Key Benefits:
Article 1. Object.
This is the object of this order:
(a) The fixing of the values of the remuneration for the operation for the second calendar half of 2016 resulting from the application of the IET/1345/2015 Order of 2 July 2015 laying down the methodology for updating of the remuneration for the operation of the facilities with specific remuneration to the type of facilities to which it is applicable.
b) The establishment of a new type facility, defining for the same the equivalence between the category, group and subgroup defined prior to the entry into force of Royal Decree 413/2014, of 6 June, and the new category, group and sub-group set out in that royal decree, also indicating their corresponding code for the purposes of determining the applicable remuneration scheme.
Also in this order are the remuneration parameters of the new type installation that will apply to the first semi-regulatory period defined in the first provision of Royal Decree 413/2014, 6 June, subject to the provisions of Article 20 thereof.
Article 2. Update of the remuneration to the operation for the second half of 2016.
1. The update of the remuneration for the operation, corresponding to the second half of 2016, of the standard facilities for which a value of the remuneration for the non-zero operation has been approved by ministerial order and the costs of which are In order to ensure that the price of the fuel is essentially dependent on the price of the fuel, it will be carried out in accordance with the provisions of Order IET/1345/2015 of 2 July 2015 laying down the methodology for updating the remuneration for the operation of the facilities with specific remuneration arrangements. The above mentioned facilities are those for the following collectives:
(a) Facilities type of groups a.1, b.6 and b.8 as defined in Article 2 of Royal Decree 413/2014 of 6 June.
(b) Type facilities for installations covered by the first transitional provision of Royal Decree 413/2014 of 6 June 2014, which would have been granted to the second transitional provision of Royal Decree 661/2007, May 25, by which the activity of electrical energy production is regulated under special conditions.
The data necessary for the application of the above methodology are set out in Annex I.
2. The values of the remuneration for the operation corresponding to the second calendar year 2016 resulting from the application of the updating methodology established by Order IET/1345/2015 of 2 July 2015 to the type-a-facility Those referred to in the previous paragraph are included in Annex II.
The values of the parameters A, B and C of the second half of 2016, of the type installations listed in Annex II, are those set out in Order IET/1345/2015 of 2 July 2015, Order IET/1344/2015 of 2 July, the Order IET/2735/2015, of 17 December, and in this order.
Article 3. Remuneration aspects of the type installation.
1. The equivalence between the category, group and sub-group defined prior to the entry into force of Royal Decree 413/2014 of 6 June 2014 and the new category, group and sub-group set out in that royal decree are set out in Annex III. for a type installation and its corresponding code.
The above equivalence, as well as the established type-installation, shall apply to installations for the production of electrical energy from renewable energy sources, cogeneration and waste that have been recognised (a) the remuneration first paid to the entry into force of Royal Decree-Law 9/2013 of 12 July 2013 adopting urgent measures to ensure the financial stability of the electricity system, referred to in the second and second provisions First transitional provision of Royal Decree 413/2014 of 6 June 2014 and those which do not correspond none of the facilities defined in Order IET/1045/2014 of 16 June 2015, Order IET/1344/2015 of 2 July 2015 and Order IET/2735/2015 of 17 December 2015.
2. The remuneration parameters of the type-installation setting out the specific remuneration scheme applicable for the year 2013 are those set out in Annex IV.1
3. The remuneration parameters of the type-installation setting out the specific remuneration scheme applicable for the years 2014, 2015 and 2016 are those set out in Annex IV.2. This Annex sets out:
(a) The value of the remuneration for the investment to be applied in the years 2014, 2015 and 2016,
(b) the value of the remuneration for the operation to be applied in the year 2014 and the first half of 2015,
(c) the value of the remuneration for the operation to be applied to the second half of 2015, as well as the values of the parameters A, B and C as defined in Order IET/1345/2015 of 2 July 2015,
(d) the value of the remuneration for the operation to be applied for the first half of 2016.
4. The remuneration parameters referred to in paragraphs 2, 3 (a) and 3 (b) above have been calculated in accordance with the provisions of Royal Decree 413/2014 of 6 June 2014 governing the production of electrical energy from sources of electricity. renewable energy, cogeneration and waste and in Order IET/1045/2014 of 16 June 2014 approving the remuneration parameters of the standard facilities applicable to certain installations for the production of electrical energy from renewable energy sources, cogeneration and waste, taking into account the calculation assumptions listed in Annex V to that order and the parameters listed in Annex V of that order.
5. The remuneration parameters referred to in paragraph 3.c above have been calculated on the basis of the methodology for updating, assumptions and data set out in Order IET/1345/2015 of 2 July 2015 laying down the methodology for updating of the remuneration for the operation of the facilities with specific remuneration.
6. The remuneration parameters referred to in point (3) (d) above have been calculated on the basis of the updating methodology set out in Order IET/1345/2015 of 2 July 2015 and the data set out in Annex VI to Order IET/2735/2015 of 17 December 2015. December.
Article 4. Regulatory life and standard value of the initial investment of the type installation.
1. The regulatory lifespan for the type facility defined in this order is 25 years.
2. The value of the regulatory useful life and the standard value of the initial investment of the type facility defined in this order may not be revised, as provided for in Article 14.4.1. of Law 24/2013 of 26 December of the Sector Electric, and in Article 20.1 of Royal Decree 41for Economic Affairs has authorised the Minister of Industry, Energy and Tourism to issue this order.
In Royal Decree 160/2016, of April 15, it was arranged that the Minister of Economy and Competitiveness in office assume the ordinary office of the cases corresponding to the Ministry of Industry, Energy and Tourism. However, after and pursuant to Royal Decree 290/2016 of 13 July, it has been provided that the Vice-President of the Government and the Minister of the Presidency in office replaces the Minister for Economic Affairs and Competitiveness in the the processing and approval of the Order setting out the values of the remuneration for the operation for the second calendar year of 2016 and approving a standard facility and its corresponding remuneration parameters. This is why this order will be signed by the Vice-President of the Government and Minister of the Presidency
Un3/2014, of 6 June.
Single additional disposition. Methodology for updating the remuneration for the operation for the second half of 2016 for installations using as main fuel biomass, with definitive operating authorisation in 2015 and 2016, including in the Order IET/2212/2015 ,of 23 October, which regulates the procedure for allocating the specific remuneration scheme in the call for new installations for the production of electrical energy from biomass located in the electrical system peninsular and for wind technology installations, convened under Royal Decree 947/2015, of 16 October, and their remuneration parameters are approved.
1. For the purpose of updating the remuneration for the operation, for the second half of 2016, of the type-installations falling within the scope of Order IET/2212/2015 of 23 October 2015, which they use as main fuel Biomass shall apply the methodology described in Article 6 of Order IET/1345/2015 of 2 July 2015.
2. For installations with definitive operating authorisation in 2015:
a) The value of ΔPcombs will be equal to the increase in the price of biomass between the second half of 2016 (Pcomb2016-2) and the value established as a mean of the price of biomass for the year 2015 (Pcomb2015), as expressed in the following equation:
ΔPcombs = Pcomb2016-2 -Pcomb2015
Where:
Pcomb2016-2: Estimated biomass price for the second half of 2016, expressed in €/MWhPCI.
Pcomb2015: Estimated price of biomass for 2015, expressed in €/MWhPCI.
b) The value of the biomass price for the second half of 2016 (Pcomb2016-2) is calculated assuming an annual increase of 1% from the biomass price for the second half of 2015 (Pcomb2015-2), according to the following equation:
Pcomb2016-2 = Pcomb2015-2 -(1 + Ta)
Where:
Pcomb2015-2: Estimated biomass price for the second half of 2015, expressed in €/MWhPCI.
Pcomb2016-2: Estimated biomass price for the second half of 2016, expressed in €/MWhPCI.
Ta: Annual rate of increase in the price of biomass, as a result of one, taking as a value 0.01 in accordance with Annex III and Annex VI of Order IET/1045/2014 of 16 June.
c) The biomass price for the second half of 2015 (Pcomb2015-2) is calculated as follows:
Pcomb2015-2 = Pcomb2015 -(1 + tb)
Where:
Pcomb2015-2: Estimated biomass price for the second half of 2015, expressed in €/MWhPCI.
tb: Is the quarterly rate of increase in the price of the biomass, by one, calculated using the following equation:
tb = (1 + Ta)1/4 -1
Ta: Annual rate of increase in the price of biomass, as a result of one, taking as a value 0.01 in accordance with Annex III and Annex VI of Order IET/1045/2014 of 16 June.
d) The value of Ros-1 shall be equal to the value of the remuneration for the operation for the year 2015 published for each IT in Order IET/2212/2015, of 23 October.
e) The values of the biomass price shall be obtained by considering a calorific value equal to that set out in Order IET/1045/2014 of 16 June for fuels in the group b.6, equal to 3.49 MWhPCI/t.
3. For installations with definitive operating authorisation in 2016:
a) The value of ΔPcombs will be equal to the increase in the price of biomass between the second half of 2016 (Pcomb2016-2) and the value established as a mean of the price of biomass for the year 2016 (Pcomb2016), as expressed in the following equation:
ΔPcombs = Pcomb2016-2 -Pcomb2016
Where:
Pcomb2016-2: Estimated biomass price for the second half of 2016, expressed in €/MWhPCI.
Pcomb2016: Estimated price of biomass for the year 2016, expressed in €/MWhPCI.
b) The biomass price for the second half of 2016 (Pcomb2016-2) is calculated as follows:
Pcomb2016-2 = Pcomb2016 -(1 + tb)
Where:
Pcomb2016-2: Estimated biomass price for the second half of 2016, expressed in €/MWhPCI.

(d) The biomass price values shall be obtained by considering a calorific value equal to that set out in IET/1045/2014 of 16 June for fuels in the group b.6, equal to 3,49 MWhPCI/t.
4. In the case where the value of the remuneration for the operation obtained from the previous methodology is less than zero, the remuneration for the transaction shall be deemed to be zero.
5. The values of the remuneration for the operation of the updated facilities as provided for in the previous paragraph, for the second half of 2016 are included in Annex III.
Single transient arrangement. Applicability of the values of the remuneration to the operation and the new type installation.
1. The values of the remuneration for the operation of the second half of 2016 shall apply from 1 July 2016.
2. The remuneration aspects of the new standard facility and its remuneration parameters, as referred to in Article 3, shall apply from the date of entry into force of Royal Decree-Law 9/2013 of 12 July 2013.
Single repeal provision. Regulatory repeal.
Any provisions of equal or lower rank are repealed as set forth in this order.
Final disposition first. Competence title.
This order has a basic character and is dictated b paragraph 1 of Annex IV introduces a third line which has the following content:

Final disposition third. Entry into force.
This order shall enter into force on the day following that of its publication in the "Official State Gazette".
