Order APA/2361/2005, of 8 July, establishes the regulatory bases for the granting of subsidies to entities, companies and professionals, related to the production and marketing in the agricultural sector that facilitate the Department information on statistics and agricultural prices; in accordance with the provisions of Law 38/2003 of 17 November, General of Grants.

Article 6 sets out the objective criteria for granting potential beneficiaries. It is considered necessary to introduce new criteria to ensure that the discretion in granting them is reduced to the maximum.

This order is dictated by the provisions of Article 149.1.31. of the Constitution, which exclusively reserves the State's competence in the field of statistics for state purposes.

In its processing, it has been submitted to the representative entities of the sectors concerned. The State Attorney and the Delegation in the Department have also issued a report in compliance with the provisions of Article 17 of Law 38/2003 of 17 November.

In its virtue, I have:

Article 6 of Order APA/2361/2005 of 8 July 2005 laying down the regulatory bases for the granting of subsidies to entities, companies and professionals related to production and marketing in the agricultural sector, which provides statistical and agricultural price data, is amended as follows:

" Article 6. Objective requirements and criteria for granting grants.

1. Applications submitted shall meet the following requirements:

(a) The supply of information shall be subject to at least one of the requests for information contained in the relevant call, which shall at least express the territorial distribution of the maximum number of beneficiaries by sector and autonomous community, which will be determined in the context of the information supply needs specified in the National Statistical Plan.

(b) The information supply characteristics will also be determined in the relevant call: periodicity supply, information variables, quantity marketed, price, market comments, and commercial position, for each sector/autonomous community binomial.

c) The information to be provided in no case may be available through the Ministry of Agriculture, Food and Environment's own networks.

2. Applications shall be valued within each individual sector/autonomous community, in accordance with the following criteria, applied in a successive and proportional manner:

(a) According to the number of products or typologies; variable according to the classifications established in each sector and shown in the corresponding call. The products or typologies shall respond to the need for data collection derived from regulatory mandates or from the national interest of the respective statistics.

b) According to the marketing volume of the product or typology represented by the applicant in the reference autonomous community.

3. Within each binomial sector/Autonomous Community, the number of proposals contained in the corresponding call will be selected at the most, resulting in the remainder of the proposals being rejected and all proposals being accepted in case of number is higher.

The number of proposals in each autonomous community/sector binomial that is on each call may not exceed 20.

The total number of proposals listed on each call may not exceed 200.

4. The calculation of the amount of grants shall be carried out in accordance with the following procedure

(a) Given that the difficulty and detail to collect the requested data differ according to sectors, the calculation of the grant will be made from the Modulos detailed in the corresponding call.

b) Each selected request will be assigned the corresponding module amount.

(c) The amount of the grant to be awarded to each beneficiary shall be the sum of the amounts allocated in the modules for the sectors for which it has been selected.

d) This total amount may not exceed the maximum referred to in the call. "

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
