Organic Law 2/2006, of 3 May, of Education, contemplates the importance of learning throughout life, establishing as one of its basic principles the duty of the educational system to prepare students for to learn for themselves and to make it easier for adults to incorporate them into the different teachings. In addition, it indicates that the education system should facilitate, and public administrations should promote, that the entire population will be able to achieve secondary or equivalent secondary education training.

Organic Law 2/2006, of 3 May, regulates in Chapter IX of Title I the education of adult persons and, in particular, in its article 67,9 determines that by way of regulation, in attention to the special circumstances of the adult persons, specific curricula may be established leading to the titles established in law.

In the same way, Article 69 states that it is up to the educational authorities to promote the necessary measures to provide all persons with the opportunity to access the teaching of Baccalaureate, and to take the necessary measures. For adults to have a specific offer of these organized studies according to their characteristics, both in person and at a distance.

On the other hand, Royal Decree 1105/2014 of 26 December, establishing the basic curriculum for compulsory secondary education and the Baccalaureate, and Order ECD/1361/2015 of 3 July, establishing the (a) the curriculum for the Ministry of Education, Culture and Sport, and its implementation, as well as the ongoing evaluation and certain organisational aspects of the stages, are of In the field of the development of the curriculum in the subjects of the teaching of Baccalaureate for adults in the field of management of the Ministry of Education, Culture and Sport.

In order to adapt the Baccalaureate offer to the principle of flexibility governing the education of adults, in the offer made by the educational administrations for these persons, the provisions will not apply in Article 32.1 or 26.3 of that Royal Decree 1105/2014 of 26 December 2014, in which the promotion scheme and the stay at the stage are determined.

For the same circumstances set out above, students who are studying the baccalaureate for adults, within the block of specific subjects, will be exempt from physical education and will only be in one place. of the two at least as set out in Order ECD/1361/2015 of 3 July.

Finally, consideration will be given to the possibility that over sixteen years of age, who are in exceptional circumstances that will prevent them from pursuing the ordinary Baccalaureate regime, can cure the Baccalaureate for people adults in any of their schemes, as provided for in Article 67 of the Organic Law 2/2006 of 3 May.

Therefore, it is now appropriate, in the context of the regulatory framework described, to set out the provisions governing the teaching of adult Baccalaureate in the night, distance and virtual distance, in the field of Management of the Ministry of Education, Culture and Sport, both in the national territory and abroad.

In the elaboration of this order the School Council of the State has issued an opinion.

By virtue of the above, I have:

CHAPTER I

General provisions

Article 1. Object and scope of application.

The purpose of this order is to establish the framework for the management of the teaching of adult Baccalaureate, and it will be applicable in the educational institutions that belong to the management of the Ministry of Education, Culture and Sport.

Article 2. Organization.

1. The teaching of Baccalaureate for adults is organized in night, distance, and virtual distance.

2. The teaching of adult Baccalaureate in night and distance regimes shall be provided in ordinary or specific teaching centres duly authorised to provide Baccalaureate in ordinary arrangements.

3. The teaching of Baccalaureate for adults at a virtual distance will be offered by the Center for Innovation and Development of Distance Education (CIDEAD).

Article 3. Curriculum.

1. The Baccalaureate curriculum has been regulated by Royal Decree 1105/2014 of 26 December, establishing the basic curriculum for compulsory secondary education and the Baccalaureate, and subsequently completed by Order ECD/1361/2015, July 3, establishing the Compulsory Secondary Education Curriculum and Baccalaureate for the management of the Ministry of Education, Culture and Sport, and regulating its implementation, as well as ongoing and determined evaluation organizational aspects of the stages.

2. Order ECD/1361/2015, of 3 July, provides in Article 1.2 of the Order of 3 July 2015, the exceptional nature of the application of the Order for adult education centres, which shall be governed by their own rules.

3. Annexes I and II of Order ECD/1361/2015 of 3 July 2015 develop the content, evaluation criteria and learning standards that will apply to the subjects that make up the teaching of Baccalaureate for adults in the the management of the Ministry of Education, Culture and Sport of this Order.

4. Given the special circumstances of the population to which the Baccalaureate of adults is directed, with the purpose of facilitating the reconciliation of their studies with other activities, the structure of the first and second courses is established. In Annex I, the students are only to have a single subject in the block of specific subjects in each course from among those offered by the centre, and they will be exempted from the subject of the physical education and the subjects of the Autonomic configuration free subjects.

5. Each didactic coordination department shall, in its programming, provide the necessary adaptations for the delivery of these teaching for adult persons, together with the appropriate methodology for each teaching regimen.

Article 4. Curriculum proposal.

The teaching centers will develop and complete the curriculum established in this order through the elaboration of a curriculum proposal, which will be part of the educational project of the center.

Article 5. Training offer.

The teaching centers will configure, within the limits established by this order, their own training offer, which will collect the subjects that will be taught in each of the courses in which the Baccalaureate and the load are structured. the time frame for the different subjects in accordance with Annex I as well as the pedagogical basis for such time distribution.

Article 6. Access and permanence conditions.

1. In order to access the teaching of adult Baccalaureate, students must be over eighteen years of age or meet them in the calendar year in which the academic year begins, being in possession of the graduate degree in secondary education. Mandatory and have passed the final assessment of Compulsory Secondary Education by the option of academic teachings.

Exceptionally, they may access the teaching of Baccalaureate for adults over the age of 16 years, who meet the requirement set out in the previous paragraph and who prove to be in one of the The following situations:

(a) That they have an employment contract that does not allow them to go to the educational centers under ordinary conditions.

b) That the status of high level or high performance athletes is accredited.

2. Those persons who meet the requirements set out in the previous paragraph may access the Baccalaureate system at a virtual distance and may also comply with one of the following conditions:

(a) Being a Spanish nationality and residing temporarily or habitually abroad;

b) Or reside abroad without being a Spanish nationality having previously studied Spanish reglates;

(c) Or to be resident in Ceuta or Melilla or in an Autonomous Community where there is no Baccalaureate modality that they wish to pursue at a distance, or where there is exceptional cause to justify it. These cases must be expressly authorized by the appropriate educational administration and by the management of CIDEAD.

Exceptionally, persons over the age of sixteen years may be able to access these teachings in the cases referred to in the previous paragraph, or when they are in exceptional circumstances that prevent them from performing Baccalaureate studies under ordinary conditions. The exceptionality will be appreciated by the Educational Inspection Services, for which they will be able to obtain the documents that they deem pertinent.

3. Students who are cured for adults will not be subject to a temporary limitation of permanence.

Article 7. Promotion.

Students who are taught in the teaching of adult Baccalaureate will not apply the provisions of Article 32 of Royal Decree 1105/2014 of 26 December 2014, and the number of subjects will not be taken into account. The aim is to promote the promotion of one course to another, while retaining the qualification of the subject matter.

Article 8. Mobility.

1. The incorporation of pupils from the Baccalaureate for adults to the ordinary scheme shall take into account the provisions laid down for teaching in the latter scheme in Articles 26.3, for maximum stay of four years, and 32.1 on promotion, of Royal Decree 1105/2014, of 26 December.

2. Similarly, when changing the system, the student must overcome the subjects not covered by the adult regime.

3. The incorporation of a student from the ordinary regime to the adult regime shall be governed by the provisions of this order as regards the configuration of the studies, with the following considerations:

a) The subjects in the block of overlapping or overhanging trunk subjects will maintain the same condition.

(b) The student will be able to contribute the subject of the block of specific subjects that he has exceeded in each course in the regime of provenance. If you do not have an approved one, you must choose one of which you offer the center.

(c) For the calculation of the average note of the two Baccalaureate courses, only the subjects corresponding to the Baccalaureate system of adult persons shall be taken into account.

Article 9. Validations and equivalences.

1. When the number of adults is formalised, those who are eligible for adult education will be eligible for:

(a) Professional training modules, professional training of plastic arts and design and sports teaching with Baccalaureate subjects, in accordance with the provisions of Article 38.1.b) of the Royal Decree 1147/2011 of 29 July 2011 establishing the general management of the vocational training of the education system; Article 25 of Royal Decree 596/2007 of 4 May establishing the general management of teaching Plastic arts and design professionals; or Article 43 of Royal Decree 1363/2007, 24 of October, for which the general ordination of special regime sports teachings is established.

b) The subjects of the professional teaching of music and dance with the subjects of Baccalaureate, in accordance with the provisions of article 3 of Royal Decree 242/2009 of 27 February, establishing convalidations between the professional teaching of Music and Dance and the compulsory secondary education and the Baccalaureate, as well as the effects on the subject of physical education must have the status of high level or high performance athlete and the professional dance teachings.

2. The materials listed in Annex II and those set out in the Annex to Order EDU/2395/2009 of 9 September 2009 for the promotion of an incomplete course of the education system defined by the Directive shall be considered equivalent. Organic Law 1/1990, of 3 October, of general ordination of the educational system, to another of the Organic Law 2/2006, of May 3, of Education.

3. The documents certifying the convalidations for any of the subjects shall be attached to the case of the student. The assessment documents shall use the term "validated" and the code "CV" in the box corresponding to the qualification of the subject matter of validation.

The subjects listed as validated will not be taken into account for the purposes of calculating the final qualification of Baccalaureate.

Article 10. Assessment.

1. Second-course subjects which involve continuity with other subjects of first as set out in Annex III to Royal Decree 1105/2014 of 26 December 2014 shall be entered as pending in advance (PT) until after the matter has been exceeded. first.

2. The assessment documents of each student shall include the necessary entries for the entry of Baccalaureate at night, distance or virtual distance.

Article 11. Curricular ordination.

The distribution of the materials corresponding to the two adult courses for adult persons shall be as set out in Annex I.

Article 12. Change of mode or of subjects within the same mode in Baccalaureate.

1. The student who starts his/her studies in one modality may apply for the change to another modality, or in the form of Humanities and Social Sciences to another itinerary, different from those coming curating. For these purposes, the general and option subjects of the block of trunk subjects already exceeded that are matched with those of the new modality or itinerary will become part of the required subjects, and the mismatched ones will be compute within the specific subject block as other subjects in the trunk subject block.

The subjects of the first course of the new modality or itinerary to be cured by the student will have the consideration of pending subjects, although they will not be computable for the purpose of modifying the conditions in which it has promoted to second.

2. In addition, students will be able to request the change of some of the option subjects of the block of unsurpassed trunk subjects. Both in this case and in the above paragraph, if the change requested involves the registration of a material which, according to the provisions of Annex III to Royal Decree 1105/2014 of 26 December 2014, requires prior knowledge, It shall apply the provisions of Article 33 of the said royal decree.

3. In any case, these changes will only be authorized by the Management of the Center when the requested modalities or itineraries are delivered.

4. All the overlapping subjects shall be computed for the purposes of calculating the average Baccalaureate note, with the exception of the change in the mode of those subjects of the abandoned mode that are not necessary to overcome the stage.

Article 13. Enrolment in the Baccalaureate for adults.

1. The secretariats of the educational institutions shall ensure that the enrolment in the Baccalaureate of adult persons is formalised upon review of the documents proving the possession of the requirements, both academic and personal.

2. The students of Baccalaureate for adults will be considered for all purposes as official students of the center in which they are enrolled.

3. The registration fee shall entitle to an ordinary final evaluation and to another extraordinary evaluation of each of the subjects.

4. Each student will make up his or her educational itinerary from a Baccalaureate modality in which he will explicitly formalize his/her tuition.

5. The addresses of the public teaching centres may exceptionally authorise the registration in the first quarter for duly documented reasons.

6. There shall be no simultaneous enrolment in Baccalaureate in two different teaching schemes.

CHAPTER II

Organization of the teaching of adult Baccalaureate in night time

Article 14. Features.

1. In order to adapt to the situation of persons accessing this system of Baccalaureate, the teaching schedule, with a general character, will take place between seventeen and twenty-two thirty hours, from Monday to Friday with the weekly hourly load. set out in Annex I, and shall not exceed twenty-six weekly sessions. Each session will have a minimum duration of fifty-five minutes.

2. Attendance at class is compulsory, not being able to be qualified by continuous evaluation those students who register an unjustified absenteeism higher than 25 per 100 of the total teaching time for each subject. The centres shall provide each student with this requirement at the time of registration.

3. Those students who, pursuant to the previous paragraph, cannot be qualified by continuous assessment in any material, shall carry out a specific final test of the same in charge of the appropriate teacher.

Article 15. Teaching centers and modalities.

1. The studies of Baccalaureate at night shall be given by the Institutes of Secondary Education, subject to the authorization of the Directorate-General for Vocational Training, on a proposal from the Provincial Directorates to which the report shall be accompanied. of the Education Inspectorate, where the personal, social and employment circumstances of a sufficient number of students so require. The authorization must specify the forms of Baccalaureate that can be imparted.

2. The arrangements which a teaching centre may provide shall be among those authorised therein for the ordinary scheme.

Article 16. Registration.

1. The registration in Baccalaureate at night shall be carried out on a general basis. However, and taking into account Article 7 of this order, students may be enrolled in the subjects they wish to do in accordance with their possibilities.

2. Students should preferably attend classes of subjects which they have not previously attended. The organisation of the centre shall provide, as far as possible, assistance to the classes of these subjects.

3. Without prejudice to the foregoing, in the case of second-course subjects which involve continuity with those of the first course, the number of such courses shall be conditional, and it is essential to have obtained a positive assessment in the the previous binding matter in order to be qualified as the next related subject, as set out in Annex III to Royal Decree 1105/2014 of 26 December 2014.

Article 17. Mentoring and guidance.

1. The tutorial action and the educational and professional orientation must aim to contribute to the integral and balanced development of all students, in order to facilitate their integration into society as citizens of full rights and, where appropriate, in the working world.

2. The direction and orientation of student learning and support for their educational process are part of the teaching function and are the task of all teachers, in a framework of collaboration with the tutor teacher and the Department of Guidance.

3. It is for the Management of the Centre to carry out, on a proposal from the Head of Studies, the allocation of tutoring.

Each group will have its corresponding tutor teacher, designated among the faculty that gives class to the group as a whole. The tutor will devote one hour a week to the attention of his students, who will be considered to be a teacher for teachers.

4. The tutor teacher, with the support of the Department of Guidance, will be responsible for the individualized attention and follow-up of his students, as well as their academic and professional orientation. It will also be for the coordination of the teaching team in the development and evaluation of teaching and learning processes and mediation between teachers, students and parents or legal guardians in their case.

It will also be necessary to keep the students and students of their group and the teaching team informed of all that they are aware of in relation to the teaching and complementary activities and with respect to the decisions taken in assessment, requiring their collaboration on the measures taken by the centre to promote the educational process.

CHAPTER III

Organization of the Bachelor's teachings for adults in remote and virtual distance regimes

Article 18. Features.

1. The teaching of Baccalaureate in the distance and virtual distance systems will be characterized by the autonomous work of the students and by the necessary tutorial action for the teaching and learning process. Both models will allow for greater flexibility for pupils to reconcile lessons with their professional activity and personal circumstances.

2. This tutorial action will be carried out in the remote system by means of the in-person and remote tutoring, and in the virtual distance by means of telematic tutoring.

Article 19. Teaching centers.

1. The studies of Baccalaureate by distance shall be taught by the Institutes of Secondary Education, subject to the authorization of the Directorate-General for Vocational Training, on a proposal from the Provincial Directorates to which it will be accompanied. the report of the Education Inspectorate, where the personal, social and employment circumstances of a sufficient number of students so require. The authorisation shall specify the forms and routes of Baccalaureate which may be provided.

2. The arrangements which a teaching centre may provide shall be among those which, in general terms, are laid down therein.

3. The teaching of Baccalaureate in a virtual distance will be taught through the Center for Innovation and Development of Distance Education (CIDEAD) throughout the national territory, according to the additional 42nd of the Law Organic 2/2006, of 3 May.

Article 20. Registration in the remote and virtual distance regimes.

1. Those who are going to take the Baccalaureate virtual distance will formalize the registration by telematic route in the deadlines indicated by the CIDEAD.

2. Those who are going to take up Baccalaureate at a distance will be enrolled in the Secondary Education Institutes that they have chosen, within the time limits determined by them.

3. Each student may be enrolled in the number of subjects he or she wants from the first and second courses. However, and without prejudice to the foregoing, in the case of second-course subjects which involve continuity with those of the first course, the number of such courses shall be conditional, with the requisite requirement having been obtained positive in the previous binding matter in order to be qualified as the next related, as set out in Annex III to Royal Decree 1105/2014 of 26 December 2014.

Article 21. Attention to students.

1. The students of the distance and virtual distance systems of the Baccalaureate will have a tutorial that guides their self-employed work. This guide will include, among other aspects, indications on the temporal distribution of the contents of the different subjects, the evaluation criteria, methodological guidelines, and the activities to be carried out, and will be completed annually with the instructions for registration, assessment dates, and any other information deemed to be of interest.

2. In the remote system, the elaboration of this guide will be the responsibility of the corresponding teaching departments, under the direction of the Head of Studies. Appropriate measures shall be taken by the management team of the relevant centre to ensure that the student receives or has access to this guide at the beginning of the course.

3. In the virtual distance, the elaboration of this guide will be the responsibility of CIDEAD. In the same way, the necessary measures will be taken to ensure that students have access to this guide at the beginning of the course.

Article 22. Mentoring and guidance.

1. Tutoring in the distance regime:

a) The tutorial support will be carried out remotely and in person, individually and collectively. At the beginning of the course, a calendar will be published, specifying the date and time of the individual and collective tutoring in each subject. In-person tutoring will be voluntary for students.

b) Through the mentorship of matter, an individualized follow-up of each student's learning process will be made.

c) For each subject, a collective tutoring will be scheduled that will be in-person and will be performed weekly. At the beginning of each quarter there will be a collective programming tutoring session, in the middle of the quarter one follow-up and at the end of the quarter, one of preparation of the evaluation. The remaining collective tutoring will be oriented to the support of the learning in each subject according to a program of activities that the tutor will establish and that will give to the students at the beginning of the course.

d) Students who are unable to attend collective tutoring must inform the tutor, at the beginning of the course, of the type of individual tutoring that best fits their possibilities.

e) The tutorial will be ensured through the educational team that will be constituted in each authorized center to impart these teachings, and will be integrated by the corresponding head of studies and the faculty of the The specified specialty for each of the materials.

f) You will be tutoring of subject matter for each course. For each of the subjects there will be a tutor, who will spend two hours a week in the individual tutorial in the case of the subjects assigned, at least three hours a week in the ordinary Baccalaureate regime, and one hour Weekly reading in the case of subjects to which under this scheme are less than three hours a week.

g) The schedule of collective and individual tutoring will cover all the week's reading days, ensuring that the tutoring of the same group and modality are concentrated in the shortest possible number of days to facilitate the attendance of the students.

h) In-person tutoring will have a fixed schedule that will be known to all students. These tutoring will last for fifty-five minutes.

i) The head of studies shall, in accordance with the pedagogical criteria laid down in the annual general programming, the general schedule of tutorials taking into account the availability of classrooms, teachers and the number of of groups.

j) At the beginning of the course, the schedules of the individual and collective tutoring, the program of activities of the latter, the timing of the evaluations and how much other information can be of interest will be made public. general for students.

2. Tutoring in the virtual distance regime:

a) In the organization of this kind of teachings, there will be no consideration of the attention of the classroom. Therefore, the work plan will include self-learning activities for students and virtual tutorial.

b) The tutorial function will be developed primarily through the Internet, through an educational platform or Virtual Education Center, with the communication tools available for individual and collective attention.

Article 23. Assessment of students in the distance and virtual distance regimes.

1. The assessment of pupils in remote and virtual distance schemes will take into account the specific particularities of the remote and virtual distance regimes, such as the impossibility of carrying out the continuous assessment in the same conditions as in the ordinary regime, the absence of a temporary limit of permanence, or the effects of the students ' ability to enroll in the number of subjects they wish.

2. An extraordinary evaluation session will be held in June for students enrolled in CIDEAD who would not have exceeded all the subjects in the regular final evaluation.

3. The Baccalaureate assessment minutes in the virtual scheme shall be in accordance with the model set out in Annex III of this order.

Article 24. Didactic media.

1. The teaching methods must enable students to acquire the skills proposed in the objectives of the Baccalaureate as well as those set out in the basic aspects of the relevant curriculum, and will meet the requirement of being self-sufficient for students to develop and control their learning process autonomously.

2. The Center for Innovation and Development of Distance Education (CIDEAD) is responsible for the design, production and management of the editing, production and distribution of teaching aids that enable the teaching of distance.

Single additional disposition. Persons with disabilities.

The addresses of the centres will take the necessary measures and resources to ensure that pupils with special educational needs arising from disability can access, cure and be assessed as a secondary school. with the principles, guarantees and measures laid down in Organic Law 2/2006 of 3 May, and in the Royal Decree of Law 1/2013 of 29 November, approving the recast of the General Law on the Rights of Persons with disability and its social inclusion.

Single transient arrangement. Promotion of an incomplete course with non-overlapping subjects from the curriculum prior to the Organic Law 8/2013 of 9 December for the Improvement of Educational Quality.

1. Students who have completed the first of the system of the system which is extinct under the ordinary scheme which, having suspended more than two subjects, wishes to enrol in adult Baccalaureate, must be registered for the first full course, but shall keep the note of the materials exceeded when they have the same name. Where they have different names, they shall be validated in accordance with the equivalences set out in Annex II to this order and, where appropriate, also taking into account the Annex to Order EDU/2395/2009 of 9 September 2009.

2. Students who have completed the first course of the system of the system which is extinguished in the ordinary system with a maximum of two subjects pending first or in the adult system with pending subjects, irrespective of their number, incorporate the second adult Baccalaureate course of the new system, and must recover only the subjects which have been completed and not completed.

3. The students who have completed the second course of the Baccalaureate of the system which dies and choose not to repeat a full course must be registered with the subjects with a negative qualification of second and, where appropriate, the subjects covered by the negative rating of first.

4. The student will be exempt from registration of specific subjects if he has overcome some of the subjects offered as an option in previous systems, as well as if he has overcome the subject matter Sciences for the contemporary world. Single repeal provision. Regulatory repeal.

From the total implementation of the modifications regulated by this order in adult education, the order of 16 December 2010, of 16 December, will be repealed. adult persons on a night, distance and virtual distance, in the field of management of the Ministry of Education.

Final disposition first. Implementation schedule.

The implementation of this order will be effective from the beginning of the academic year 2015/2016 for the first course of Baccalaureate, and from the beginning of the academic year 2016/2017 for the second course of Baccalaureate.

Final disposition second. Application.

It is up to the Secretary of State for Education, Vocational Training and Universities to dictate how many resolutions and instructions are required for the implementation of this order.

Final disposition third. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
