Order DEF/3594/2003, of 10 December, approving the rules for the processing and the ordinary concession of the Cruces of Military, Naval and Aeronautical Merit, with a white flag, and of the Honorific Holds, the delegation of powers in this field, and the use of the representative decorations of the rewards, was dictated in development and execution of the provisions in the additional provision second of the general regulation of military rewards, approved by Royal Decree 1040/2003 of 1 August, which states that the Minister of Defence determine the rules for the processing and the ordinary concession of the Military, Naval and Aeronautical Merit Cruces, with a white flag, granted as Grand Cross or as Cross, and of the Honorific Mention, as well as its limitations; and in the a single final provision, which provides that it shall adopt all provisions and measures necessary for the development and implementation of the provisions of this Regulation.

The length of time since the entry into force of Order DEF/3594/2003 of 10 December 2003 has shown the need for the authorities with delegated powers to have uniform criteria for implementation in the the cases which are determined, ensuring consistency and proportionality in the presentation of the initial proposals for granting, in addition to systematising and completing the regulation of the legal system applicable to the rewards military.

During its processing, this provision was informed by professional associations with representation in the Staff Council of the Armed Forces, in accordance with Article 40.2.b) of the Organic Law 9/2011, of 27 July, rights and duties of the members of the Armed Forces, and the rest of the professional associations registered in the Register of Professional Associations of members of the Armed Forces have been informed in accordance with Article 40.1.c) of the Organic Law 9/2011 of 27 July. Finally, according to the provisions of article 49.1 (c) of the aforementioned organic law, it has been informed by the Armed Forces Staff Council.

In its virtue, I have:

Single item. Amendment of Order DEF/3594/2003 of 10 December 2003 approving the rules for the processing and the ordinary concession of the Military, Naval and Aeronautical Merit Cruces, with a white flag, and the Honorific Holds, the delegation of competences in this field, and the use of the representative decorations of the rewards.

Order of 10 December 2003 of 10 December 2003 amending the Order of 10 December 2003, approving the rules for the processing and the ordinary concession of the Military, Naval and Aeronautical Merit Cruces, with a white flag, and of the Mentions honorific, the delegation of competences in this field, and the use of the representative decorations of the rewards, in the following sense:

One. Seven new paragraphs, 4, 5, 6, 7, 8, 9 and 10 are added to the first chapter of Chapter I with the following content:

" 4. In each call, of the two annual, the competent authorities will be able to grant Cruces of the Military Merit, of the Naval Merit and of the Aeronautical Merit, with distinctive white, like Cruz, to the military and civilian personnel destined to the Ministry of Defense and the Armed Forces, in the following maximum percentages:

(a) For military personnel, 2.5 percent of the personnel in each category of officer, noncommissioned officer, and troop and marine personnel.

b) For civilian personnel, 1.5 percent of this personnel.

5. After the completion of the case by accumulation of three Honorific Holds, the competent authorities shall determine the Military, Naval or Aeronautical Merit Cross that is granted by applying the criteria in accordance with the order of preference. next:

a) Army of military membership.

b) Army where it is intended.

c) Army in which the largest number of honorific Mholds were received.

d) Army where the last honorific Mention was granted.

e) Criterion of the Head of the Unit, Centre or body of destination.

6. In each call, of the two annual meetings, the competent authorities will be able to grant Honorific Mentions to the military and civilian personnel assigned to the Ministry of Defense and the Armed Forces, at the following maximum percentages:

(a) For military personnel, 1 percent of the officers in each of the categories of officer, noncommissioned officer, and troop and marine personnel.

b) For civilian personnel, 0.60 percent of this staff.

7. For the calculation of the number of concessions from the Military, Naval and Aeronautical Merit Cruces, with white flag, and honorific holds, according to the corresponding maximum percentage, the existing personnel will be taken as a reference of January, for the proclamation of Her Majesty The King, and first of the month of September, for the Military Passover, of the current year.

8. The personnel of the Civil Guard Corps assigned to the Ministry of Defense and the Armed Forces will be counted within the maximum percentages of the military personnel, in their respective categories.

9. In each call, of the two annual meetings, with respect to the personnel of the Civil Guard Corps assigned in its field, the Director General of the Civil Guard will present to the Assistant Secretary of Defense the proposal for military rewards of the Cruces del Military merit and Honorific Mentions, with a maximum percentage of 0.5 percent of the personnel of each of the categories of officer, noncommissioned officer, cabs and guards.

10. In each of the calls, of the two annual calls, the competent authorities will raise to the Assistant Secretary of Defense the proposals for the granting of Cruces of Military Merit, of the Naval Merit and of the Aeronautical Merit, with white distinctive, like Cruz, to the following civilian, military, and State Security Corps personnel, in the following maximum amounts:

(a) For civilian personnel serving the Public Administrations outside the Ministry of Defense, as well as for other Spanish nationals, five (5).

b) For foreign military and civilian personnel, three (3).

(c) For military personnel destined outside the competence of these authorities, 15 (15).

d) For Civil Guard Corps personnel, ten (10).

e) For National Police Corps personnel, four (4). "

Two. Paragraph 1 of the fourth rule is worded as follows:

" 1. The ordinary concession of the Cruces of Military Merit, of the Naval Merit or of the Aeronautical Merit, with a white flag, like Grand Cross or as Cross, and of the Honorific Mentions, will be carried out twice a year, these calls will be able coincide with the anniversary of the proclamation of Her Majesty The King or with the Military Passover. "

Single end disposition. Entry into force.

This ministerial order shall enter into force on the day following that of its publication in the "Official State Gazette".
