The employment offices in which the State Employment Public Service provides its services are integrated into the network of employment offices from which the various public employment services of the Autonomous Communities are incumbent, and At present many of them present very serious deficiencies from the point of view of working conditions and compliance with the current regulations in the prevention of occupational risks, especially in what affects the occupied spaces by the State Employment Public Service staff. Thus, serious problems related to accessibility, insufficient space, faulty air conditioning, inadequate furniture and the absence of safety and signalling measures, among others, are found.

The subhealing of these defects and the improvement of the working conditions of the employees of the State Employment Service are a priority for the agency, and thus has been addressed in the appropriate forums of relationship with the autonomous communities without obtaining the expected result so far.

For this reason, the Ministry of Employment and Social Security's approval of a line of grants for the adequacy and reform of the employment office facilities where the Service staff provides services is provided for. State Employment Public, aimed at financing the actions carried out by the autonomous communities of the network of offices that result in the renovation and modernization of the network and the improvement of the working conditions of the employees of the State Employment Service.

Through successive annual calls, the financing of the different investment actions will be guaranteed, the execution time of which will not exceed two years, so that the results in terms of comfort and safety are visible to the body and its employees within a reasonable time.

This measure will also be compatible with the maintenance of funding for the strengthening of the public employment services through actions and modernisation measures which are foreseen in the annual orders which territorially distributed for the management of the autonomous communities with assumed powers, grants from the field of work financed from the General Budget of the State, guaranteeing in any case that the same expenditure is not fund twice.

In this sense, it must be borne in mind that the expenditure to be financed through the respective call for the bases approved in this order could be subsidised from the funds provided for financing the programme for the modernisation of public employment services. However, with this order they are intended to undertake very specific and indefectionable investments, which put at risk the proper provision of their services by the staff of the State Employment Public Service, and which do not affect all of them. Autonomous communities. Therefore, it cannot be left to them to develop themselves from funds that are allocated to the autonomous communities on the basis of criteria that are largely unrelated to the needs that are exposed. In any event, the provision of the abovementioned programme for the modernisation of public employment services shall also take account of the needs to be met in each financial year by means of the call for this order.

Law 38/2003, of 17 November, General of Grants, establishes in Article 9 that, prior to the granting of the grants, in the field of the General Administration of the State, the rules must be approved establishing the regulatory basis for granting and shall be published in the "Official State Gazette".

For its part, Article 17 of the Law 38/2003, of 17 November, provides that the aforementioned regulatory bases must be approved by ministerial order and indicates the extremes that must be specified at least.

On the basis of the above, this order establishes the regulatory basis for the granting of subsidies, under competitive competition, to finance the expenses resulting from the renovation of facilities and equipment. of the employment offices with State Employment Public Service personnel.

In the process of drafting this order they have issued a report on State Advocacy in the Department and the Delegated Intervention of the State General Intervention in the State Employment Public Service.

In its virtue, with the prior approval of the Minister of Finance and Public Administrations, I have:

CHAPTER I

General provisions

Item 1 Object.

1. The purpose of this order is to establish the regulatory basis for the granting, by competitive competition, of grants for actions for the total or partial renewal of employment offices with the presence of Service personnel. State Employment Public, listed in Annex I.

2. The works of renovation, adaptation and/or repair of the facilities of the existing or new plant offices shall be eligible, exclusively the actions collected in an express manner in each call. In any event, such actions shall be aimed at ensuring an improvement in the working conditions of the staff of the State Employment Public Service who provide their services at the employment offices. In this same sense, a maximum amount will be established in the respective call for each performance.

Article 2. Beneficiaries.

1. They may be applicants and may acquire the status of beneficiaries of the grants referred to in this order, the regional authorities holding the employment offices with the presence of the staff of the Public Employment Service. State, or which may acquire such ownership. The determination of the proposed administrations will be set out in the corresponding calls.

2. The beneficiaries will have to prove, according to the respective call and by means of the responsible declaration provided for in article 24.6 of the Regulation of Law 38/2003, of 17 November, General of Grants, approved by the Royal Decree 887/2006, of July 21, which are in the current of the tax obligations and in the face of the Social Security, as well as not being incourses in the rest of the causes of exclusion provided for in article 13 of the aforementioned law.

Article 3. Obligations of the beneficiaries.

In addition to the general obligations under Article 14 of Law 38/2003 of 17 November, General of Grants, the beneficiaries will be obliged to carry out the activity which is the subject of a subsidy during the period to be determined in the relevant call and in any event shall comply with the minimum requirements per office set out in Annex II.

Article 4. Funding.

1. The funding of the grants regulated in this order shall be made from the expenditure budget of the State Employment Public Service, in accordance with what is determined in the relevant calls.

2. In any event, the granting of such grants shall be subject to the existence of the budgetary resources available for this purpose for each financial year.

3. In the light of the specific nature of the actions to be carried out and which are very specific to certain autonomous communities, the amounts used to finance the subsidies provided for in this order do not have the the nature of national employment funds within the meaning of Article 21 of the recast text of the Employment Law, approved by the Royal Decree of 23 October 2015, and therefore does not apply to them as provided for in the Article 86 of Law 47/2003 of 26 November, General Budget.

Article 5. Eligible expenditure.

1. Investments and expenses in facilities which are directly affected by the functions of the office of performance or which are common to those functions and to other functions of the beneficiary administration shall be considered as eligible. they have been carried out during the period to be determined in the call, and in no case may they be prior to the exercise of their approval. In any case, the respective calls shall establish in an express manner a list of the costs which may be eligible under the calls.

2. The facilities which are subsidised through the procedure provided for in this order shall be affected by the functions of the performance office for a minimum of 10 years from its effective implementation.

The period of execution of the works to be carried out shall not exceed two years from the date of the grant of the respective grant.

It shall not be necessary to comply with the time limits provided for in the first subparagraph of this paragraph when the withdrawal of the condition of office of performance or the permanent presence of the staff of the Public Employment Service at the employment office.

This assumption will not be considered as a drawback of the subsidies granted from those regulated in Article 37 of Law 38/2003 of 17 November.

3. Expenditure which is the subject of financing by the respective calls may not be included in the justification of the expenditure incurred in the programme for the modernisation of the public employment services, which for each financial year make the respective Autonomous Communities.

CHAPTER II

Procedure for awarding grants

Article 6. Scheme and start of the concession procedure.

1. The procedure for granting such subsidies shall be treated as a competitive competition by comparison of the applications submitted in order to establish a priority between them in accordance with the criteria for the assessment of the aid. previously set out in these regulatory bases and in the call, and to award, with the limit of the available credit set out in the call, those which have obtained the highest valuation in application of the above criteria, established in Article 22 of Law 38/2003 of 17 November.

2. In accordance with the provisions of Article 55.1 of the Regulation of Law 38/2003 of 17 November, General of Grants, a ranking order shall not be established between the applications submitted which meet the requirements laid down, if the sum of the amount requested does not exceed the total amount of the credit established in the call.

3. The procedure shall be initiated ex officio by means of a public call approved by the corresponding resolution of the State Employment Public Service, which shall be published in the national database of grants, in accordance with the procedure established in Article 20.8 of Law 38/2003 of 17 November, and in accordance with the principles of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure. That resolution shall specify the relationship of employment offices subject to the renewal actions to be undertaken.

The entities referred to in Article 2 of this order must submit the grant application, accompanying the documents and information specified in the call, unless the required documents are already in force. of any organ of the Acting Administration, in which case the applicant may avail himself of the provisions of Article 35 (f) of Law No 30/1992 of 26 November, provided that the date and the body or agency in which it is established are entered were submitted or, where appropriate, issued, and where no more than five years have elapsed since the completion of the procedure to which they correspond.

Applications shall be filed with the General Directorate of the State Employment Public Service, or in any of the forms provided for in Article 38.4 of Law 30/1992, of 26 November. The time limit for the submission of applications shall be one month from the day following that of the publication in the "Official Gazette of the State" of the relevant decision approving the call.

And in accordance with the provisions of Law 11/2007 of June 22, of electronic access of citizens to public services, the application may be made by electronic means.

Article 7. Objective criteria for granting and weighting the grant.

The Evaluation Commission provided for in the following article will assess the proposals according to the following criteria:

1. All proposals must necessarily meet the conditions and standards set out in detail for the office which is the subject of the call. Proposals which do not meet these minimum conditions according to Annex II shall not be eligible.

2. The proposals considered eligible will also be assessed on the basis of the following:

Up to 100 points, distributed as follows:

(a) Number of jobs of the State Employment Public Service, according to convocation, to be located in the subsidized office: 3 points per employee up to a maximum of 60 points.

b) Number of square meters per employee of the Public Employment Service available in the proposed office: 6 points for each square meter that exceeds the minimum set in the call for the job of the State Employment Public Service, up to a maximum of 30 points.

c) Project and schedule in relation to the same performance of the works: up to 10 points.

Article 8. Ordering and instruction of the procedure.

1. The General Subdirectorate of Resources and the Organization of the State Employment Public Service shall be the body responsible for the management and instruction of the procedure.

2. The proposals submitted will be subject to the assessment of an Evaluation Commission which will be composed of the Deputy Director General of Resources and the State Employment Public Service Organization, which will act as President; and three vowels, two belonging to that Subdirection, one of which shall be the holder of the Technical Advisory Committee on Materials, and the other, acting as Secretary, the holder of the Heritage Service and a representative of the Works Service of the Deputy General Manager of Financial Management of the State Employment Public Service. The operation of this Evaluation Commission will be in line with the provisions of Chapter II of Title II of Law 30/1992 of 26 November.

3. The Evaluation Committee shall issue a report setting out the outcome of the assessment of the applications in accordance with the criteria laid down in Article 7 of this order. The same report shall give a reasoned indication of the amount granted to each of the proposals submitted.

4. The functioning of the Evaluation Commission shall be addressed to the personal, technical and budgetary means of the State Employment Public Service.

Article 9. Determination of the amount of grants.

1. The Evaluation Committee provided for in Article 8 shall propose in its report the amounts of the grants taking into account the actions to be taken, the amount requested and the budgetary availability provided for in the call.

2. Grants shall not be awarded in excess of the maximum budget to be determined in the call. Where the sum of the amounts requested exceeds the maximum overall amount set out in the call, the Evaluation Commission shall relate the eligible proposals on the basis of the order of precedence achieved by the score obtained applying the assessment criteria of Article 7.

3. The amount of the grant shall be collected, both in the draft resolution submitted by the instructor and in the decision granting the grant, in accordance with the terms of Article 10.

Article 10. Resolution.

1. The Deputy Directorate-General for Resources and the Organization, in the light of the dossier and of the report of the Evaluation Committee referred to in Article 8 (2) of this order, shall make the proposal for a provisional, duly substantiated, resolution of the parties concerned must be notified in the manner set out in the call, with a period of 10 days to submit claims.

It may be possible to dispense with the procedure for hearing where the proceedings are not in the process of being taken into account other facts or other arguments and evidence than those submitted by the parties concerned. In this case, the proposed resolution will have the ultimate character.

The arguments put forward by the interested parties will be examined, the proposal for a final decision, which must be expressed by the applicant or the list of applicants for which the granting of the aid is proposed, will be formulated. grant, and its amount, specifying its assessment and the assessment criteria followed to carry out the grant.

Where the amount of the subsidy referred to in the application has been amended in the motion for a resolution, the applicant may be asked to reformulate its application for the adjustment of the commitments and, where appropriate, conditions, to the grant grant, in the terms provided for in Article 27 of Law 38/2003 of 17 November.

2. Approved the final proposal, the head of the Directorate General of the State Employment Public Service will resolve the procedure. The time limit for resolving and notifying the decision shall be two months from the date of publication in the "Official Gazette of the State" of the relevant resolution approving the call.

3. After the period referred to in paragraph 1 has not been notified, the application may be deemed to be refused.

4. Against the decisions given by the Director General of the State Employment Service, which will put an end to the administrative road, it may be possible to make a preliminary injunction in accordance with the terms laid down in Article 44 of the Law. 29/1998, of July 13, regulator of the Jurisdiction-Administrative Jurisdiction or, if necessary, directly interject litigation-administrative in the terms provided for in the law mentioned above.

Article 11. Modification of the resolution.

1. Any alteration of the conditions under consideration for the grant of the grants, as well as the concurrent obtaining of grants or aid for the same purpose, may result in the modification of the decision of the concession.

2. The beneficiary of the grant may request the amendment of the resolution where circumstances that are over-sold, duly justified, affect the content of the subsidised activity or prevent the investment from being carried out within the time limit. in installations or equipment.

3. Such a request shall be submitted before the end of the period for the performance of the activity and its processing shall be carried out in accordance with the terms laid down for the grant of the grant.

4. In accordance with Article 64 of the Regulation of Law 38/2003 of 17 November, General Grants, the amendment of the resolution may be authorized only when it does not harm third-party rights.

Article 12. Payment of the grant.

1. The payment of the grant shall be made on the basis of justification by the beneficiary, of the performance of the activity or project for which it was granted in the terms set out in the present grant regulatory order.

The loss of the right to the full or partial recovery of the grant will occur in the event of a lack of justification or concurrence of any of the causes provided for in Article 37 of Law 38/2003 of 17 November.

2. Advance payments may be made up to the full amount of the grant awarded, which will involve the provision of funds on a pre-basis basis as the necessary financing in order to be able to carry out the actions inherent in the grant. grant.

3. In the present case, the beneficiaries of the subsidies regulated in this order, the autonomous communities, and the existence of financial relations between them and the State Employment Public Service every year to subsidise the Implementation of labour-related programmes and services, in application of the provisions of Article 42 of the Regulation of Law 38/2003 of 17 November, General of Grants, will not proceed with the provision of guarantees.

In any case, in compliance with the provisions of Article 20.3 of the Organic Law 2/2012, of 27 April, of budgetary stability and financial sustainability, prior to the grant of the grant will be requested a favourable, mandatory and binding report by the Ministry of Finance and Public Administrations when the autonomous communities benefiting from these grants have failed to fulfil their objective of budgetary stability, public debt or the spending rule in the terms and assumptions set out in the Budget Law General of the State of each financial year.

Article 13. Compatibility with other grants or aid.

1. These grants are compatible with other grants, aid, revenue or resources for the same purpose, provided that the total sum does not exceed the cost of the subject-matter of the grant at the premises of the employment offices, without prejudice to the provided for in Article 5.3 of this order.

In particular, they will be compatible with the funds earmarked for the program financed from the State Employment Public Service budget, for the modernization of the public employment services of the autonomous communities, to be included in the block "modernization" of the corresponding ministerial order for which they are distributed territorially for their management by the autonomous communities with assumed competences, grants in the field of employment The General Budget of the State.

2. In the event that the beneficiary receives other grants, aid, revenue or resources for the purpose provided for in this order, he shall inform him as soon as he has knowledge and, in any event, prior to the justification of the Application given to the grant received, and should be duly justified in the final supporting economic memory.

Article 14. Advertisement by the beneficiary of the grants received.

1. The beneficiary of the aid shall record the grant received from the State Employment Service for the improvement of the premises of the employment offices as follows:

(a) In the case of installations, a poster or plate, which is suitable for the same size and placed on a preferential site, must inform that the office as a whole or some of the facilities has been awarded a subsidy by the State Employment Public Service for its construction or reform, indicating the date and incorporating the logos that are included in Annex III.

(b) In addition to the above, information that certain installations have been constructed, acquired or reformed by means of a grant from the State Employment Public Service shall be recorded by the beneficiaries in the of activities, brochures and any form of dissemination or advertising on both printed and electronic media (web pages).

2. For the purposes of the above paragraph, the logos listed in Annex III shall be used, which shall in any case be in accordance with the Public Service Public Service Image Manual, adapted to the Image Manual. Article 15. Subcontracting.

1. The beneficiaries may subcontract up to one hundred per cent of the implementation of the activity constituting the subject of the grant, in accordance with the terms laid down in Article 29 of Law 38/2003 of 17 November, and as provided for in this Article. order.

The contractors will be obliged only to the beneficiary, who will assume full responsibility for the execution of the subsidised activity against the State Employment Public Service.

Contractors shall maintain the documentation of the costs at the disposal of the State Employment Public Service and other control bodies in compliance with their duty to cooperate and to facilitate the documentation is required in the exercise of its functions, in the terms laid down in Article 46 of Law 38/2003 of 17 November. "

2. Since the beneficiaries of these grants are Public Administrations, the subcontracting of the execution of the various projects will be carried out with total submission to the provisions of the Royal Legislative Decree 3/2011, of 14 November, by the the recast text of the Public Sector Contracts Act is approved.

3. In the case provided for in Article 29.3 of Law 38/2003 of 17 November, the conclusion of the relevant contract must be formalized in writing and be authorized in advance by the entity in the granting decision itself or by a later decision, issued within 15 days of the application for the authorisation. Authorisation shall be deemed to have been granted if the term of the granting authority passes.

4. If the beneficiary of the grant makes a minor contract of the ones regulated in article 122.3 of the recast text of the Law of Public Sector Contracts, approved by the Royal Legislative Decree 3/2011, of November 14, considers that the documentation required by Article 111 of that text is equivalent to the conclusion of the written contract provided for in Article 29.3 of Law 38/2003 of 17 November.

A contract may not be split in order to reduce the amount of the contract and to avoid compliance with the requirements set out in the previous paragraph.

Article 16. Justification for the grant.

1. The justification by the beneficiary of the fulfilment of the purpose of the grant and the material application of the funds received shall in any event be adjusted as set out in Articles 30 and 31 of Law 38/2003 of 17 November, and its development provisions, without prejudice to the submission to the verification and control that are relevant.

2. The justification shall take the form of a supporting account with supporting evidence of expenditure provided for in Article 72 of the Regulation of 17 November of 17 November, General of Grants, except that the amount of the subsidy granted is less than EUR 60 000 in which case the simplified supporting account provided for in Article 75 of this Regulation shall apply. Such justification shall be signed by the holder of the management centre who manages the grant and shall give its conformity to the Financial Controller or the economic-financial officer, in case of not counting the beneficiary administration with a tax authority which exercise the controller function.

The final report of the Provincial Monitoring Committee provided for in Article 18.3 of this order shall also be accompanied.

3. The justification shall be submitted within the maximum period of three months after the end of the period laid down for the implementation of the subsidised activity.

4. In addition to the above, before 31 January and 31 July of each financial year, the beneficiary shall draw up a report on the state of implementation of the investments made up to the date to be forwarded to the Public Employment Service. State through the Evaluation Commission provided for in Article 8 of this order.

Article 17. Reimbursement of subsidies.

1. The total or partial refund of the amounts received and the requirement of interest for late payment from the time of payment of the subsidy up to the date on which the refund is agreed, in the cases established In Articles 36.4 and 37 of Law 38/2003 of 17 November.

Furthermore, the total or partial reimbursement of the amounts received shall be carried out, where the subsidies are not justified with the requirements of Article 16 of this order and where the time limits for the application of the the affectation referred to in Article 5.2.

2. The graduation of the possible defaults referred to in the previous paragraph shall be determined according to the following criteria:

(a) The total non-compliance for the purposes for which the grant was awarded will result in the 100% drawback of the grant awarded.

(b) In the event of partial non-compliance, the drawback shall be made in proportion to the degree of non-compliance produced.

3. The drawback procedure shall be in accordance with the provisions of the Resolution of 12 April 2004, of the State Employment Public Service, on the procedure for the reimbursement of the grants awarded by the body and the actions (a) administrative expenditure arising from the voluntary collection of the revenue from public law of a non-tax nature arising from the reintegrations, as well as those referred to in Chapter II of Title II of Law 38/2003 of 17 November, and in Chapter II of Title III of its Implementing Regulation, approved by Royal Decree 887/2006, of 21 July.

Article 18. Monitoring of grants.

1. The actions supported will be subject to monitoring by the State Employment Public Service to ensure that its implementation is in line with the provisions of the grant resolution.

It will be carried out through the State Employment Service's Provincial Monitoring Committees that will be composed, at least, by the following members:

(a) The Provincial Director of the State Employment Public Service, who will act as President, and will be replaced in case of vacancy, absence or illness by the Provincial Deputy Directors, according to the order established in the Royal Decree 1383/2008 of 1 August 2008 approving the organic structure and institutional participation of the State Employment Public Service; the Provincial Deputy Director for Economic Management and the Director of the Office of Benefits supported as vowels, one of whom will act as secretary.

b) The Director General of Employment or the like of the respective Autonomous Community, shall designate three persons in its representation, who shall act as vowels.

2. The Commission shall meet at least once every quarter to monitor the actions and verify their proper implementation.

3. In addition to this, on a six-monthly basis and, in any case, to the completion of the supported action, the Provincial Monitoring Commission will submit a report to the Deputy Director General of Resources and Organization of the State Employment Public Service, in the details of the project's implementation, its suitability for the parameters approved in the award resolution and any deviations or non-compliances that may arise.

4. The operation of the Provincial Monitoring Committees will be attended with the personal, technical and budgetary resources of each of the Provincial Directorates of the State Employment Public Service, and will promote the use of electronic means in accordance with the provisions of Law 11/2007 of 22 June 2007 on the electronic access of citizens to public services.

Single additional disposition. Autonomous Community of the Basque Country.

The total or partial renewal of the offices located in the Autonomous Community of the Basque Country listed in Annex I shall be financed from the provisions of Royal Decree 1441/2010 of 5 November on the transfer of functions and services to the Autonomous Community of the Basque Country in respect of the implementation of labour law in the field of employment, employment and vocational training for employment, which is carried out by the State Employment Public Service.

Final disposition first. Competence title.

This order is issued in accordance with the provisions of Article 149.1.7. of the Spanish Constitution, which attributes to the State exclusive competence in matters of labor law.

Final disposition second. Legal system of application.

The granting of regulated grants in this order shall, as not provided for in this order, be adjusted to the provisions of the following provisions, as well as the other rules applicable to them:

a) Law 38/2003, of November 17, General of Grants.

b) Regulation 38/2003 of 17 November, General of Grants, approved by Royal Decree 887/2006 of 21 July.

c) Law 47/2003 of 26 November, General Budget.

Final disposition third. Enforcement powers.

The head of the Directorate-General of the State Employment Service is hereby authorized to make any decisions necessary for the application of this order.

Final disposition fourth. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".

Minimum Office Requirements

-The minimum spaces to be contemplated for the State Employment Public Service in the Shared Offices will be:

• 1 Dispatch for the Director of the State Employment Public Service with a minimum of 15 m2.

• 1 File of 15 m2.

• 30 m multipurpose shared room2.

• Employee toilets:

9 m2 up to 15 SEPE employees.

15 m2 for more than 15 SEPE employees.

• 5 m standby room2 per SEPE employee.
