Likewise, Order IET/2446/2013 of 27 December 2013 establishing the tolls and charges associated with third party access to gas installations and the remuneration of regulated activities established in its article 11, which the Directorate-General for Energy Policy and Mines, on a proposal from the Technical System Manager, and after report of the National Commission of the Markets and the Competition, will determine annually the zones with the possibility of congestion and the capacity to be contracted under the system of interruptibility, depending on the market developments and the zonal needs of the gas system. This Article provides that for these purposes only areas where existing plants are unable to supply the expected demand in circumstances of both normal operation and winter peak demand shall be considered.

The Technical Manager of the System has submitted to the Directorate General of Energy Policy and Mines, by letter dated March 13, 2015, a proposal for the offer of an interruptible toll for the period 1 of October 2015 to September 30, 2016.

The hearing procedure has been evacuated through the Hydrocarbons Advisory Council, which, in accordance with the provisions of the transitional provisions of Royal Decree 657/2013 of 30 August 2013, approving the Organic Statute of the National Commission of the Markets and Competition, continues to exercise its functions until the formation of the Energy Advisory Council. The comments and comments have been taken into consideration for the preparation of the mandatory report which, in accordance with the provisions of Article 7.35 of Law No 3/2013 of 4 June, of the creation of the National Commission of the Markets and the Competition has been evacuated by the Commission, which has approved it in session of its Council.

In its virtue, this General Address resolves:

First. Amendment of the Resolution of 25 July 2006.

1. Article 6 of the resolution of 25 July 2006, of the Directorate-General for Energy Policy and Mines, governing the conditions of allocation and the procedure for the application of the interruption of the gas system, is amended, which is worded as follows:

" The uninterruptible capacity allocation for the period from 1 October 2015 to 30 September 2016 is as follows:

Interruptibility type "A": 5 GWh/day.

This capacity will be distributed in the following zones:

• Red prelittoral 45 bar (Montmelo): 2 GWh/day, due to the saturation of the Serinya-Figueres pipeline and the construction of the north branch of the Martorell-Figueres Pipeline and the Figuere-Figueres pipeline.

• Red de Pamplona: 3 GWh/day, located 2 GWh/day in the vicinity of Egues (G03.02), until the construction of the bridge bridge the Queen-Muruarte de Reta, and 1 GWh/day in the vicinity of Beriain (E05), until the incorporation of the Sansoain-Lumbier replication.

The feasibility of the interruptible toll requests in these networks will be analyzed by the System Technical Manager in collaboration with the affected carriers and distributors, so that the Interruption effectiveness for problem resolution, taking into account the location of each point of consumption.

The Technical Manager of the System will make, before March 15 of each year, a proposal to update the zones with the possibility of congestion and the maximum volume of interruptible gas, for the period from 1 October and September 30, next year, proposed to be approved by Resolution of the Directorate General of Energy Policy and Mines, prior to the report of the National Commission of the Markets and the Competition. "

Second. Applications for the period 2015 -2016.

Without prejudice to the validity of the applications submitted to date, for the period from 1 October 2015 to 30 September 2016, the user may request the application of the interruptible toll for the their points of supply to the holder of the same, until 1 September 2015, including, in accordance with the procedure described in the Resolution of 25 July 2006, governing the conditions of allocation and the procedure for the provision of application of the interruptibility in the gas system.

Third. Input into effect.

This resolution shall take effect from the day following that of its publication.
