Commission Regulation (EU) No 83/2014 of 29 January 2014 amended, on the one hand, Commission Regulation (EU) No 965/2012 of 5 October 2012 laying down technical requirements and procedures for the use of the (a) administrative arrangements for air operations under Regulation (EC) No 216/2008 of the European Parliament and of the Council, incorporating, through the FTL Subpart of Annex III, the requirements relating to the time constraints of the European Parliament and of the Council; flight for commercial air transport operations with aeroplanes. Such amendments shall enter into force on 18 February 2016.

In accordance with Article 8.2 of Regulation 965/2012, air taxi commercial air transport operations, emergency medical services and operations with a single air taxi are excluded from the application of the abovementioned requirements. pilot, defining "air taxi operation", for the purposes of flight and activity time limitations, such as commercial, non-scheduled and on-demand air transport operations, conducted with aircraft with an operational configuration of maximum passenger seats (MOPSC) equal to or less than 19 seats.

On the other hand, Regulation 83/2014 also incorporates Regulation 965/2012, in its Annex II, the ARO.OPS.230 Determination of Irregular Schedules, which states that " for the purposes of flight time limitations, the The competent authority shall determine, in accordance with the definitions of 'type early and' type tardiodes in point ORO.FTL.105 of Annex III, which of these two types of irregular schedules shall apply to all air transport operators commercial under its supervision. "

It is therefore necessary for the State Aviation Safety Agency, as the competent authority, to establish the type of irregular schedule applicable to Spanish air operators engaged in commercial air transport.

Therefore, the Directorate of the State Aviation Safety Agency resolves:

First. Scope of application.

This resolution applies to commercial air transport operations with aircraft, except air taxi, emergency medical services, and operations with a single pilot.

Second. Irregular schedule.

It is determined, in accordance with ARO.OPS.230, the late type ("Late type"), as the type of irregular schedule applicable to all air operators to which the State Aviation Safety Agency has issued a Certificate of Air Operator (AOC).

Late type, is that irregular schedule for which it is defined, according to ORO.FTL.105:

-"an activity that starts early", such as a period of activity beginning between 5.00 and 6.59 of the time zone in which the crew member is acclimated; and

-"an activity that ends late", such as an activity period ending between 0.00 and 1.59 in the time zone where the crew member is acclimated.
