Commission Regulation (EU) No 1321/2014, as amended by Regulation (EU) No 2015/1088, lays down requirements for the continued airworthiness of aircraft and aeronautical products, components and teams and on the organisations and personnel involved in these tasks.

Regulation (EU) No 1321/2014, as amended by Regulation (EU) No 2015/1088, provides in Article 8 (2) (b) the possibility for Member States to choose not to apply certain provisions. In particular, Member States are granted the possibility of not applying until 28 September 2016, for ELA1 aeroplanes not used in commercial air transport, the following requirements:

i) The requirement for the competent authority to issue aircraft maintenance licences in accordance with Annex III (Part 66), new or converted, in application of point 66.A. 70 of the same Annex.

(ii) The requirement to have certified certified personnel in accordance with Annex III (Part 66), as set out in the following provisions:

-Points M.A. 606 (g) and M.A. 801 (b) 2 of Annex I (Part M).

-Points 145.A. 30 (g) and (h) of Annex II (Part 145).

In this regard, and in accordance with recital 2 of Regulation (EU) No 2015/1088, this State Aviation Safety Agency understands, as well as the Commission, that it is necessary to reduce complexity the detailed rules for the application of Regulation (EU) No 1321/2014 in order to adapt them to the risks associated with the different categories of aircraft and types of operations, and in particular to the minor risks associated with the aircraft of general aviation.

Thus, in order to simplify maintenance procedures with the intention of providing greater flexibility and allowing the owners of such aircraft to benefit from a reduction in costs, considers it necessary to make use of the possibility provided for in Article 8 (2) (b) and to postpone the entry into force of the requirements for ELA1 aircraft not used in commercial air transport.

By virtue of all the above, the Director of the State Aviation Safety Agency resolves to postpone the application of the above requirements, as set out in Regulation (EU) No 1321/2014, for ELA1 aircraft not used in the commercial air transport, until 28 September 2016.
