result in the anticipated quota being exceeded, a single one of these criteria will be established prioritization according to the date of administrative authorization, in the case of the criterion of prioritization 1. º, and of the date of authorization of definitive exploitation for the criterion of prioritization 2. º and 3. º, as provided in paragraph 6 of the provision Fourth, Royal Decree 413/2014, of 6 June.

Whereas, as provided for in paragraph 6 of the fourth additional provision of Royal Decree 413/2014 of 6 June 2014, the coverage of the 120 MW power quota shall be made by default, i.e. the first application which is not The estimate will be that, for which, its consideration would be to exceed the expected quota.

This Directorate-General, by virtue of the powers conferred upon it by the legislation in force, resolves:

1. To register, in the register of specific remuneration in the pre-allocation state regulated in Royal Decree 413/2014, of 6 June, the installations or projects of installations listed in Annex I to this resolution.

2. Declare not registered, in the register of specific remuneration in the pre-allocation state governed by Royal Decree 413/2014, of 6 June, to the installations or projects of installations listed in Annex II to this Regulation resolution.

3. To declare inadmissible applications for registration in the register of specific remuneration in the pre-allocation state dealt with under the provisions of the fourth Royal Decree 413/2014, of 6 June 2014, of the installations or projects of installations listed in Annex III to this resolution.

As provided for in paragraph 7 of the fourth additional provision of Royal Decree 413/2014 of 6 June 2014, this resolution will be published in the Official Gazette of the State.

Against this resolution, it is possible to bring an appeal before the Secretary of State for Energy, within one month of publication in the Official Gazette of the State, in accordance with the provisions of Law 30/1992, On 26 November, the Legal Regime of the Public Administrations and the Common Administrative Procedure, as amended by Law 4/1999 of 13 January, and Article 14.7 of Law 6/1997 of 14 April, of the Organization and the Functioning of the General Administration of the State.

-Do not fall within the criteria of prioritization 1. º and 2. º, having not submitted application for registration in the Register of preallocation of remuneration under the provisions of article 4 of the Royal Decree-Law 6/2009, 30 April, with the date of entry into the Register of the Ministry of Industry, Energy and Tourism prior to the entry into force of Royal Decree-Law 1/2012 of 27 January, as provided for in paragraph 1.a) of the Additional 4th of the Royal Decree 413/2014 of 6 June.

-Entran within the prioritization criterion 3. º, but they have definitive operating authorization, or in their case of a completed Low Tension Certificate, dated back to the last request that falls within the Expected quota.
