This amendment includes the technical transposition of the measures in the field of permits and holidays regulated in Royal Decree-Law 10/2015 of 11 September, granting extraordinary credits and Credit supplements in the State budget and other measures in the field of public employment and stimulus to the economy are adopted.

On the other hand, in the field of negotiation of different measures in the field of public employment, the possibility of increasing the possibility has been the object of negotiation in the General Administration of the Negotiation of the General Administration of the State Annual period of enjoyment of the days of leave for private affairs and holidays until the 31st of January. To date, it was extended to 15 January of the year following that corresponding to those permits and holidays.

Such an extension, which is considered to be rationalizing the enjoyment regime of those days, is thus incorporated into the Resolution of 28 December 2012.

On the basis of the above, this Secretariat of State, in exercise of the powers conferred by Article 12 of Royal Decree 256/2012, of 27 January, for which the basic organic structure of the Ministry of Finance and Public Administrations, resolves:

First.

The Resolution of 28 December 2012 of the Secretariat of State of Public Administrations is amended, giving instructions on working hours and working hours to the service of the General Administration the State and its public bodies, in the following terms:

1. Article 1 of paragraph 3 is amended as follows:

"3.1 The duration of the general day shall be 37 and a half weekly average working hours in annual computation, equivalent to one thousand six hundred and forty-two hours per year."

2. The wording of paragraphs 1, 3 and 7 of paragraph 9 is amended as follows:

" 9.1 Each calendar year the paid leave shall be a duration of 22 working days per year full of services, or of the days corresponding proportionally if the service time during the year was lower. For these purposes, Saturdays shall be considered to be non-working, without prejudice to any adaptations to special timetables.

For the calculation of the annual holiday period, the absences due to illness, accident, those arising from the enjoyment of the permits regulated in Articles 48 and 49 of Law 7/2007, of 12 April, of the Basic Statute of the Public Employment, or of the license referred to in Article 72 of the text of the Law of Civil Servants of the State, approved by Decree 315/1964 of 7 February, will have, in any case and for these purposes, the consideration of service time.

In the case of having completed the years of seniority in the Administration that are indicated, you will be entitled to the following additional days of annual leave:

-Fifteen years of service: Twenty-three working days.

-Twenty years of service: Twenty-four business days.

-Twenty-five years of service: Twenty-five business days.

-Thirty or more years of service: Twenty-six business days.

Such days may be enjoyed from the day following the day of compliance with the corresponding years of service. "

" 9.3 The holidays shall be enjoyed, subject to authorisation and provided that it is compatible with the needs of the service, within the calendar year and until 31 January of the following year, in minimum periods of 5 working days consecutive.

Without prejudice to the foregoing, and provided that the needs of the service permit, from the vacation days provided for in paragraph 9.1 of this instruction, the independent enjoyment of up to 5 working days may be requested. calendar year. "

" 9.7 Throughout each year, public employees will have the right to enjoy six days of leave for private matters, without prejudice to the granting of the remaining permits and licenses established in the regulations. in effect.

Likewise, public employees will have the right to enjoy an additional two days of leave for particular business from the day following that of the sixth three-year period, increasing, at most, on an additional day. for each triennium fulfilled from the eighth.

Such days will not be able to accrue to annual leave periods. The staff may distribute these days at their convenience, subject to authorization from their superiors and always respecting the needs of the service. Where for these reasons it is not possible to enjoy the said permit before the end of December, it may be granted until the following 31 January.

Without prejudice to the foregoing, and provided that the needs of the service permit, the days of leave for particular matters as well as, where applicable, the days of leave provided for in the following paragraph, may be accumulated to the holiday days that are independently enjoyed. "

Second.

The additional days of holidays corresponding to the year 2015 resulting from the application of the additional provision of Royal Decree-Law 10/2015 of 11 September 2015 will be able to be enjoyed independently, in the the terms set out in the second subparagraph of paragraph 9.3 of the Resolution of 28 December 2012, giving instructions on working time and working hours to the service of the General Administration of the State and its Public Bodies.

Third.

The provisions of this Resolution shall be taken into account by the Undersecretaries, as well as by the competent bodies of the other bodies and public entities and by the Government Delegates in their respective bodies. respective Autonomous Communities, when they approve the work schedules corresponding to their respective areas.

Fourth.

This resolution shall enter into force on the day following that of its publication in the "Official State Gazette".
