Article 20 of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, states that the creation, modification or deletion of the automated files of public administrations may only be be made by means of a general provision published in the Official Journal of the State or the official journal concerned.

Personal data files managed by the Ministry of Agriculture, Food and the Environment are listed in Order ARM/1683/2011 of 2 June, which regulates the files with character data Staff of the Ministry of Environment, Rural and Marine Affairs.

Digital media has become a mechanism of service to citizens that allows its continued operation, in 24 × 7 mode, and in mobility, from any location. In addition, transparency and open government are also enhanced. Part of these services involve the sending of documentation, newsletters, subscription services of notices or alerts, and consequently require the identification of the citizens, for which a minimum of collection and registration through the first name, national identity card and e-mail address.

This order is issued pursuant to Article 20 of Organic Law 15/1999 of December 13.

In its virtue, prior to the report of the Spanish Data Protection Agency and the Ministry of Agriculture, Food and Environment's Ministerial Committee on Electronic Administration, I have:

Single item. Amendment of the Order ARM/1683/2011 of 2 June, regulating the files with personal data of the Ministry of Environment, Rural and Marine Environment.

In accordance with the provisions of Article 20 of Organic Law 15/1999 of 13 December on the Protection of Personal Data, and for the purposes specified therein, the following file should be included in Annex I, Order ARM/1683/2011, of 2 June, for which the files are regulated with personal data of the Ministry of Environment, Rural and Marine, being responsible the Directorate General of Services:

a) Identification and use of the file:

a.1) Identification of the file: Users of identified services of portals and social networks.

a.2) Purpose and intended uses: Monitoring of digital services of the MAGRAMA: alerts, periodic bulletins, promotion of events, warnings and attention to the citizen, contribution in public information processes, professional networks, social networks, complaints and suggestions, electronic headquarters, telematic registration, etc.

a.3) Purposes of purposes: Digital public service; horizontal communication with citizens through new channels for promotion, creation of networks of interest, attention to the citizen, entry of files (application, registration, state consultation, etc.). In addition historical, statistical and/or scientific purposes.

b) Data source:

b.1) Persons or collectives who require information and provide personal data or are obliged to supply them: Citizens interested in the thematic information of the MAGRAMA, companies in the sector and their representatives.

b.2) Provenance: The data comes from the data subject himself and/or his legal representative.

c) Collection procedure: Data provided on the website by the person concerned or his/her representative: documentary, face-to-face and automated.

d) Basic file structure and treatment system used in your organization:

d.1) Structure: Identificative data: Name or social reason, DNI/NIF/ID, name, telephone, electronic addresses (mail, network users, etc.), areas of interest, representation data or organization that represents. Other data related to the rights and services requested.

Other personal data categories: Social circumstances (properties, authorities) and other data (goods and services received by the affected).

d.2) Treatment system: Automatic.

e) Communications for expected data:

e.1) Recipients or categories of recipients: attention or internal processing organs of registered requests.

e.2) International transfers to third countries: There are no plans.

f) Body responsible for the file: General Services Directorate.

g) Services or units to which the rights of access, rectification, cancellation and opposition may be exercised: Directorate General of Services of the Ministry of Agriculture, Food and Environment, Paseo Infanta Isabel, Number 1, 28014 Madrid.

h) Security measures as set out in Title VIII RLOPD: Basic Level.

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
