Article 20.1 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data and Article 52 of Royal Decree 1720/2007 of 21 November, on the adoption of the Law on the Development of Law Organic 15/1999, of 13 December, on the Protection of Personal Data, requires that the creation, modification or deletion of the files of public administrations be made by means of a general provision published in the "Official Gazette". of the State " or the official journal concerned.

At the beginning of 2014, the Royal Decree 19/2014, of 17 January, was approved, by which the autonomous bodies National Institute of Consumption and the Spanish Agency for Food Safety and Nutrition are recast in a new autonomous body called the Spanish Agency for Consumption, Food Security and Nutrition and its status is approved.

This assumes that the Spanish Agency for Consumption, Food Security and Nutrition (AECOSAN) assumes, as provided for in Article 3 of Royal Decree 19/2014, of 17 January, the functions that previously corresponded to the bodies recast in the areas of consumption, food security and nutrition.

Consequently, in order to comply with the mandate of the Organic Law 15/1999, of December 13, and to assure the citizens of the exercise of their legitimate rights, we proceed to the regulation of the files corresponding to the new Spanish Agency for Consumption, Food Safety and Nutrition, while repealing resolutions regulating the files of personal data relating to the autonomous agency Agencia Española de Seguridad Alimentaria y Nutrition.

Also, and given that the personal data files for the National Consumer Institute had been created or modified by their inclusion in different ministerial orders of the Ministry of Health, Social Services and Equality, the deletion of these files has been carried out through a standard of the same normative range, passing those files to be incorporated, as files of the AECOSAN, in this resolution.

In its virtue, and in exercise of the privileges conferred on me by article 15 of the statute of the AECOSAN, approved by Royal Decree 19/2014, of 17 January, approving the Statute of the Spanish Agency for Consumption, Food Security and Nutrition, and its status is approved, with the report of the Spanish Agency for Data Protection, available:

First.

The files of the Spanish Agency for Consumption, Food Security and Nutrition will be contained in Annexes I and II of this Resolution, the first of which contains a data file of a health character called Occupational Health and Occupational Risk Prevention and the second the files relating to administrative data.

Second.

Pre-existing personal data files, which are regulated in previous provisions corresponding to the now recused organisms, which are not included in the annexes of this resolution, will be destroyed or deleted.

The person responsible for the files mentioned in the preceding paragraph shall take appropriate measures to delete or destroy them physically, without the possibility of recovery, acting in the same way with the backup copies as can exist in any type of media.

Third.

Following the entry into force of this Resolution, the Resolution of 26 August 2009, of the Spanish Agency for Food Safety and Nutrition, which creates the data files of a personal nature, is hereby repealed. Agency.

Fourth.

The holder of the organ responsible for these files shall adopt the necessary management and organizational measures, ensuring in any case the confidentiality, security and integrity of the data, as well as the conduct of the data. to make effective the guarantees, obligations and rights recognised in the Organic Law 15/1999 of 13 December and in its implementing rules and in Royal Decree 1720/2007 of 21 December, approving the Regulation on the security of automated and non-automated files containing personal data.

Fifth.

This resolution shall enter into force on the day following that of its publication in the "Official State Gazette".
