The Spanish Office of Climate Change (OECC), under the Ministry of Agriculture, Food and Environment, is the executive body responsible for the functions of climate change prevention. they are reflected in Article 3 of Royal Decree 401/2012 of 17 February, for which the basic organic structure of the Ministry of Agriculture, Food and the Environment is developed, which require specific knowledge and technical requirements and experience which justify that the holder is not necessarily a public official.

Thus, among others, it is the responsibility of the Director of the OECC, to analyze and promote research activities; the integration of adaptation to climate change in the planning of sectoral policies; the development and implementation of technologies for the reduction of greenhouse gases and their transfer to development and cooperation policies.

The OECC is closely related to the United Nations, as well as to the European institutions, public administrations, NGOs, public and private institutions and other social partners to collaborate with initiatives related to the fight against climate change also provides advice to different bodies of the General Administration of the State in matters related to climate change.

You must also highlight the political load of your functions. It is up to the OECC to formulate national climate change policy. This policy transcends the purely administrative powers necessary to achieve the various sectors of the country's economic activity, which requires knowledge of all these sectors of private activity that are not required. in the field of the General Administration of the State in any of the Bodies of officials whose statutory tasks correspond to the professional qualification demanded in the management of these areas.

Therefore, in the field of the Ministry of Agriculture, Food and the Environment, and in accordance with Article 18.2 of Law 6/1997, of April 14, of the Organization and the Functioning of the General Administration of the State, The appointment of the holder of the Spanish Climate Change Office, with the rank of director-general, is considered appropriate except for the official reserve.

Under the initiative of the Minister for Agriculture, Food and the Environment, on the proposal of the Minister for Finance and Public Administration and after deliberation by the Council of Ministers at its meeting on 25 March. September 2015,

DISPONGO:

Article first. Amendment of Royal Decree 1887/2011 of 30 December 2011 establishing the basic organic structure of the ministerial departments.

The following point (f) is added in paragraph 2 of the fourth additional provision. "Exception in Directors General appointments":

"f) Spanish Office of Climate Change of the Ministry of Agriculture, Food and Environment."

Article 2. Modification of the Royal 401/2012, of February 17, for which the basic organic structure of the Ministry of Agriculture, Food and Environment is developed.

The following additional provision is added in Royal 401/2012, dated February 17, for which the basic organic structure of the Ministry of Agriculture, Food and Environment is developed:

" Additional disposal sixth. Exception in the appointments of Directors-General.

According to the provisions of article 18.2 of Law 6/1997, of July 14, of the organization and operation of the General Administration of the State, it will not be necessary for the holder of the Spanish Office of Climate Change, with the rank of director-general, with the status of official, in consideration of its specific characteristics. "
