View the relationship of Labour Parties for the year 2016 referred to the Ministry of Employment and Social Security by the seventeen Autonomous Communities and by the cities of Ceuta and Melilla,

And considering the following

Fact Background

First.

In accordance with the provisions of Article 45.4 of Royal Decree 2001/1983 of 28 July 1983, as amended by Royal Decree 1346/1989 of 3 November 1989, the 17 Autonomous Communities and the Cities of Ceuta and Melilla have referred to the Ministry of Employment and Social Security the relationship of Labour Parties for the year 2016.

Second.

The reference of the Working Party relationship to which reference has been made is intended to give publicity to them by publication in the "Official Gazette of the State", in accordance with the provisions of Article 45.4 of the Royal Treaty. Decree 2001/1983.

The above facts are applicable to the following

Fundamentals of Law

First.

When Article 45.1 of Royal Decree 2001/1983 of 28 July 1983 lists the parties at national level, which are remunerated and not recoverable, distinguish between the parties referred to in paragraphs (a), (b) and (c), which have the character of (a) national non-substitutable to the Autonomous Communities, and those reflected in paragraph (d), in respect of which the Autonomous Communities may choose to hold such parties on their territory or to replace them with other parties which, by tradition, are own.

Second.

Among the powers recognized in favor of the Autonomous Communities in Article 45.3 of the Royal Decree 2001/1983, there is also the possibility of replacing the rest of the Monday of the national parties that coincide in the Sunday for the incorporation into the relationship of parties of the Autonomous Community of others that are traditional to them, as well as the option between the celebration of the Feast of St. Joseph or the one of Santiago Apostle in its corresponding territory.

Likewise, Article 37 (2) of the Workers ' Statute, Recast Text, approved by Royal Legislative Decree 1/1995 of 24 March, empowers those Autonomous Communities in their last paragraph. establish one of its traditional festivals by not coinciding with Sunday a sufficient number of national holidays to add, in the year that so happens, one more party, with a recoverable character, to the maximum of fourteen.

Third.

The Directorate-General for Employment is competent to arrange for publication in the "Official Gazette of the State" of the relationship of parties communicated, in accordance with the provisions of the aforementioned article 45.4 of the Royal Decree 2001/1983, and in Royal Decree 343/2012 of 10 February, in order to comply with the aim of facilitating general knowledge throughout the national territory of the whole of the working parties, in such a way that together with the publication of the parties of the Autonomous Communities and the cities of Ceuta and Melilla are also transcribed National-wide labour parties of a permanent nature listed in that provision.

Seen the cited legal precepts and other general application.

This Directorate-General for Employment has the publication in the "Official Gazette of the State" of the list of parties at national level, Autonomous Community and the Cities of Ceuta and Melilla listed as Annex to this Resolution.
