The Organic Law 2/1986, of March 13, of Forces and Security Corps, created the National Police Corps through the integration of the existing state-wide police corps, one of civil nature, the Superior Corps

The National Police-former Armed Police-, in consideration of its structure, organization and military character, had the right to use and hold the National Flag, granted by Decree 485/1970, of 26 February, by the that the right to use and hold the National Flag to the Armed Police Corps is granted.

This precedent, coupled with the condition of guaranteeing public freedoms and the security of the National Police, as well as the fact that it is a national organization that counts, among others, with units and Uniformed services, and participating in a diversity of commemorative events, make it worthy of holding the flag of Spain as a stimulus for the fulfillment of the public service entrusted.

The regulation of the use of the Spanish flag by the National Police is specific to it and is based on the provisions of Law 39/1981 of 28 October, which regulates the use of the flag of Spain and other flags and ensenas.

This royal decree consists of four articles, one additional provision, one repeal and two endings.

Article 1 grants the use of the Spanish flag to the National Police. Article 2 provides for its use by the Higher Police Headquarters and the National Police College. In Article 3, the protocol and escort of the flag of Spain is determined. Article 4 is dedicated to the measures and accessories of the flag of Spain in its use by the National Police. The single additional provision regulates its use in tribute to the fallen in act of service. The only derogating provision expressly repeals Decree 485/1970 of 26 February. The final provision first refers to the normative development, and the final disposition second to the entry into force.

In its virtue, in use of the regulatory enablement provided for in the additional provision of Law 39/1981, of October 28, at the proposal of the Minister of the Interior, in agreement with the Council of State, and after deliberation of the Council of Ministers at their meeting on 16 October 2015,

DISPONGO:

Article 1. Concession and use of the flag of Spain by the National Police.

1.The use of the Spanish flag is granted to the National Police, whose custody corresponds to the Operational Deputy Directorate of the Directorate General of Police.

2. The National Police will use the flag of Spain in the formations of its protocolary acts, especially on the occasion of the Police Day and in those other acts in which it concurs with other National Security Forces or foreign.

Article 2. Bodies and units of the Directorate-General of the Police that will be able to use the flag of Spain.

In the field of the Police Directorate General, the use of the Spanish flag will be the responsibility of the Police Superior Headquarters and the National Police College.

Article 3. Protocol and escort of the flag of Spain.

1. In the acts or ceremonies with static formations, the head of the same will order the position of maximum respect when the flag of Spain joins and comes out of the formation. When the Spanish flag is incorporated into the static formation, the head of the same will shout "police, live Spain", which will be answered by a "living".

2. The escort of honor will be composed of an escort chief, a standard-bearer and three escorts, who will be, respectively, an inspector, a sub-inspector and three police officers.

3. The incorporation and withdrawal of the formation of the Spanish flag correspond to national anthem honors in full version.

4. In accordance with the provisions of Article 2. Three of the Law 39/1981, of October 28, which regulates the use of the flag of Spain and other flags and ensenas, the treatment that the National Police will receive the flag, in no case will have the consideration of surrender of honors military.

Article 4. Measures and accessories of the flag of Spain in its use by the National Police.

1. When the Spanish flag is used by the National Police it will carry the Spanish coat of arms embroidered from both sides in the center of the yellow strip, around which the following inscriptions will be distributed in a circumference Police blue color: the legend NATIONAL POLICE, at the top, and the name of the Superior Police Chief or, where appropriate, the National Police College, at the bottom.

2. It shall be fixed to the mast supported on the same fabric, cosioning it in a way that it can and fastened by a jar. It will take the moharra and tied to the pole a blue ribbon police, with which a loop will be made that will end both ends with a golden fleco.

3. The measures of the flag of Spain, when used by the National Police, will be as follows:

a) Long of 1,475 mm.

b) Width of 1,280 mm.

c) 520 mm shield height

d) Height of 80 mm letters

e) 340 mm inner circumference radius

f) Radio of the outer circumference of 420 mm.

4. The flagpole of the Spanish flag shall be made of wood or bamboo; at the top end it shall have a moharra and at the bottom a regaton, and a length of 2400 mm. from the tip of the moharra to the end of the regaton.

The moharra will have a spear-tip shape and will be of gold-colored metal, carrying the National Police's place-emblem.

5. The keeper will have a form of cazoleta and will have recorded the place-emblem of the National Police.

6. The holder will be an 80 mm wide leather band that will be lined with blue police cloth with a central strip with the colors of the flag of Spain. It will be a golden gallon ribested and will have a cuja to support the pole.

Single additional disposition. Use of the flag of Spain in tribute to the fallen in act of service.

In the event of the death in the act of service of National Police officials or personnel of the Directorate General of Police, the flag will fly at half-mast in the police buildings and during the period determined by the police. each case the Minister of the Interior, on a proposal from the Director General of the Police, attending to the concurrent circumstances.

Single repeal provision. Regulatory repeal.

1. Decree 485/1970, of 26 February, is hereby repealed, granting the right to use and flaunt the National Flag to the Armed Police Corps.

2. Likewise, the provisions of this royal decree are repealed as many provisions of the same or lower rank.

Final disposition first. Regulatory development.

The Minister of the Interior is authorized to dictate how many rules are necessary for the development and execution of the provisions of this royal decree.

Final disposition second. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
