Organic Law 8/2013, of 9 December, for the Improvement of Educational Quality, establishes a new management of the teaching of the Spanish educational system whose implementation schedule is collected in its final disposition fifth. According to the same, the new order is expected to replace the one defined by the Organic Law 2/2006, of May 3, of Education, in its original wording.

Royal Decree 1105/2014 of 26 December 2014 establishing the basic curriculum for compulsory secondary education and secondary education provides for the third final provision for the person holding the Ministry of Education, Culture and Sport is empowered to dictate how many provisions require the application of the provisions of the said royal decree, without prejudice to the powers that correspond to the autonomous communities.

In order to facilitate the transition from the previous order to the one derived from the implementation of the new Organic Law on equal conditions for all students, it is now appropriate to regulate the conditions under which it will Compulsory secondary education and Baccalaureate students are to be enrolled in a new system with subjects pending from the previous curriculum.

In the elaboration of this order, the Autonomous Communities have been consulted within the Sectoral Education Conference and the State School Council, and the report of the Ministry of Finance has been requested. Public Administrations.

Therefore, I have:

Article 1. Object.

This order aims to establish the procedure for the incorporation of students into a course of secondary education compulsory or high school of the educational system defined by the Organic Law 8/2013, of December 9, for the Improvement of Educational Quality, with non-overlapping subjects from the curriculum prior to its implementation.

Article 2. Compulsory Secondary Education.

1. The promotion of course without having exceeded all the subjects in compulsory secondary education shall be done under the conditions laid down in Article 22.2 of Royal Decree 1105/2014 of 26 December 2014 establishing the curriculum The basic education of compulsory secondary education and the secondary school. For these purposes, the table set out in the Annex, as well as the subject block to which the relevant subject matter belongs, shall be taken into account.

The students will have to recover the subjects completed and unsurpassed from the previous courses if they continue to be part of the organization of the corresponding course in the new management of the compulsory secondary education within the programming of the educational offer established by each educational administration. For the recovery of these matters, the curriculum derived from the aforementioned Royal Decree 1105/2014 of 26 December 2014 will apply. In the case of students with specific needs for educational support, account must be taken of the access, methodological and evaluation adjustments made before and during the stage.

In the case where the subjects submitted and not exceeded, in accordance with that Annex, are part of the block of specific subjects, the pupil or pupil may choose either to pursue them again or to replace them with any other of their choice within those belonging to the same block, according to the regulation established by the educational administrations.

2. In order to obtain the degree of Undergraduate in compulsory secondary education, the requirements laid down in Article 23 of Royal Decree 1105/2014 of 26 December 2014 must be fulfilled. Without prejudice to the foregoing, the students who have not obtained the degree of Undergraduate in Secondary Education may choose to submit to the annual tests provided for in Article 68.2 of the Organic Law 2/2006, of May 3, for obtaining the Graduate degree in compulsory secondary education, provided that it meets the requirements laid down. The educational authorities shall determine the parts which are regarded as exceeding those tests, in the light of the subjects or fields in question and the qualifications obtained in the years which the pupil or pupil has remained in school. Compulsory Secondary Education.

Article 3. Baccalaureate.

1. The promotion of the first course of Baccalaureate to the second will be done under the conditions set out in article 32.1 of Royal Decree 1105/2014, of December 26. For these purposes, the table set out in the Annex, as well as the subject block to which the relevant subject matter belongs, shall be taken into account.

2. The students who have completed the first course of the system which is extinct and are incorporated into the second course of the new system with pending matters must recover those which, in accordance with the correspondences laid down in the Annex, form part of the block of subjects within the modality chosen by the student or student. All other subjects which are submitted and not exceeded which, in accordance with the said Annex, are part of the block of specific subjects, must be submitted again or be replaced by any other chosen by the student or pupil within the to the same block according to the regulation established by the educational administrations. 3. In the event that the students or students who opt for the full course repeat have, in addition, non-overlapping subjects of the first course, the procedure for overcoming the latter will be the same as the one described in the paragraph 2.

The student who has completed the second of the Baccalaureate of the system that dies and has not chosen to repeat course, must recover all the subjects with a negative qualification of second and, where appropriate, the subjects with a negative rating of first which, in accordance with the correspondences set out in the Annex, are part of the block of subjects within the form of Baccalaureate.

In the case where the subjects submitted and not exceeded, in accordance with the said Annex, are part of the block of choice or specific subjects, the student or pupil may choose either to pursue them again, or replace them with any other of their choice within those belonging to the same block, in accordance with the regulation established by the educational administrations.

4. For the recovery of the non-overlapping subjects, the curriculum derived from the aforementioned Royal Decree 1105/2014 of 26 December 2014 will apply.

5. In order to obtain the title of Bachiller, the requirements laid down in Article 34 of Royal Decree 1105/2014 of 26 December 2014 must be complied with. Without prejudice to the foregoing, the student who has not obtained the title of Bachiller may choose to submit to the annual tests provided for in Article 69.4 of the Organic Law 2/2006 of 3 May for obtaining the title of Bachiller, whenever you meet the requirements set.

6. For all intents and purposes, it is to be considered in the above paragraphs that the students who before the course 2015 -2016, in the case of first of Baccalaureate and of the course 2016-2017, in the case of second, were pursuing the modality of Science and Technology will correspond to the new mode of science.

Article 4. Subjects that are not part of the educational offer.

Students who have non-overlapping subjects who have ceased to be part of the educational offer established by each educational administration for the teachings which are the subject of this order may choose not to pursue them again, in which the case of the qualification which it has previously obtained shall not be taken into account for the calculation of the average of the numerical qualifications obtained in each of the subjects submitted at the stage, or for replacing them with another of their choice according to the regulation established by the educational administrations.

Any of these options will be conditional on the number of subjects belonging to each of the subject blocks being the minimum that the student should be required to attend.

The student or student or his or her parents, mothers or legal guardians, must leave a written record of the option chosen when the number is registered.

Single transient arrangement. Assessment in accordance with the curriculum.

Exceptionally and in accordance with the provisions of the educational administrations, during the courses 2015-2016 and 2016-2017 the students to whom the provisions of this order are applicable may be evaluated of the non- exceeded according to the curriculum that you would have submitted.

Final disposition first. Competence title.

This order is issued pursuant to Article 149.1.30. of the Constitution, which attributes to the State the powers to regulate the conditions for obtaining, issuing and approving academic and professional qualifications and basic rules for the development of Article 27 of the Constitution in order to ensure compliance with the obligations of the public authorities in this field.

Final disposition second. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official Gazette of the State", and shall be applicable according to the timetable of implementation set out in the final provision of the Royal Decree. 1105/2014, of December 26.
