The Spanish Constitution of 1978, in its article 103 states that the Public Administration acts in accordance with the principles of effectiveness, hierarchy, decentralization, deconcentration and coordination, with full submission to the law and law.

Also, Article 3 of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, establishes, among others, the following principles of organization and operation:

Hierarchy.

Functional decentralization.

Functional and territorial disconcentration.

Economy, sufficiency and tight media adequacy for institutional purposes.

Simplicity, clarity and proximity to citizens.

Coordination.

Effectiveness in meeting the goals set.

Efficiency in the allocation and utilization of public resources.

On the other hand, Article 12 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, provides that competition is indispensable and will be exercised by the a body that has it assigned as its own, except in cases of delegation or endorsement, when they are carried out in accordance with the terms laid down in this or other laws.

By virtue of these principles and in accordance with the provisions of Article 13 of Law No 30/1992 of 26 November 1992 and the Additional Provision of Law 6/1997 of 14 April 1997 on the Organization and the Functioning of the European Union the General Administration of the State which, in the case of non-hierarchically related bodies, establishes the prior approval by the higher body of which the delegated body depends, if the delegating and delegated body belong to different ministries, available

First. Delegated powers and bodies in which they are delegated.

Delegate to the Director-Provincial of the General Treasury of Social Security, of the National Institute of Social Security, of the Public Service of State Employment and of the Social Institute of the Navy in the Principality of Asturias, the competence in respect of permits and licences of officials assigned respectively in each of the bodies referred to in that Autonomous Community.

Second. Legal regime.

1. The delegation of powers agreed shall not entail the transfer of the ownership of the competition but only its exercise.

2. Whenever the delegation granted in this resolution is used, this circumstance shall be expressly indicated and the resolutions to be adopted shall be deemed to be dictated by the delegating body.

3. The delegation shall be revocable at any time and shall not be delegated the privileges conferred by it.

4. The powers delegated by this resolution may at any time be the subject of an endorsement by the delegating body, in accordance with Article 14 of Law No 30/1992 of 26 November 1992 on the legal system of Public Administrations and Common Administrative Procedure.

Third. Publication and entry into force.

This resolution shall be published in the "Official State Gazette" and shall have effect from the day following its publication.

Fourth. Modification.

To leave without effect point 2.3 of the Resolution of the Government Delegate in the Autonomous Community of the Principality of Asturias of 29 June 2001 ("BOPA" of 5 July), as regards the officials assigned to the General Treasury of Social Security, National Institute of Social Security, Public Service of State Employment and Social Institute of the Navy in the Principality of Asturias.
