Organic Law 2/2006, of 3 May, of Education, points out in Article 2a 4, that the functioning of the Spanish Educational System is governed by the principles of quality, cooperation, equity, freedom of teaching, merit, equality of opportunities, non-discrimination, efficiency in the allocation of public resources, transparency and accountability.

Likewise, the Organic Law 2/2006, of 3 May, states in its article 89 that the Ministry of Education, Culture and Sport, without prejudice to the competences of the Autonomous Communities, may establish, by itself or in collaboration with other entities, awards and competitions of a state nature intended for students, teachers or schools.

In line with the above, the Order EDU/2058/2010 of July 13, for which the National Baccalaureate Awards established by the Organic Law 2/2006, of 3 May, of Education, were published, was published in due time. Order EDU/2128/2011 of 15 July 2011 establishing and regulating the National Professional Training Awards of a higher grade established by the Organic Law 2/2006 of 3 May of Education in order to determine the requirements of participation in such awards.

The Ministry of Education, Culture and Sport, within its objective of improving educational quality and increasing the performance of students, now wishes to extend its recognition to the effort and merit of those students and students. who have distinguished themselves in their studies at the end of the stage of compulsory secondary education, understanding that this must be used to recognize the effort and dedication of the students who have completed these studies and to encourage them to Continuation of the same.

Also, taking into account the similarities that, in terms of the academic level, organization in cycles, structure and purpose, establishes the own Organic Law 2/2006, of May 3, between the Professional Art Teachings and the Vocational Training, following the existing model for the latter, it is considered necessary to establish also for the first official recognition for those students and students who have completed them with an excellent performance.

For this reason, in the calls of the National Education Awards in non-university education for the years 2013 and 2014, within the academic performance category of the students, two were included. new modalities: the National Compulsory Secondary Education Awards and the National Professional Arts Awards.

Realized already these calls and analyzed their development, it becomes necessary, in order to improve the processing of the procedures, to publish a order of bases that will regulate from now on the requirements that will be necessary gather to participate in such awards.

In the elaboration of this order the Autonomous Communities have been consulted within the Sectoral Conference of Education, and the Higher Council of Arts Teachings.

Therefore, with the prior approval of the Minister of Finance and Public Administrations, I have:

CHAPTER I

General provisions

Article 1. Object.

This order aims to regulate the National Awards for the academic performance of students and students in the modalities of compulsory secondary education and professional artistic teachings in the fields of education. Music, of Dance and of Plastic Arts and Design, as recognition of the special use of the students who have submitted these teachings in accordance with the provisions of the Organic Law 2/2006, of May 3, of Education.

Article 2. Calls.

1. The Ministry of Education, Culture and Sport may convene and annually award 15 National Compulsory Secondary Education Awards and 15 National Professional Arts Teaching Awards under competitive competition and advertising.

2. The National Awards in the form of Professional Art Teachings will, in turn, comprise the following areas:

a) Music.

b) Dance.

c) Plastic Arts and Design.

Of the total of the awards will be awarded six prizes for the field A: Music, three awards for the scope B: Dance and six prizes for the field C: Plastic Arts and Design.

3. The annual calls will be governed by the provisions of Law 38/2003 of 17 November, General of Grants, and in the Regulation of that Law, approved by Royal Decree 887/2006, of July 21.

The deadline for submitting applications will be fixed at each call. In any event, the time limit laid down in Article 3 of this order shall be initiated for the communication of the students selected by the educational administrations to participate in each of the modalities of the Awards and will conclude before the completion of the corresponding calendar year.

The National Awards will have an economic envelope, the individual amount of which will be fixed in the corresponding annual call based on the credit previously assigned to the effect in the department's expenditure budget. for the corresponding year and in correlation with the other prizes called by the Ministry of Education, Culture and Sport.

Article 3. Alumni communication selected to participate in the National Awards.

1. The educational authorities shall send to the Directorate-General for Evaluation and Territorial Cooperation of the Ministry of Education, Culture and Sport, before 15 October each year, the relationship of the student who has obtained an Extraordinary Prize. Compulsory Secondary Education and has been selected by its Educational Administration to participate in the National Awards, indicating the First Foreign Language and in its case the option of Mathematics.

2. They shall also send, before 15 November each year, the relationship of the student who has obtained an Extraordinary Prize for Professional Artistic Teachings in the fields of Music, Dance and Plastic Arts and Design, and has been selected by its Educational Administration to participate in the National Awards of the relevant field, indicating the teachings.

3. The number of selected for each Educational Administration must be set within the following limits:

(a) for the compulsory secondary education modality: one for each 1750, or a fraction exceeding 500, enrolled in the fourth course in the academic year to which the call is concerned,

b) for the modality of Professional Art Teachings: one for each specialty or professional family.

Article 4. Procedure.

1. The Directorate-General for Evaluation and Territorial Cooperation is responsible for the management and instruction of the procedure.

2. It is up to the Ministry of Education, Vocational Training and Universities of the Ministry of Education, Culture and Sport to resolve the procedure.

3. The Advisory Councils of Education of the Autonomous Communities, the Provincial Directorates of Ceuta and Melilla, the Ministry of Education, Culture and Sport and the CIDEAD, will facilitate the students all the information relating to the call.

4. Students and students who, having obtained an Extraordinary Prize, have been selected by their educational administration to participate in the National Awards of the corresponding modality, and wish to take part in the call they shall submit the corresponding application, addressed to the holder of the Directorate-General for Regional Evaluation and Cooperation, and may make such a presentation in the places referred to in Article 38.4 of Law 30/1992, of 26 November, the Legal Regime of Public Administrations and the Procedure Common Administrative, or by electronic means at the headquarters of the Department. For these purposes, the records of the educational institutions are not considered to be dependencies of those listed in Article 38.4 of Law 30/1992, of November 26.

5. For the examination and assessment of the files relating to the compulsory secondary education system, a selection jury shall be set up, to be appointed by the Director-General for Territorial Cooperation and Evaluation and shall be composed of: by a president and a secretary, who shall be officials of the Directorate-General for Evaluation and Territorial Cooperation, and a maximum of six members. The latter shall be education inspectors, professors or teachers belonging to the respective bodies of the Catholic or secondary education teachers, specialists in the subject matter of the tests, and professionals of the prestige in the field of education.

For the examination and evaluation of the files corresponding to each of the fields of the modality of Professional Art Teachings will be constituted a jury of selection, that will be appointed by the Director General of Territorial evaluation and cooperation shall be composed of a president and a secretary, who shall be officials of the Directorate-General for Evaluation and Territorial Cooperation, and a maximum of six members, one of whom shall be the Deputy Director General. The other vowels will be teachers or specialists in the corresponding scopes.

Such juries shall assume the functions assigned to the collegiate body referred to in Article 22.1 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Administrative Procedure Common. Its composition shall, wherever possible, respect the composition of the Joint Assembly in accordance with the provisions of Order PRE/525/2005 of 7 March, which gives publicity to the Agreement of the Council of Ministers adopting measures to promote equality between women and men and may be assisted by a committee of experts for the prior assessment of applications submitted.

6. The assessment of the dossiers shall be carried out in a single stage and shall be carried out taking into account the score given to the participants in accordance with the assessment criteria set out in the call and, where appropriate, the results obtained from the specific tests carried out for that purpose.

7. The instructor shall submit a motion for a resolution to the resolver, in the light of the report issued by the selection panel; the motion for a resolution may propose the declaration "desert".

Article 5. Award annotation in the academic record and history.

Obtaining the National Award for Compulsory Secondary Education or Professional Artistic Teaching will be noted, by means of diligence performed by the Secretary of the teaching center, in the academic record and in the academic history of the pupil or pupil.

CHAPTER II

National Awards for the Academic Performance of the Compulsory Secondary Education Student

Article 6. Candidate requirements.

May be eligible for the National Compulsory Secondary Education Awards, the student who has previously obtained the Extraordinary Award for Compulsory Secondary Education in the field of management of the Ministry of Education, Culture and Sport or the Autonomous Community in which these teachings have been completed, or any other prize which, under another name, may be called by the different educational administrations in order to recognise the academic performance of the pupils and pupils of this stage (which will henceforth be understood to be included within the general name of Extraordinary Awards), and which also meets the following requirements:

(a) To have completed all compulsory secondary education in Spanish teaching centres, either in person or in a distance in any of the options set out in the framework of the Organic Law 2/2006, of 3 May.

b) Having completed these studies in the academic year referred to in the call.

(c) There has been a total of 8.75 points in all four of the compulsory secondary education courses. The average note shall be the arithmetic mean of the qualifications of all the subjects of the four courses of compulsory secondary education, rounded up to the nearest hundredth and in case of equidistance to the higher one. The ratings of 'fit', 'exempt' or 'validated' shall not be taken into account in that calculation.

(d) Having obtained a final qualification of "outstanding" in the last course of compulsory secondary education, in the subjects covered by the test referred to in Article 7 of this order.

e) You have been selected by your Educational Administration to participate in the National Awards.

Article 7. Tests.

1. The Directorate-General for Evaluation and Territorial Cooperation shall draw up and transmit to the Autonomous Communities, Provincial Directorates of the Ministry of Education, Culture and Sport, Foreign Education Councils, and CIDEAD, both the instructions required for the development of the tests, such as the content of the tests.

2. The Autonomous Communities, Provincial Directorates, Foreign Education Counselors and CIDEAD will call upon the students to carry out the tests in good time, providing them with the appropriate information for the testing, as well as the place and time at which the tests will be held.

3. The tests, which shall in any case take as a reference the curricular elements laid down in the current regulations, shall consist of three exercises:

(a) The first exercise shall cover aspects which enable the degree of acquisition of linguistic communication competence to be verified in relation to the language of the Spanish language and literature, and shall consist of an analysis and critical comment of a text in the Spanish language and answers to questions of linguistic or literary content that arise.

(b) The second exercise shall relate to aspects which permit the verification of the degree of acquisition of mathematical competence in relation to the subject matter of Mathematics, or in its case Mathematics Oriented to Academic Teachings or Mathematics Oriented to the Teachings Applied according to the option pursued by the student or student, and will consist in the answer to questions and/or resolution of practical exercises and/or resolution of problems on the contents of the material.

c) The third financial year shall cover aspects to verify the degree of acquisition of linguistic competence in relation to the First Foreign Language, and shall consist of the carrying out of tasks of understanding and written expression on a text of a cultural, literary or divulgative character.

Article 8. Testing criteria for the tests.

The assessment of the tests will, among other specific criteria for each of the exercises that compose them, to the following: the correction of the answers, the clarity and quality of the exhibition, the structuring of the exercise, vocabulary property, punctuation, and spelling.

CHAPTER III

National Awards for Professional Art Teachings in the fields of Music, Dance and Plastic Arts and Design

Article 9. Candidate requirements.

You will be eligible for the National Awards for Professional Artistic Teachings the students who have previously obtained Extraordinary Prize for Professional Artistic Teachings in the field of direct management of the Ministry of Education, Culture and Sport or the Autonomous Community in which the teachings have been completed, and which, in addition, meets the following requirements:

a) Scope A: Music:

1. º Haber completed the Professional Teachings of Music in the academic year of the convocation in Spanish teaching centers.

2. º Haber obtained an average note equal to or greater than 8.75 in the last two courses of the Professional Teachings of Music. For these purposes the validated subjects shall not be taken into account. In the event that the pupil or pupil has entered the sixth course, the average note shall be referred to only the subjects of that course.

3. º Haber was selected by his Educational Administration to participate in the National Awards.

b) Scope B: Dance:

1. º Haber completed the Professional Dance Teachings in the academic year of the convocation in Spanish teaching centers.

2. º Haber obtained an average note equal to or greater than 8.75 in the last two courses of the Professional Dance Teachings. For these purposes the validated subjects shall not be taken into account. In the event that the pupil or pupil has entered the sixth course, the average note shall be referred to only the subjects of that course.

3. º Haber was selected by his Educational Administration to participate in the National Awards.

c) Scope C: Plastic Arts and Design:

1. º Haber completed a formative cycle of higher degree of plastic arts and design in the academic course of the convocation, in Spanish teaching centers.

2. º Haber obtained an average final note equal to or greater than 8.75 in the higher grade level of Plastic Arts and Design.

3. º Haber was selected by his Educational Administration to participate in the National Awards.

Article 10. Assessment criteria.

The jury appointed to this effect will carry out the assessment of the files submitted, taking into account, among other specific criteria established for each call, the following: technical level, artistic quality and quality execution.

Single additional disposition. Legal regime.

For all those extremes not provided for in this order, Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, and any other provision shall apply. rules which by its nature may be applicable.

Single transient arrangement. Transitional period.

This order shall not apply to the procedures governed by the calls approved prior to its entry into force. The deadline set out in Article 3.1 shall be extended for the convening of the Extraordinary Awards in the modalities referred to in this order for the 2014-2015 course until 15 November 2015.

Until the 2016-2017 school year, in which, in accordance with paragraph 2 of the fifth final provision of the Organic Law 8/2013, of 9 December, for the improvement of educational quality, the implementation of the amendments to the curriculum, organisation, objectives, requirements for obtaining certificates and certificates, programmes, promotion and evaluations of compulsory secondary education, the distinction of options shall not be taken into account intended for that stage referred to in Article 6 (a) of this order.

Similarly, until that date, the second exercise of the evidence referred to in Article 7 shall consist of the answer to questions and/or resolution of practical exercises within the subject of Mathematics submitted by the pupil or pupil.

Final disposition first. Competence title.

This Order is dictated by the provisions of Article 149.1.30. of the Constitution which attributes to the State the competence for the establishment of the basic norms for the development of Article 27 of the Constitution, in order to ensure compliance with the obligations of the public authorities in this field.

Final disposition second. Development.

The head of the Secretary of State for Education, Vocational Training and Universities is empowered to dictate how many provisions will require the application of the provisions of this order.

Final disposition third. Entry into force.

This Order shall enter into force from the day following that of its publication in the "Official State Gazette".
