Article 20.1 of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, states that the creation, modification or deletion of files of Public Administrations may be made only by means of general provision published in the Official Journal of the State or the official journal concerned.

This same requirement was already imposed in article 18 of the Organic Law 5/1992, of October 29, of Regulation of the Automated Treatment of Personal Data, which was repealed by the aforementioned Organic Law 15/1999.

The Order of the Ministry of Public Works, Transport and the Environment of 27 July 1994, for which the automated data files were regulated, was approved in accordance with the provisions of this Article 18. personal character of this Ministry, and subsequently, the Order of the Ministry of Public Works of 4 October 1999, in order to update the relationship of automated files of personal data of the Ministry of Public Works. After the Order that has just been mentioned, several Orders were approved in which modifications were made to the relationship of files of the Department.

By means of the Order that is now approved, the list of files of the Ministry of Public Works is updated again in order to create a new file and modify a file for which the General Subdirectorate of Regime is responsible. Postal.

This Order, in accordance with Article 37.1.h of the Organic Law 15/1999, of December 13, has been submitted during its processing to the mandatory report of the Spanish Data Protection Agency.

In its virtue, I have:

First. Creating a file.

In Annex I of this Order the new creation file corresponding to the General Subdirectorate of the Postal System is related, which must be incorporated into the set of files of personal data of the Ministry of Public Works. This file is: "Management of queries, complaints and complaints in the scope of the universal postal service".

With regard to the file, the aforementioned annex states its identification, purpose, intended uses, persons or collectives on which it is intended to obtain personal data or which are obliged to supply them, origin of the data and procedure for its collection, basic structure of the file, description of the types of personal data included in it, treatment system, data transfers, transfers to third countries, responsible organ to exercise the rights of access, rectification, cancellation and opposition and file security.

Second. File modification.

In Annex II of this Order the file corresponding to the General Subdirection of the Postal System to be modified is related. This file is: "General Register of Postal Service Companies".

With regard to the file, in the above mentioned annex it is indicated its identification and the epigraps that are modified: name of the file, purpose, intended uses, system of treatment and responsible organ before which the access rights, rectification, cancellation and opposition.

Third. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".

The following file is created: File for "Management of queries, complaints, and complaints in the scope of the universal postal service".
