By the Ministry of Development and the port authority of Aviles has been developed in the framework of the Plan of Use of the Port Spaces of the Port of Aviles a project in order to extend the mentioned port incorporating the new port facility called "Pier de Valliniello".

This dock is located on the right bank of the Aviles estuary, with an area of 18 hectares and a berth length of 996.5 m, corresponding to the phases of enlargement I and II.

It is a space of public domain related in the second section of the Order FOM/2361/2006 of July 4, for which the Plan of use of the harbour spaces of the port of Avilés (Area 9) is approved.

With the completion of its construction, the Port Authority of Aviles has come to request from the Department of Customs and Excise of the State Agency of Tax Administration to enable it as a customs precinct of the new port facility called 'Pier de Valliniello'.

The application has been informed in a positive manner by the competent border inspection services and by the Civil Guard, in their condition as Tax Resguardo, without prejudice to the limitations on the presentation of certain goods in application of the sectoral legislation in respect of, inter alia, health, veterinary or plant health.

examined such a request and taking into account that it does not imply the creation of an organic unit of any kind, in the use of the delegation for the clearance of customs offices conferred by the Resolution of 24 June 1999 of the Presidency of the State Administration of Tax Administration, delegation of powers in the Department of Customs and Excise, I have:

First. Enabling the Muelle de Valliniello Customs House.

1. The Muelle de Valliniello customs precinct attached to the Administration of Customs and Excise of Avilés, dependent on the Regional Dependence of Customs and Excise of Asturias of the Special Delegation of the Agency State of Tax Administration of Asturias.

2. All types of goods may be placed in the customs premises, without prejudice to the limitations laid down in the sectoral rules of nature, including health, veterinary, pharmaceutical, plant health, defence equipment, other material or products and dual-use technology.

Second. No increase in public expenditure.

The functions necessary for the exercise of the activity to be carried out in this customs precinct will be exercised by the personnel dependent on the Regional Dependence of Customs and Excise of Asturias, so the Implementation of the provisions of this Resolution will not imply an increase in the expenditure on the budget of the State Tax Administration Agency.

Third. Entry into force.

This resolution shall enter into force on the day following that of its publication in the "Official State Gazette".
