Article 54.1 of Law 39/2007 of 19 November of the military career empowers the Minister of Defence to lay down general rules governing, among other matters, the organisation and functions of teachers ' centres. military.

The Government of Spain has set in motion an important and ambitious program of reforms among whose axes are measures of administrative rationalization, simplification and elimination of duplicities and bureaucratic obstacles. And the Commission for the Reform of Public Administrations (CORA), created by the Council of Ministers Agreement of 26 October 2012, has carried out an intense work of comprehensive review of the Public Administration, aimed at achieving an improvement in the effectiveness and efficiency of public activity.

In this line, the Defense Policy Directive of October 2012 establishes, among its aims, the simplification of the organization of the Armed Forces and the rationalization of the existing organic structures in the Ministry of Defense.

Likewise, the additional provision of Royal Decree 524/2014, of 20 June, amending Royal Decree 454/2012 of 5 March, for the development of the basic organic structure of the Ministry of Defence, in its paragraph 1, establishes the creation of the Central Academy of Defense, as a military training center, and in paragraph 3, that " the Minister of Defense will determine the internal structure and functions of this military academy in which he is integrate the Military School of Legal Studies, the Military School of Intervention, the Military School of Health, the School of Military Musicians, the Military School of Languages and the Military School of Education Sciences, so that their current denominations and tasks are maintained. "

One of these tasks is to carry out the assessment of linguistic competence in foreign languages considered to be of interest to the Armed Forces. The increasing importance of language proficiency in languages requires that the system of assessment of linguistic competence be continuously improved and developed. For the development of this task, a language competence assessment body shall be established.

In its virtue, I have:

Article 1. Object and scope of application.

The purpose of this ministerial order is to establish the basic organic structure of the Central Academy of Defense, in accordance with the provisions of the additional provision of Royal Decree 524/2014 of 20 June 2014, which amend Royal Decree 454/2012 of 5 March, for which the basic organic structure of the Ministry of Defence is developed.

Article 2. Dependence and functions.

1. The Central Academy of Defense, as established by the additional provision of Royal Decree 524/2014, of June 20, is a military training center for training, which depends on the General Subdirectorate of Military Teaching.

2. The Central Academy of Defense is entrusted with the following tasks:

a) Imparting the education of the formation of the common bodies of the Armed Forces.

(b) Imparting the teaching of the common bodies of the Armed Forces and those related to the pedagogical qualification, the evaluation of the military education system, the languages and the determine the Minister of Defense.

c) Evaluate language proficiency in foreign languages considered to be of interest to the Armed Forces.

Article 3. Structure of the Central Academy of Defense.

The Central Academy of Defense is structured as follows:

a) Address.

b) Subdirection.

c) University Center of Defense.

d) Military School of Legal Studies.

e) Military School of Intervention.

f) Military School of Health.

g) School of Military Musicians.

h) Military Language School.

i) Military School of Education Sciences.

j) Department of Instruction and Training.

k) Support Services Unit.

l) Economic Management Service.

Article 4. Address.

1. The Director of the Central Academy of Defense shall be the Deputy Director General of Military Education.

2. The Director of the Central Academy of Defense, as the ultimate authority of the center, is responsible for exercising command, management and government of the institution; and for its representation.

Article 5. Subdirection.

1. The Deputy Director of the Central Academy of Defense has the following functions:

(a) In the absence of the Director, as well as in those cases determined by the Director, he shall exercise command, direction and government of the Centre; and shall be represented.

b) Coordinate the tasks that are carried out by the directors of schools or departments, which will be functionally dependent on the deputy director, as determined by the Director of the Central Academy of Defense, without prejudice to the provisions of Article 7.1.

2. For the purpose of fulfilling the functions of paragraph 1 above, it shall have an auxiliary organ.

Article 6. University of Defense Center.

1. Her ownership corresponds to the Ministry of Defense, which exercises her through the Assistant Secretary of Defense, pursuant to article 51.1 of Law 39/2007, of 19 November, of the military career.

2. The University Center of Defense will be governed, among other norms, by the Convention of the Adscription between the Ministry of Defense and the University of Alcala, signed on May 31, 2012, and by its own rules of organization and operation, with Article 11.3 of the Organic Law 6/2001, of 21 December, of Universities.

Article 7. Structure by academic departments.

1. The Central Academy of Defense, adopts an academic organization, which is articulated in the following departments: the Military School of Legal Studies, the Military School of Intervention, the Military School of Health, the School of Music Military, the Military School of Languages, the Military School of Education Sciences and the Department of Instruction and Training. These are integrated into the Central Academy of Defense. In the case of schools of common bodies of the Armed Forces, they will have the competences related to the technical training corresponding to their respective bodies.

2. The Department of Instruction and Training will be the student's polling unit. The Director of the Department of Instruction and Training shall, in the performance of his duties, depend on the Deputy Director.

3. In order to take account of the role of assessing linguistic competence in foreign languages considered to be of interest to the Armed Forces, the Central Academy of Defense may have an organ for the evaluation of linguistic competence, with the competence to manage, coordinate and control assessment teams and review commissions that could be formed for the various language tests.

Article 8. Support Services Unit.

1. To the Support Services Unit, the following functions correspond to:

a) Understand the needs for staff and facilities assistance.

b) Provide security to the Central Academy of Defense.

c) Understanding resource coordination and control.

d) Provide the necessary logistical support for the performance of the functions entrusted to the Central Academy of Defense.

2. The Head of the Support Services Unit shall, in the performance of his/her duties, depend on the Deputy Director.

Article 9. Economic Administration Service.

1. The Economic Management Service is responsible for the administration, coordination and control of economic resources.

2. The Head of the Economic Management Service shall, in the performance of his duties, depend on the Deputy Director.

Additional disposition first. No increase in public or template expenditure.

The implementation and development of this ministerial order will be carried out without any increase in the cost of operation and will not increase public or personal expenditure.

Additional provision second. Staff scheme.

1. The staff of the Military Posts Relationship and numerical tables of the schools that composed the Group of Defense Schools and the Support Services Unit, are assigned to the Central Academy of Defense.

2. The Assistant Secretary of Defense will determine the Relationship of Military Posts and numerical tables, and the corresponding organic adaptations will be made to the posts.

Additional provision third. Department of Instruction and Training.

1. The Department of Education and Training of the Military School of Health is the Department of Instruction and Training of the Central Academy of Defense.

2. The units to be determined, in which the students will be surveyed, will be responsible.

3. The Director of the Department of Instruction and Training, as head of the student survey unit, will have the sanctioning competence attributed to the heads of units of the battalion or similar entity, according to the Articles 32.5 and 33 of Organic Law 8/2014, of 4 December, of Disciplinary Regime of the Armed Forces, under the authority of the Director of the Central Academy of Defense.

First transient disposition. Rules on the organisation and functions of the Teaching Centres in the Military Training Teaching.

The Central Academy of Defense shall comply with the provisions of the Standards on the Organization and the Functions of the Teaching Centers of Military Education, approved by Order 80/1993, of July 29, until they enter into force. In force the General Rules governing the organisation and functions, the internal regime and the programming of military teaching centres, to be determined by the order of the Minister of Defence, laid down in Article 54.1 of Law 39/2007, of 19 November, of the military race.

Second transient disposition. Functions of the Military School of Education Sciences.

The functions of the Military School of Education Sciences established in the second section of the Ministerial Order 89/1992, of 24 November, which regulates the denomination, affiliation and functioning of the School Military of Science of Education, will remain in force until the provisions that complement or apply this ministerial order come into force, the necessary organic adaptations are produced and these functions are transferred to the new ones units and structures.

Transitional provision third. Functions of the Military Language School.

The functions of the Military School of Languages set out in the third paragraph of Order DEF/538/2003 of 4 March, establishing the structure and functions of the Military School of Languages, will remain in force until The provisions supplementing or implementing this ministerial order shall enter into force, the necessary organic adaptations shall be made and those functions transferred to the new units and structures.

Single repeal provision. Regulatory repeal.

1. The following provisions are repealed:

(a) Ministerial Order 89/1992, of 24 November, regulating the denomination, membership and functioning of the Military School of Education Sciences.

b) Ministerial Order 193/2000 of 6 July, creating the Support Services Unit for the Defence Schools Group.

c) Order DEF/538/2003 of 4 March establishing the structure and functions of the Military School of Languages.

2. In addition, any other provision of equal or lower rank which is opposed to the provisions of this ministerial order is hereby repealed.

Final disposition first. Enforcement powers.

The Deputy Secretary of Defense is empowered to make any necessary provisions for the implementation of this ministerial order and, in particular, for the constitution, on a proposal from the Director General of Recruitment and Military education, of the departments or administrative units deemed appropriate.

Final disposition second. Entry into force.

This ministerial order shall enter into force on the day following that of its publication in the "Official State Gazette".
