Royal Decree 1434/2010 of 5 November 2010 on the interoperability of the rail system of the general interest railway network incorporates into national law Directive 2008 /57/EC of the European Parliament and of the Council of 17 June 2008, on the interoperability of the rail system within the Community. That Directive 2008 /57/EC lays down the conditions to be fulfilled for the interoperability of the rail system in the Community territory.

The need to define the gauges to consider, both for the construction of vehicles, the placement of elements close to the road, as well as the cargo in open wagons is fundamental in order to guarantee the safety of the Railway traffic, avoiding interferences between vehicles, and of these vehicles with the infrastructure and materializes the need in the Instruction that is approved by this order.

The instruction set out in the Annex has been drawn up in line with the standard of gauges EN 15273:2013 and respects the technical specifications for interoperability of the infrastructure, rolling stock and energy subsystems Trans-European conventional and high-speed rail systems.

This Order has been subject to the formalities laid down in Royal Decree 1337/1999 of 31 July, which regulates the referral of information in the field of technical standards and regulations and regulations relating to the services of the information society, which incorporates Directive 98 /34/EC of the European Parliament and of the Council of 22 June, as amended by Directive 98 /48/EC, of the European Parliament and of the Council, of 20 June 2002, to the Spanish legal system The Commission has decided to initiate the procedure for the provision of information in the field of standards and regulations. techniques.

The Order has been dealt with in accordance with the provisions of Article 15 of the Railway Sector Regulations, approved by Royal Decree 2387/2004 of 30 December 2004, which authorizes the Minister of Public Works to approve the rules and regulations. instructions governing the basic or construction projects of the railway infrastructure and those to which the works and construction works of the railway infrastructure are to be subjected.

In its virtue, at the initiative of the State Agency for Railway Safety, on the proposal of the Secretary General of Infrastructures and with the agreement of the Secretary of State for Infrastructures, Transport and Housing, I have:

The provisions in this Order will not apply to:

1. Projects for the new construction of railway infrastructure or for the upgrading of existing ones, the corresponding order of which would have been issued before the entry into force of this order.

2. The works to be carried out in the development of the projects referred to in the previous point.

The State Railway Safety Agency is empowered to issue any instructions necessary for the application and interpretation of this Order.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
