Organic Law 15/1999 of 13 December on the Protection of Personal Data sets out a set of measures to ensure, and protect, in the treatment of personal data, public freedoms. and the fundamental rights of natural persons, and especially their personal and family honor and intimacy.

Article 20.1 of Organic Law 15/1999, of December 13, determines that the creation, modification or deletion of files of the Public Administrations may be made only by means of a general provision published in the "Official State Gazette" or corresponding official journal. Similarly, the additional provision of the aforementioned Organic Law, orders the Public Administrations responsible for files to approve the provision of creation of the same.

The entry into force of Royal Decree 628/2014, of July 18, which regulates the peculiarities of the regime of authorizations to drive vehicles belonging to the Armed Forces and the Civil Guard, implies a change in the management of these permits and, consequently, requires the Ministry of Defense to adapt the files with personal data that support all the necessary procedures in this management.

Finally, in accordance with the provisions of Article 26 of the Organic Law 15/1999 of December 13, this project has been previously reported by the Spanish Data Protection Agency.

In its virtue, I have:

Article 1. Creating files.

The following personal data files are created from the Technical General Secretariat of the Under-Secretary of Defense as well as the Army of the Earth, Navy, and Air Force, described in Annex I of this ministerial order:

a) Armed Forces Driver Registration File.

b) File of Military Driving Permits and special authorizations to drive vehicles of the Armed Forces or the Civil Guard, transporting dangerous goods by road (TPC authorizations).

c) Land Army Driver Recognition Centers (ET) file.

Article 2. Deleting files.

The following personal data files listed in Annex II to this ministerial order are deleted:

a) File of the Driver Recognition Centers of the Earth Army Training and Doctrine Command.

b) File of special driving license situations at the Army Logistics Academy of Earth.

Single repeal provision. Regulatory repeal.

All provisions of equal or lower rank that are opposed to the provisions of this ministerial order are repealed.

Single end disposition. Entry into force.

This ministerial order shall enter into force on the day following that of its publication in the "Official State Gazette".

ANNEX I

Personal data files that are created

a) Armed Forces Driver Registration File.

(a) Finality of the file and the intended uses for it: Automated management of driving licences or special authorisation to drive vehicles carrying dangerous goods by road, as well as their behaviour and penalties for offences related to traffic and road safety, with the aim of controlling the behaviour of the requirements laid down by the rules in force.

(b) Persons or collectives on whom they are intended to obtain personal data or who are obliged to supply them: Military personnel, civil servants, employees, students and personnel outside the Ministry of Defense that they have of a military driving licence.

c) Procedure for the collection of personal data: The data subject himself or his legal representative. General government.

d) Basic file structure and description of the personal data included in the file:

Description of data types:

1) Name, surname, nationality and destination of the holder of the authorization, the number of your national identity document if it is Spanish or, if applicable, the number of foreign identity.

2) Date, place of birth and sex of the holder of the authorization.

3) Military situation.

4) Body/Scale, Category/Degree and Job Position.

5) Permission classes and other administrative authorizations or documents required to drive or related to driving.

6) Condition of professional driving, trainer or trainer trainer.

7) History and results of the various aptitude tests performed to obtain administrative authorizations to drive.

8) History, mentions and periods of validity of the different authorizations or documents that they authorize to drive.

9) Holds, incidents, restrictions and limitations related to the authorisation itself, the person holding it, the vehicle or the movement.

10) Identification of the health service or recognition center that performed the driver's scan and issued the corresponding psycho-physical fitness report, as well as the final result of such a report.

11) Court convictions affecting the administrative authorisation to drive and administrative penalties imposed by a firm decision on administrative basis by the commission of serious or very serious infringements.

12) Nullity or lesivity, loss of validity or precautionary measures taken.

13) Point Credit is available.

14) Source of the permit in case of exchange.

15) Other incidents related to administrative authorizations to drive.

e) Data transfers of a personal nature and, where appropriate, transfers of data that are provided to third countries: Judicial organs. Records of drivers according to Royal Decree 628/2014, of July 18, which regulates the peculiarities of the regime of authorizations to drive vehicles belonging to the Armed Forces and the Civil Guard.

a) Finality of the file and the intended uses for it: Manage high, swaps, renewals, duplicates and expeditions by modification of data of the military permits of driving of vehicles and authorizations for driving vehicles carrying dangerous goods belonging to the Armed Forces or the Civil Guard. Process reports about these permissions and authorizations that are requested by the drives.

(b) Persons or collectives on whom data of a personal nature are intended to be obtained or which are obliged to supply them. Military personnel, official, labor, students, and personnel outside the Ministry of Defense with military driving and/or TPC authorization.

c) Procedure for the collection of personal data: The data subject himself or his legal representative. Other natural persons other than the affected person or their representative. General government.

d) Basic file structure and description of the personal data included in the file:

a) Finality of the file and intended uses for the file: Determine the degree of psycho-physical fitness for obtaining and exchange of the military driving licence, in compliance with Royal Decree 628/2014, of July 18, for which regulate the peculiarities of the authorization regime for driving vehicles belonging to the Armed Forces and the Civil Guard. Management of data relating to the military driving licence of Ministry of Defence personnel.

(b) Persons or collectives on whom they are intended to obtain personal data or who are obliged to supply them: Civil and military personnel of the Ministry of Defense carrying out the proof of obtaining the permit Military driving.

c) Personal data collection procedure: On an individual request to the interested parties.

d) Basic file structure and description of the personal data included in it.

1. Identifiers: First and last names, DNI/NIF, address, telephone, and signature.

2. Personal Characteristics: Date and place of birth, age, gender and nationality.

3. º social circumstances: Military situation, licenses, permits, and authorizations.

4. Job Details: Body, scale, category, grade and job.

5. Data of a specially protected character: Health.

e) Recessions of personal data and, where appropriate, transfers of data that are provided to third countries: To the Records of Drivers, according to " Royal Decree 628/2014, of July 18, for which the peculiarities of the system of authorizations to drive vehicles belonging to the Armed Forces and the Civil Guard. " They should be limited to the "final outcome of the report" with the minimum data to verify the necessary psycho-physical skills of the affected person to drive vehicles; not including all health data that has been collected by the Recognition of Drivers in order to ensure full compliance with the provisions of Article 4.1 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data.
