Royal Decree 454/2012 of 5 March, for which the basic organic structure of the Ministry of Defence is developed, was amended by Royal Decree 524/2014 of 20 June, as a result of the Defence Directive National dictated by the President of the Government, the Defense Policy Directive of the holder of the Department and the measures of administrative rationalization, simplification and elimination of duplicities and bureaucratic obstacles carried out by the Commission for the Reform of Public Administrations.

Following this change, the Government issued Royal Decree 806/2014 of 19 September on the organisation and operational instruments of information and communications technologies in the General Administration of the State and its Public Bodies, within the framework of the digital transformation process currently being developed in this administration.

The Secretary of State of Defense directs, drives and manages the policies of the systems, technologies and security of information in the field of defense. To enable a better exercise of these competences in the aforementioned process of digital transformation, this higher body needs, under its direct dependence, a management body with exclusive dedication in this field, so it is need to modify the dependency of the current General Information and Communications Technology Subdirectorate which, with the new name of the Information and Communications Systems and Communications Center and the sub-direction range (a) shall take all the powers and functions which, in the field of systems and technologies of the Information, communications and information security, so far have been addressed to the Directorate-General for Infrastructure.

Moreover, in order to improve the effectiveness of the Directorate General of Personnel of the Undersecretary of Defense, modifications are made to the distribution of functions of the different structures that compose it. Thus, the competencies on the planning of personnel of military personnel are integrated into the General Subdirectorate of Human Resources Costs, in such a way that this general sub-directorate assumes the functions of planning the totality of personnel. Civilians and military personnel serving in the Ministry of Defense. In addition, along the lines of promoting the social and equality policies promoted by the Ministry of Defense throughout the legislature, they are integrated into the Division of the Personnel Support Service, which is dependent on the Directorate-General for Personnel. the functions related to this subject, thus obtaining better coordination of resources.

In its virtue, at the initiative of the Minister of Defense, at the proposal of the Minister of Finance and Public Administrations and after deliberation of the Council of Ministers at its meeting of 18 September 2015,

Single item. Amendment of Royal Decree 454/2012 of 5 March, for which the basic organic structure of the Ministry of Defence is developed.

Royal Decree 454/2012 of 5 March, for which the basic organic structure of the Ministry of Defence is developed, is amended as follows:

One. Article 3 (3), which is worded as follows, is amended as follows:

" 3. The following management bodies are dependent on the Secretary of State for Defence:

a) The General Direction of Armament and Material.

b) The Directorate-General for Economic Affairs.

c) The Infrastructure General Address.

It also depends directly on the Secretary of State of Defense, with the rank of general sub-directorate, the Information and Communications Systems and Technologies Center, which is responsible for planning and development. the policies of the systems, technologies and information security of the Department, as well as the supervision and direction of its implementation. To this end, the competent organs of the Armed Forces and the autonomous agencies of the Department are functionally dependent on this center.

Correspond to this center, in the scope of its competencies, the following functions:

a) Define, plan and coordinate the policies of the information, telecommunications, and information systems of the Department. Lead the execution and control the compliance of these policies in the common field to the Department.

b) To direct and manage information and telecommunications systems in the common domain to the Department and the infrastructure on which they are based, in coordination with the General Staff of the Defense.

c) Collaborate with the General Staff of Defense in the tasks of designing and maintaining information and telecommunications systems in the field of the competencies of the General Staff of Defense.

(d) To provide for the representation and dialogue, in relation to information systems, telecommunications and information security, to other agencies of the State administration and, at international level, in coordination with the Defence Staff and the Directorate-General for Defence Policy. "

Two. Article 6 (1) is worded as follows:

" 1. The Directorate-General for Infrastructure is the management body responsible for the planning and development of the Department's infrastructure and environmental policies, as well as the supervision and management of its implementation. For these purposes, the competent bodies in the fields of the Armed Forces and the autonomous agencies of the Department are functionally dependent on this general direction. "

Three. In Article 6, paragraphs (f), (g), (h) and (i) of paragraph 2 and subparagraph (c) of paragraph 3 are not contained.

Four. Article 9 (3) and (4) are worded as follows:

" 3. The following management bodies are responsible for the Directorate-General for Personnel:

(a) The General Subdirectorate of Military Personnel, which develops the functions referred to in paragraph 2, paragraphs (b) and (c).

(b) The General Secretariat of Civil Personnel, which develops the functions referred to in paragraph 2.d).

(c) The General Subdirectorate of Human Resources Costs, which develops the functions referred to in paragraph 2, paragraphs (a), (e), (f), (g) and (i).

4. They also depend on the Directorate-General for Personnel:

(a) The Division of the Personnel Support Service with the organic level to determine the corresponding employment relationship, which develops the functions referred to in paragraph 2, paragraphs (h) and (j).

(b) The Military Observatory for Equality between Women and Men in the Armed Forces, which is organically integrated in the Division of the Personnel Support Service, develops the functions outlined in paragraph 2.k.).

c) The Castrose Archbishopric.

d) The Administrative Unit of the Royal and Military Orders of San Fernando and San Hermenegildo. "

Five. The additional second provision is worded as follows:

" Additional Disposition Second. Information and telecommunications networks and systems.

1. By agreement of the Council of Ministers the networks and systems to be managed and managed by the Center for Information Systems and Technologies and the Communications of the Ministry of Defense will be determined.

2. Prior agreement with the Center for Information and Communications Systems and Technologies, the Directorate General for Civil Protection and Emergencies of the Ministry of the Interior will be able to use, in emergency situations, the targeted networks and managed by the above mentioned centre. "

Additional disposition first. Removal of management bodies.

The General Information and Communications Technology Subdirectorate is deleted.

Additional provision second. No increase in public spending.

The measures included in this royal decree will not entail any increase in appropriations, remuneration or other personnel costs.

Single transient arrangement. Units and jobs with the lower organic level than the general sub-direction.

The units and jobs with the lower organic level to the general sub-directorate will continue to remain and will be paid from the same budget appropriations until the corresponding relations are approved. or catalogues of Department jobs adapted to the organic structure modified by this royal decree.

The units and jobs surveyed in the deleted organs, or whose organic dependence has been modified by this royal decree, will be provisionally assigned, by means of a resolution of the Deputy Secretary of Defense, until the corresponding relations or catalogues of jobs, to the bodies regulated in this royal decree, are in force in accordance with the privileges assigned to them.

Single end disposition. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
